On August 1, 2024, at the government meeting, various amendments to the "Physicians' Order" were approved. 

Penalties have been toughened, starting with reprimands, suspension of medical services for a while, license suspension, fines from 100 thousand to 1 million new lek. The most serious penalty is the removal of the license to practice the profession of a doctor. e. 

No more than 12 hours a week in private

For doctors, it is specified that they cannot work in private hospitals or clinics more than 30% of the monthly hours that work in the public health system. In other words, if the maximum margin of work by law in public health institutions is provided for 5 days of 8 hours, or 40 hours per week, it is estimated that in private they cannot work more than 12 hours per week. 

It is not allowed to suggest one's own clinic to the patient

It is prohibited for any doctor to suggest to a patient who has gone for treatment and services at a public hospital to go to a private clinic. 

"Not to ask the patients, who presented themselves at the public health institution for treatment and services, in accordance with his specialty, to refer to the non-public health institution where he practices his profession" is stated in point D that is added Article 8 of the Order.

Request for double employment

A completely new article has been added to the Doctor's Order, article 8/a, which defines the criteria that must be met to have dual employment, state and private, and who is excluded. If a doctor wants to practice his profession privately, he must make a request to the head of the public health institution where he is employed. 

Doctors who are employed in public hospitals that have obtained the status of hospital autonomy cannot work in the private sector. So doctors who also have management positions. 
 
Name in electronic public register 

In case the holder assesses that there are no obstacles, he approves the request and notifies the Ministry of Health. The latter publishes the data of this doctor in a public electronic register. 

Disciplinary measures

Article 17 of the Doctor's Order provides for the disciplinary measures that are taken for doctors who commit violations of ethics, the Code of Ethics and Medical Deontology or make technical mistakes.

Measure: Remarks;
- Suspension to perform certain medical services, for a period from 6 (six) months to 3 (three) years; 
-Suspension of the license to practice the profession of doctor in its entirety, for a period from 6 (six) months to 5 (five) years;
-Fine worth from 100,000 (one hundred thousand) ALL to 1,000,000 (one million) ALL;
- Removal of the license to practice the profession of a doctor.

Disciplinary proceedings begin within 5 years from the moment the violation was committed. In the case when the doctor exercises his duty in the same health institution, where he committed the disciplinary violation, the disciplinary procedure starts immediately from the moment of its detection.

Disciplinary warning measure expires 3 years after it was issued or ended. The measure of suspension is extinguished after 5 years of the end of the period of suspension or payment of the fine. Whereas if a doctor's license is revoked, it cannot be returned. / CNA
