The Special Court of Appeal has directed SPAK to investigate the implication of the director of Tirana Waterworks, Elton Kacidhja, in the 5D affair. The Appeal decision mentions a number of indications and facts, which, according to him, SPAK has not properly investigated. Some of them are related to a tendering procedure for the reconstruction of the water supply network in the street: "Aleksander Moisiu".

Out of 14 economic operators, including the merger of economic operators "VAS Konstruksion sh.pk - Senka sh.pk", it results that after the evaluation of the offers, that of the merger of the middle operators was ranked fourth.

"It turns out that the KVO has disqualified the economic operator in the ranking whose offer was lower than the winning operators' union, while one of the offers has been evaluated as an abnormally low offer and has been disqualified. The tender

The tender for the reconstruction of the Waterworks on Aleksandër Moisiu street was announced on September 22, 2020. The limit fund of this contract was set at 42 million lek or 420 thousand euros and 14 companies or associations of companies participated in the competition.

The lowest offer in the tender was presented by the company "Euro-Alb sh.pk". This company offered to carry out the contract against a price of about 250 thousand euros. After Euroalb, the second lowest price was given by Ndregjoni with 265 thousand euros and in third place was the union of VAS Konstruksion-Senka with a price of 311 thousand euros. VAS Konstruksion is the former name of the 5D company.

According to the decision, during this time the director of the Waterworks, Kacidhja, had continuous communications with the deeded owner of 5D, Nestor Muhametllari. Their topic was not only the tender in Aleksandër Moisiu street, but also many other procurement procedures, where D seemed to receive privileged information directly from Elton Kacidhja.

"They communicate about projects, for the procurement of the reconstruction of the catastrophic discharger of the catchment, the Allgjate reservoir, projects for the Gjuslikonje reservoir, information on the problem of the Gjysylkane dam, they exchange documents with messages, before and after the public procurement procedure takes place. To create the impression that there is a very close relationship of cooperation between them", says one of the decisions of the Special Appeal, which leaves SPAK with many tasks related to the 5D affair.
