The Special Court has issued a verdict for Dritan Stoka, former Cadastre official, and Agim Osma, former mayor of Sauk, accused of corruption in the 2019 elections.
Stoka and Osma were found guilty of the criminal offenses of "Exercising unlawful influence over persons exercising public functions" and "Active corruption in elections", committed in collaboration.
Taking advantage of the shortened trial, Stoka was ultimately sentenced to two years in prison. Meanwhile, Osma's two-year prison sentence was converted to probation.
The decision was given by a panel of judges composed of judges Erjon Çela, Flora Hajredinaj and Bib Ndreca.
Full announcement:
1. The Special Prosecution Office against Corruption and Organized Crime has submitted to the Court the request with the subject matter: “Trial of the criminal case against the defendants Dritan Stoka and Agim Osma, accused of committing the criminal offenses “Exercising illegal influence over persons exercising public functions”, (before the amendments by Law No. 43/2021, dated 23.3.2021), committed in collaboration and “Active corruption in elections”, committed in collaboration, provided for by Articles 245/1, paragraphs 2 and 25, 328 and 25 of the Criminal Code”.
2. The trial of this case was conducted under the rules of summary trial. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime, with a panel composed of judges Erjon Çela, Flora Hajredinaj and Bib Ndreca, with decision no. 76, dated 26.11.2025, decided:
1. The guilty plea of ??the defendant Dritan Stoka for committing the criminal offense of "Exercising unlawful influence over persons exercising public functions" (before amendments by Law No. 43/2021, dated 23.3.2021), committed in collaboration, as provided for by Articles 245/1, paragraph 2 and 25 of the Criminal Code and, based on this provision, his sentence to 1 (one) year and 6 (six) months of imprisonment.
2. The guilty plea of ??the defendant Dritan Stoka for committing the criminal offense of "Active Corruption in Elections", committed in collaboration, as provided for by Articles 328 and 25 of the Criminal Code and, based on this provision, his sentence to 2 (two) years of imprisonment.
3. Pursuant to Article 55 of the Criminal Code on determining the punishment for committing two criminal offenses, the defendant Dritan Stoka is sentenced to a single sentence of 3 (three) years of imprisonment.
4. In application of Article 406/1 of the Code of Criminal Procedure, the above sentence is reduced by 1/3, definitively sentencing the defendant Dritan Stoka to a single sentence of 2 (two) years of imprisonment.
5. The defendant Dritan Stoka's sentence shall be served in an IEVP, a normal security prison.
6. The guilty plea of ??the defendant Agim Osma for committing the criminal offense "Exercising unlawful influence over persons exercising public functions" (before amendments by Law No. 43/2021, dated 23.3.2021), committed in collaboration, provided for by Articles 245/1, paragraph 2 and 25 of the Criminal Code and based on this provision his sentence to 1 (one) year and 6 (six) months of imprisonment.
7. The guilty plea of ??the defendant Agim Osma for committing the criminal offense of "Active corruption in elections", committed in collaboration, as provided for by articles 328 and 25 of the Criminal Code and, based on this provision, his sentence to 2 (two) years of imprisonment.
8. Pursuant to Article 55 of the Criminal Code on determining the punishment for committing two criminal offenses, the defendant Agim Osma is sentenced to a single sentence of 3 (three) years of imprisonment.
9. In application of Article 406/1 of the Code of Criminal Procedure, the above sentence is reduced by 1/3, definitively sentencing the defendant Agim Osma to a single sentence of 2 (two) years imprisonment.
10. Pursuant to Article 59 of the Criminal Code, the suspension of the execution of the decision to sentence him to imprisonment, for the remaining part not served, by placing the defendant Agim Osma on probation for a period of 24 (twenty-four) months, provided that during this time he does not commit another criminal offense and maintains regular contact with the Probation Service Office where he has his residence.
11. Pursuant to Article 60/9 of the Criminal Code, the defendant Agim Osma is ordered not to associate with convicted persons.
12. In accordance with Article 261/1 letter “b” of the Code of Criminal Procedure, the termination of the personal security measure “House arrest” imposed by decision no. 47, dated 28.04.2024 of the Special Court of First Instance for Corruption and Organized Crime.
13. Procedural costs during the investigation phase as well as court costs shall be borne jointly and severally by the defendants.
14. This decision may be appealed by the parties within 15 (fifteen) days to the Special Court of Appeal for Corruption and Organized Crime, a deadline which begins on the day following the notification of the decision. /CNA
