The doubling of the price of patents is dropped / the Competition Authority, on

The Competition Commission, in its meeting on 01.03.2023, considered the issue "On the legal evaluation of the act-agreement concluded between DPSHTRR, DPT, the National Association of Driving Schools, the Association of Driving Schools "Road Safety", in relation to determination of the payment fee and the minimum fiscal cost for the preparation and equipment with a driving license.

Në respektim të nenit 44 të Ligjit nr.9121/2003 “Për Mbrojtjen e Konkurrencës”, Komisioni i Konkurrencës vlerësoi se Akt Marrëveshja për përcaktimin e tarifës së pagesës dhe kostos minimale fiskale për përgatitjen dhe pajisjen me leje drejtimi, nëpërmjet përcaktimit të tarifës minimale ka rrezik eminent të sjellë një dëm të rëndë dhe të pariparueshëm për konkurrencën në ofrimin e këtyre shërbimeve, duke reduktuar seriozisht përfitimet që tregjet konkurruese ofrojnë për konsumatorët.

Vendimi

Autoriteti i Konkurencës ka vendosur marrjen e masave të përkohshme ndaj palëve nënshkruese të Akt Marrëveshjes nr. 2729 prot., datë 13.02.2023: Drejtorisë së Përgjithshme të Shërbimeve të Transportit Rrugor, Shoqatës “Kombëtare të Autoshkollave”, Shoqatës së Autoshkollave “Siguria në rrugë” dhe Drejtorisë së Përgjithshme të Tatimeve, si vijon:

Prohibition of the implementation of Agreement Act no. 2729 prot., dated 13.02.2023, regarding the determination of the payment fee and the minimum fiscal cost for the preparation and equipment with a driving license;

The deposition before the CA of all the practice followed until the signing of this Agreement Act, in order to carry out its legal assessment, based on Article 4, Article 69 and 70 of Law no. 9121/2003 "On the Protection of Competition";

The temporary measure is taken for a period of time until the end of the administrative procedure and the final decision of the Competition Commission. III. The non-implementation of this decision constitutes a serious violation of competition in the sense of Article 74, point 1, letter b), of Law no. 9121/2003. /CNA.al
