Rama's coded message on the Erion Veliaj case
Prime Minister Edi Rama discussed a number of important issues for the week ahead on his podcast "Flasim" today.

Rama focused on the role of justice institutions and especially the Special Prosecution Office, following the election of its new head, Klodjan Braho, regarding the handling of cases, which he stated should not be masked through statistics from the 'big bag' for what he called the 'nebulous' article of abuse of office.

"The fight against corruption, which cannot be considered fully fulfilled successfully by that institution (SPAK), if it is masked with statistics extracted from the "big bag" as the nebulous article of abuse of office is called, for which a new EU directive has just been issued, precisely to reflect on concerns that are not only ours or with Big Brother-type media games, with telephone transcripts extracted in violation of the law from investigative files, for which the EU also has very strict legal frameworks," Rama said.

And while Prime Minister Edi Rama mentions abuse of office, the most sensational case of this year is related to the arrested mayor of Tirana, Erion Veliaj, who has been proven guilty of abuse of office by another court decision, but also faces 12 other charges.

There are dozens of cases of abuse of office investigated by SPAK. Mayor Erion Veliaj also has this charge. It is his thirteenth charge. In fact, it is the law that provides for it and the law was made by the Assembly, along with the Criminal Code. SPAK and the prosecutors have nothing else to do, they will simply and only implement it.

Erion Veliaj's abuse of office is an accusation raised not according to any major investigation by prosecutors, but was found almost by a court decision. For those who do not know, Erion Veliaj had a confrontation in the Administrative Court of Tirana, for the construction of a road that went to the properties of Ajola, his wife, complained by Vlima Rakipi, which is also the law firm that has defended Mayor Erion Veliaj in many hearings.

So, Mayor Veliaj has an accusation in SPAK for abuse of office, as a result of a complaint filed by the law firm, which is now defending him in the GJKKO. This is the truth about abuse of office.

In fact, Rama is concerned about abuse of office, not only in relation to Veliaj, but also with other officials. And in the European Union, abuse of office has other approaches, unlike the Albanian Criminal Code. But, in the case of Erion Veliaj, abuse of office is proven by a prior court decision. It is completely different from other cases.

And if the Prime Minister wants to implement EU directives and regulate the issue of the accusation of abuse of office, that is in his hands. He has a constitutional majority. The Criminal Code is being discussed. It can be corrected, it can be regulated, it can be placed in the new Criminal Code and then, after the Parliament approves it, the prosecutors and the courts will implement it. The prosecutor when he files the accusation and the court when he gives the decision.

But, no matter how the Prime Minister behaves and whatever he asks: first, responsibility begins with him; and second, whenever he approves, abuse of office has no retroactive effect.

So, until the day we have a new criminal code with the article on abuse of office amended, until then the law will be implemented as it is. The Prime Minister cannot help either Erion Veliaj or other officials by demanding that the law be exceeded. So, since the European Union is guiding, the law should not be implemented. No, it is very simple: correct the law, make it with European Union standards and then it will be implemented.

There cannot be two standards for the implementation of the law, as is often requested in the Veliaj case.
One standard since he is Erioni and Mayor, and one standard for ordinary citizens. The law is one, one and only one, for every official and for every person who must carry out state duties. /CNA
