Constitutional Court Decision on Balluk/Prime Minister Rama shares the full

Prime Minister Edi Rama shared his position today, following the decision given by the Constitutional Court on the case against Deputy Prime Minister and Minister of Infrastructure and Energy, Belinda Balluku.

In his speech on the 'Flasim' podcast, Rama focused on the process, saying that from a legal perspective, this decision eliminated a dangerous precedent.

Rama described the previous decision as an 'Albanian-style' brutality in the interpretation of the law, which strikes at the democratic organization of the state. 

"The Constitutional Court lifted the suspension of the Deputy Prime Minister and decided to judge the case on the merits at the end of January. In legal terms, a unique precedent in the world was eliminated and the highest court of the country rejected an Albanian brutality in the interpretation of the law, which struck at the democratic organization of the state. 

Meanwhile, in the inter-institutional aspect, this unconstitutional and anti-democratic surprise, where a prosecutor and a judge took over the powers of the Prime Minister, the President, and the Parliament, thereby overwhelming the state and turning a legal process into a partisan trial outside the framework of the law, necessarily requires an equally inter-institutional reflection. 

Not just on this case, but in general on the disturbing symptoms of the irresponsible exercise of the independence of the new judicial power, making, in more than one case, the cure more harmful than the disease we are fighting together. 

This flash did not come out of the blue and it did not come alone, unfortunately or perhaps fortunately, because in parallel with the unconstitutional suspension of a minister, another Albanian-style brutality emerged, this time, not thanks to a single prosecutor's office and judge, but thanks to two associations of Albanian judges, with the opening of a trial by judges to increase their salaries. 

Yes, you heard that right, judges want to increase their own salaries. 

Not for the first time, unfortunately, but for the second time, they want to take back the powers of the government and parliament, showing, not just to the elected, but to the voters themselves, that above their will and beyond the constitutional boundaries between powers, they stand, the black platoons of Albania, with the supreme power of the hammer of justice now independent of politics. And that hammer that the Republic has entrusted to them for its high interest of equal justice for all, they can use whenever they want to forcibly open the coffers of the state budget, and to increase their salaries, and respectively 1600 euros plus per month for the ordinary courts and prosecutors' offices and 3100 euros plus per month for the Special Court and SPAK. 

An Italian proverb says "due indizzi non fanno una prova", two clues do not constitute a proof - which today, in fact, if you look at how people are accused in our political and media circles, they constitute, not one proof, but two convictions. 

But I will never follow the perverse logic of sentencing based on circumstantial evidence, not even in this case, but I will remain convinced that these two extremely disturbing indications do not prove that the protagonists of the independence of justice have lost their minds and have become convinced that they are the state, the law and justice, like the work of some brave men of the BKH, about whom I have heard many strange things, if they had come one day to the Council of Ministers building, and did not want to leave the door open according to the high security regulations of the Republic Guard. 

"So, I do not want to say that the thorns of old mindsets and diseases have taken the bridge of new justice, but I want to share with all the conviction that the time has come for a serious, professional and inter-institutional reflection, to separate the newborn baby from the dirty waters, in a historical process, where we must necessarily guarantee the success of the Justice Reform, we must guarantee the independence of the judiciary, but where, at the same time, we cannot necessarily allow the cure to become a bigger problem than the disease, endangering the freedoms, rights and breathing space of the country's administration and economy," Rama declared./CNA
