The Tirana Prosecutor's Office has requested "Prison arrest" for two architects who applied for a construction permit with false data in the E-permit.

According to the information, a verification of the coordinates results that the coordinates reflected in the relations by the AP or KB architects show different locations compared to the real location of the objects ascertained by the self-declarations at the ASHK.

The facilities were built in the plots of forest economies 1/a and 2/a, in the jurisdiction of the Municipality of Tirana.

Architects AP and KB have made it possible to apply data that shows false data, through E-permit.

After the verifications, the imposition of preventive seizure on the built objects was requested.

Notice of the Prosecution

The Prosecutor's Office at the Court of First Instance of General Jurisdiction, Tirana, has registered criminal proceedings no. 1285, of 2023 (joined), for the criminal offense "Illegal construction", provided for by article 199/ai of the Criminal Code, referring to in charge of MT, AT, FZ, AH, DD, GM, TV and MD citizens

Up to this stage of the investigation, it has been proven that the above citizens have applied to the E-Permit system, through AP and KB citizens (Architects), and have been provided with the respective reconstruction permits.

From a simple verification of the coordinates through the 'Google Maps' application, it results that the coordinates reflected in the relations from the AP or KB Architect, show different locations compared to the real location of the objects ascertained from the self-declarations at the ASHK, or even without location not advertising coordinates.

From the collected data, it appears that the facilities were built in the plots of forest economies 1/a and 2/a, in the jurisdiction of the Municipality of Tirana.

Citizen GM, administrator and sole partner of the entity Certi W South Balkans, has concluded a lease contract on 14.04.2021 with the Parks and Recreation Agency for the area of ??2000 m2, which is part of the forest fund, plot 1/a, for which the relevant acts have been compiled, finding that some of the iron and concrete structures as well as the surrounding wall are positioned on an area of ??the forest fund which has been put to use.

Architects AP and KB have made it possible to apply data that shows false data, through E-permit.

After the verifications, it is requested to place a preventive seizure on the objects built by;

MT with an area of ??370 m2, determined according to the minutes for the determination of violation no. 5271 dated 12.01.2023, of IMT and self-declared with application no. 62 dated 09.02.2023, at ASHK;

FZ with an area of ??370 m2, ascertained according to the minutes for ascertaining the offense no. 5272 dated 12.01.2023, of IMT and self-declared with application no. 63 dated 09.02.2023;

AT with an area of ??370 m2, ascertained according to the minutes for the ascertainment of the offense no. 5270 dated 12.01.2023, of IMT and self-declared with application no. 65 dated 11.02.2023, at ASHK;

AH with an area of ??370 m2, ascertained according to the minutes for the ascertainment of contravention no. 5269 dated 12.01.2023, of IMT and self-declared with application no. 72 dated 15.02.2023, at the ASHK;

DD with an area of ??360 m2, ascertained according to the minutes for ascertaining the offense no. 2582 dated 30.01.2023, of the IMT and self-declaration no. 38 dated 01.02.2023, at the ASHK;

Self-declared TV with application no. 5714 dated 31.03.2022, at the ASHK; AND

MD, which does not turn out to have applied for illegal construction, but claimed to have built the facility found based on building permit no. K-10349/2.

In the same way, there are conditions and criteria provided by article 228, 229, 230, 238, of the Penal Code, for determining the measure of security arrest in prison for citizens: AP and KB

There is a reasonable suspicion based on evidence that they have committed the criminal offense provided for by Article 186/3 of the Penal Code. Architects AP and KB have made it possible to apply data that shows false data, through E-permit./ CNA
