Vlora/Pacolli Airport Issue: Legal liability will be sought for any damage

Businessman Begjet Pacolli has reacted on social media regarding the Vlora airport issue.

In his post, Pacolli states that due to a series of decisions issued by judges Fatmir Ndreu, Mirjana Shagani and Miranda Nakaj, MABCO, although it owns 98% of the shares of the company VIA sh.pk, was deprived for months of the right to exercise control and the powers that legally belong to it as a majority shareholder.

He further adds that it is difficult to find a similar case in modern commercial law practice, where the owner of almost all the capital of a company is excluded from its management,

Among other things, he states that the completion of a strategic project was blocked for months, causing considerable economic, financial and reputational damage, damage for which, according to him, responsibility will be sought through legal channels. Pacolli emphasizes that his faith in true justice has never wavered.

Since October 2025, a series of decisions in the form of security measures, issued by judges Fatmir Ndreu, Mirjana Shagani and Miranda Nakaj, produced extremely serious consequences for the company MABCO Construction SA and for the Vlora International Airport project.

The Supreme Court subsequently annulled these measures, finding that they were contrary to the law. As a result of these decisions, MABCO, although it owns 98% of the shares of VIA sh.pk, was deprived for months of the right to exercise control and the powers legally due to it as a majority shareholder.

It is difficult to find a similar case in modern commercial law practice, where the owner of almost all the capital of a company is excluded from its management through measures that are later declared illegal by the highest court of the country. This case deserves to be studied as an example of the consequences of violating legal certainty and the right to property.

These measures also created the conditions for persons placed in the company's administration during this period to continue to block the works and prevent the entry of MABCO specialists and subcontractors to the airport. The completion of a strategic project was blocked for months, causing considerable economic, financial and reputational damage.

I am convinced that all damages caused will be held accountable through legal channels and that everyone will be held accountable for their actions or inactions, in accordance with the law.

The false narratives that have been built during this period are slowly disintegrating. My faith in justice has never wavered. I believe that honest judges and institutions that respect the law will continue to do their job with professionalism and impartiality.

Justice may be delayed, but when it acts on the basis of law and facts, it triumphs. /CNA
