The financial effect of dismissed judges from the re-evaluation reaches 9.6

Judges dismissed during the re-evaluation by the Independent Qualification Commission (IKC) and who remain suspended are costing the state's "pocket" dearly.

The summary report of the High Judicial Council for 2024 states that the financial effect from the start of the revaluation process until December 31, 2024 is estimated at hundreds of millions of lek.

According to the report, as a result of the transitional reassessment process, since the beginning of the process, 113 dismissal decisions have resulted from a final decision by the Special Appeals Chamber (SAC), of which 24 decisions belong to the year 2024.

"It results that since the beginning of the transitional re-evaluation process, a total of 144 judges have been dismissed from office by decision of the KPC, with a financial effect of 965.7 million lek, until December 31, 2024. For 2024 alone, 7 judges have been dismissed, by decision of the KPC, who are awaiting the development of the process at the KPA, while maintaining the status of judge due to suspension, as well as simultaneously benefiting from 75% of the initial gross salary, according to the law.

The estimated financial effect on the budget is 11.9 million lek. During 2024, a total of 60 judges with a decision by the KPK to dismiss from office result, who are awaiting the development of the process at the KPA, while maintaining the status of judge due to suspension, as well as simultaneously benefiting from 75% of the initial gross salary, according to the law. Such a situation is estimated with a financial effect of 140.9 million lek," the report states.

The same document notes that by December 31, 2024, there will be 33 judges dismissed from office, by decision of the KPC, who will await the development of the process at the KPA throughout 2025, while maintaining the status of judge due to suspension, but at the same time benefiting from 75% of the salary according to the law.

"From the data available to the Human Resources Directorate, it results that the number of vacancies in the system for judges is 136 vacancies (of which 75 are permanent and 61 are temporary vacancies)," the report states.

During 2024, a total of 272 judges effectively exercised the function of judge in courts of all levels during the same period of time. This means that the judicial system during 2024 functioned with almost 66.6% of its capacity, almost 6.6% more than in 2023, which resulted in 247 judges who effectively exercised their duties./ Monitor Magazine
