Accused of criminal group/ SPAK requests seizure of assets of two people

The Special Prosecution Office has requested from the GJKKO the confiscation of the assets of Erjon Kasmi and Xhulian Xhafa.

These individuals are under investigation after being accused of "Computer Fraud", "Structured Criminal Group" and "Committing Criminal Offenses by a Criminal Organization or Structured Criminal Group". 

The total value of Erjon Kasmi's assets is 1,108,920 euros and 13,300,000 lekë. While Xhulain Xhafa's assets reach a total value of 240,000 euros.

 

SPAK announcement

The Special Prosecution Office against Corruption and Organized Crime, on April 25, 2025, submitted to the Special Court the request for the confiscation of the assets of citizens Erjon Kasmi and Xhulian Xhafa, within the framework of property proceedings no. 13 of 2023.

Citizens Erjon Kasmi and Xhulian Xhafa are subjects of a property investigation, following the registration of criminal proceedings no. 300/2021*, on charges of committing criminal offenses:

"Computer fraud" committed in collaboration, in the special form of collaboration of a structured criminal group, "Structured criminal group" and "Commitment of criminal offenses by a criminal organization or structured criminal group", provided for by articles 143/b/2, 28/4, 333/a and 334 of the Criminal Code.

Based on the provisions of Law No. 10192 dated 03.12.2009 “On the Prevention and Suppression of Organized Crime, Trafficking, Corruption and Other Crimes Through Preventive Measures Against Property”, amended by Law No. 70/2017, investigations have been conducted within the framework of the property investigation and as a result, movable and immovable property of the persons under property investigation and persons related to them have been identified and seized.

At the conclusion of the property investigation no. 13/2023, it results that the seized assets are unjustified from legal sources and are presumed to be the result of criminal activity.

The value of the seized assets for which confiscation is requested is approximately 1,937,145 Euros and 33,089,854 Lekë:

Assets:

1. 2+1 type "Apartment", with a total area of ??110 m2, with an address in Yzberisht, Tirana, owned by Erjon Kasmi.

2. 3-storey residential villa + basement, with a perimeter area of ??420 m2 and a total building area + veranda of 342 m2, with an address in Selitë, Tirana, owned by Erjon Kasmi.

3. Unit, with an area of ??167 m2, with address: Rruga e Kavajës Tirana, owned by Erjon Kasmi.

4. Garage, with a total area of ??19 m2, with an address on “Margarita Tutulani” street, Tirana, owned by Erjon Kasmi and L. Leka,

5. Apartment, type Apartment (3+1) with an area of ??146.12 m2, with address on “Margarita Tutulani” Street, Tirana, owned by Erjon Kasmi and L. Leka.

6. Apartment, with an area of ??66.96 m2, with address “Margarita Tutulani” street, Tirana, owned by Erjon Kasmi and L. Leka.

7. Apartment, with a total area of ??96 m2, with address Bulevardi “Bajram Curri”, Tirana, owned by Erjon Kasmi.

8. Garage, with a total area of ??16 m2, with address Bulevardi “Bajram Curri”, Tirana, owned by Erjon Kasmi.

9. Land, with an area of ??2750 m2, of which 750 m2 is a building, with address Mazrek Tirana, owned by Erjon Ylli Kasmi.

10. Apartment, with an area of ??57 m2, located in neighborhood No. 13 Durrës, owned by Erjon Ylli Kasmi and L. Leka.

11. Property: 'Apartment', type 2+1, with a total area of ??117.05 m2, owned by L. Leka, with the property address at 'Rruga e Dafinave', Former Tirana Airfield.

12. Garages 2 (two), with a total area of ??40 m2, owned by L. Leka with the property address, at 'Rruga e Dafinave', Former Tirana Aviation Field.

13. 100 m2 orchard, owned by Erjon Ylli Kasmi, in Borsh Saranda.

14. 1000 m2 orchard, owned by Erjon Kasmi, in Borsh Saranda.

15. 1000 m2 orchard, owned by Erjon Kasmi, in Borsh Saranda.

16. 1000 m2 orchard, owned by Erjon Kasmi, in Borsh Saranda

17. The commercial entity 'Wood Land' Shpk, owned by Erjon Ylli Kasmi, based in Kashar, Mazrek, Tirana.

18. Apartment, with a total area of ??67.73 m2, owned by Xhulian Etem Xhafa with address Kryemëdhenj, Kavajë,

19. Garage, owned by Xhulian Etem Xhafa and S. Tila, with a surface area of ??16.30 m2, with address “Ndre Mjeda” street, Tirana.

20. Apartment, with an area of ??79.42 m2, owned by Xhulian Xhafa with NID J20623112M and S.Mustafa Tila, with address “Ndre Mjeda” street, Tirana./ CNA

21. Apartment” with a total area of ??93.8 m2, in the name of Xhulian Xhafa and S. Tila, with an address on “Ndre Mjeda” street, Tirana.

22. The monetary values ??seized in bank accounts amount to 588,225 euros and 19,789,854 lekë.

For citizen Erjon Kasmi, the value of real estate according to contracts is 1,108,920 euros and 13,300,000 lekë.

The value of real estate according to contracts for citizen Xhuljan Xhafa is 240,000 euros.
