"Partizani"/Maltezi file, open letter to Duman

Jamarbër Malltezi, the son-in-law of former Prime Minister Sali Berisha, has sent an open letter to the head of SPAK, Altin Dumani.

In the letter sent to the head of SPAK, Malltezi, who is accused in connection with the privatization of the properties of the former "Partizani" complex, stated that the postponement of the investigation period by SPAK under the rationale that 6 months are insufficient for the investigative process, it does not apply, as according to him he and his family have been under investigation for 3 years already.

Further in the letter, he emphasized that the decision to postpone the deadline will be opposed by his lawyers, as an illegal decision.

The second open letter for SPAK:

Hello Mr. Dumani, I learned about your decision to extend the investigations since 6 months was insufficient because the investigations are complex.
In fact, you are investigating for (1) the return of the property to the rightful owner after it was stolen by the communist thief state for 65 years, (2) the forced privatization of the ruined and occupied buildings (in cooperation with those officials who were paid for maintained and administered) and (3) development by private owners of their land. All these processes that have lasted over 25 years (since 1995) are private property for which you have no legal title, regardless of the misuse of the law to suit the interests or political orders of Taulant Balles and Edi Rames.

Contrary to what you wrote that maybe 6 months were not enough, you have been investigating me and my children by name and surname for over 3 years (eg see letter 10598 dated 24.12.2021). After Edi Rama ordered you at the SP Congress on April 09, 2022 and at the SP Assembly on May 07, 2022 to prosecute Sali Berishen as "the SPAK is being delegitimized and the entire justice reform" you, as a subordinate prosecutor, will start within a few days 6 investigation requests for Jamarber Malltezi, his wife and children, investigating even Berisha's granddaughters from the time they were not born yet (see documents with Prot. no. 3607 to 3612 dated 29.04.2022).

Therefore, we are not dealing with the extension of investigations beyond the 6-month deadline, but beyond 3 years, which puts you as a tool in the hands of Taulant Balles and Edi Rames for deliberate political procrastination.

After more than 15 years, hundreds of owners - descendants of the 5 founding owner families of Tirana - got their private property back after the state stole from them for 65 years and finally forced them to pay $800,000 for some dilapidated and occupied buildings and SPAK has doubts about corruption, why did it return its land to these 100 families, since one of these hundreds was Berisha's son-in-law!

Berisha did not give it to the son-in-law with PPP or VKM as Edi Rama does for Olsi or Bolino, but the land was returned to the legal owners in accordance with the laws. However, in the years 2005-2012, about 1,577,400,000 m2 of land was returned to over 510 thousand legitimate owners. Meanwhile, Edi Rama with his company decides to make his brother millions by donating him a military unit with 37,000 m2 of land including 5,160 m2 of buildings for only 1 euro! (see VKM 183 dated 9.3.2016).

So, my brother gave you 37,000 m2 of public land (private land of the Deliu and Lici families, but they didn't give it back because they called it a military ward in the expansion plan!) and 5,160 m2 of buildings between Tirana, except for 1 company of his own, one beautiful day and except for 1 euro, it is normal (no criminal offense), while the property is returned to hundreds of heir families in accordance with the law after 15 years of robbery through dozens of institutions and they are forced to pay another 800,000 euros for those usurped plots, there are suspicions of corruption and the head of the opposition must be arrested! Edi Rama, with his own company, has donated 6 million m2 of land on the coast to his friends and relatives, and removing taxes according to your pocket or pocket, while SPAK closes its eyes and turns into a political tool of the government for these massive thefts.

Until now, during the investigations, it has been proven that:
1. Taulant Balla filed a false report with many lies and continued to declare in the media that "I brought documents that the land was expropriated by Shefqet Verlaci and Jako Mane" (since as an ignorant person he knows Jakomon for a villager named Jako Mane), but SPAK does not dare to mention his name. I filed a lawsuit for false reporting against Taulant Balla, but SPAK "afterwards" did not dare to initiate criminal proceedings;
2. Edi Rama has squandered the task by bringing about 320,000 euros of damage to the finances of the municipality, but the defenders of the public interest do not dare to express themselves even though they have administered as evidence all the decisions of the courts regarding Edi Rama's legal violations. "Afermendsh" does not dare SPAK to speak for its commanders.
The prosecutors request an extension of the investigation beyond the 3 years and 6 months they have so far, on suspicions for an article that does not concern me, since I have never been a high official or a local elected official. Does the law matter or is it a useless technicality?
Furthermore, is it the standard of SPAK to request an extension of investigations by presenting lies with facts known and administered in the file? I am listing some for you:

Prokuroret genjejne sikur pronaret nuk e kerkuan pronen nga viti 1999 deri ne 2006 kur ne fakt jane me dhjetra kerkesa nga pronaret edhe ne 2000, 2001, 2002, por ligji i kohes lejonte kthim fizik fillimisht deri ne 5000 m2. Pronaret fisnike priten ligjin por kjo nuk do te thote qe nuk donin token qe te paret e tyre e paten blere me florinj sic i keni vertetuar ne dosje pasi po hetoni qysh ne 1935. Se ne cilin lokal jane takuar trashegimtaret e 5 familjeve pronare eshte zgjedhja e tyre. Edhe qe kane bashkepunuar per te marre mbrapsht pronen e vjedhur nga hajdutet komuniste vec i nderon familjet pronare. Edhe fakti qe kane rene dakort te mos nxjerrin ne rruge asnje familje informale i nderon. Edhe qe ndertuam kopshtin dhe cerdhen me te mire ne Tirane falas per komunitetin prape na nderon.

Prokuroret genjejne duke paraqitur nderrimin e destinacionit te zones nga sportive ne banim sikur e kreu Berisha kur ne fakt u krye nga 10 drejtoret e Edi Rames (Keshilli Teknik i Bashkise) me 12.05.2006 pa pasur fare kerkese te pronareve te tokes dhe pa firmosur ende pronaret e tokes kontrate me firmen ndertuese. Kjo eshte administruar ne dosje dhe fshehja e ketij fakti tregon qe po ju drejton urdhri politik dhe urrejtja ndaj pronareve e jo faktet apo ligji. Vendimin e Keshillit Teknik te perbere nga 10 drejtore te tij, po Edi Rama e miratoi ne KRT te Tiranes me 09.06.2006 dhe e coi ne KRRTRSH per miratim se bashku me nje dyzine tjeter vendimesh qe ju miratuan te gjitha ne fund te Nentorit 2006. A e keni arrestuar Edi Ramen per kete gje? Apo ai eshte mbi ligjin?

Prokuroret vijojne genjeshtren sikur ndryshimin e destinacionit te pjeses tjeter e kreu Berisha me Planin Rregullues se Tiranes ne 2013 kur ne fakt e ka kryer Edi Rama me drejtoret e tij dhe Keshillin Teknik te tij ne 2008 me kompanine Urbaplan dhe vendimin 238 te dates 27.12.2008 te KKRT Tirane. Keto vendime Edi Rama i ka marre pa kerkese te pales pronare te tokes dhe pa perfunduar procesin e privatizimit te objekteve te rrenuara.
Prokuroret genjejne lidhur me qenien apo jo te ish Klubit ne Planin e Perhapjes te Forcave te Armatosura kur dokumenti zyrtar tregonte se nuk ishte dhe per me teper as nuk posedoheshin pasi objektet e rrenuara ishin te uzurpuara nga 42 familje informale dhe dy biznese pa asnje tager ligjor, ndersa zyrtaret shteterore paguheshin nga shteti e mbyllnin syte ndaj zaptimit mesa duket perkundrejt rryshfetit.

Prokuroret vijojne genjeshtrat sikur perdorimi i letrave me vlere ne privatizim u krye per favorizimin e dhendrit te Berishes nderkohe qe kjo ka qene qysh prej 1995 dhe per me teper edhe para pak javesh u fut perseri ne Kuvendin e Shqiperise kjo nisme ne 2024! Per me teper Klubi Shumesportesh qe kushtoi rreth 700,000 USD u pagua i gjithi me para vec 1 muaj perpara se te dilte vendimi per perdorimin e letrave me vlere, ndersa i Futbollit (qe kish vec 1 ndertese) per te cilin u pagua me leke dhe letra me vlere ishte vetem 100,000 USD! Nese do kishte komunikim apo vullnet per te ndihmuar nje pronar te vecante do prisnim nje muaj me gjate per te kursyer pagesen e 700,000 USD, pasi ne total u pagua 720,000 USD me para ne banke dhe vec 80,000 me letra me vlere nga te cilat personalisht kam perfituar gjithsejt 64 euro.

Prokuroret politike nen urdhrat e Taulant Balles dhe Edi Rames ne vend qe te mbrojne interesin publik shkojne deri ne mbrojtje te vjedhjes se prones permes uzurpimit ose rryshfeteve ndaj zyrtareve duke injoruar shtetin e se drejtes. Ndofta prokuroret tuaj kane shpikur menyre tjeter per fitimin e pasurise pertej atyre qe parashikohen ne Kodin Civil.
Prokuroret politike konsiderojne presion inspektimin e ligjshem per te pare keqperdorimin e pozites zyrtare pasi kish perfunduar cdo procedure dhe pronaret e tokes kishin paguar edhe parate por perseri vijonte grabitja e prones gje perbente dem financiar pasi e ngarkonte shtetin per te paguar qira ndaj pronareve private. A mbrojne interesin publik dhe financat e shtetit apo urrejtja i ka zene syte? Jane te njejtet prokurore qe kane kryer shkelje ligjore dhe kushtetuese qofte me sekuestrimin e dosjes civile per shpifje ndaj Taulant Balles qe penguan te drejta kushtetuese per proces te rregullt gjyqsor te Prof. Malltezit, dhe qofte me sekuestrimin e gjithe dosjeve te pronave te gjithe fisit Begeja ne Kadaster! Denime kolektive kishim pare vec ne diktatura, por mesa duket “afermendsh” ligji dhe shteti ligjor nuk perfillen kur behet fjale per kundershtaret politike.

Me tej, krejt jashte tagrit ligjor, per nje investim krejt privat, ndonese nuk tregojne dot asnje shkelje ligjore shprehin preference te tyre nese duhet punesuar dikush si auditore apo kontabiliste. A kane turp e cipe keta prokurore politike, apo edhe turpin edhe cipen e kane me karar, aq sa ua lejon Taulant Balla dhe Edi Rama?

A calm mind immediately understands what motive prompts SPAK prosecutors to lie in an official document. My lawyers will oppose the decision to extend the investigation beyond 3 years and 6 months, as this is not only illegal, but perhaps a world record for a case where the state has not lost a single cent, on the contrary, it has gained $800,000 from stopping the illegality that was carried out by bribe takers. "By the way, the courts always decide what we (SPAK) demand" - I had the chance to experience it personally, but it is not something that you respect.
