The National Association of Judges has responded to the statement that Prime Minister Rama made yesterday against Judge Marko Boshku.
The association condemns Prime Minister Rama's statement, stating that it is unprecedented and unacceptable and that it is an attempt to usurp power.
For the Judges' Association, Prime Minister Rama's attack borders on a criminal offense.
Full reaction:
" The National Association of Judges of the Republic of Albania notes with outrage that once again the head of the Albanian executive, in a completely unprecedented and unacceptable manner, has attacked another judge of the Administrative Court of First Instance of Tirana, Mr. Marko Boshku. First, the Association expresses its full support for Judge Boshku, as a judge with integrity and a model in his work.
Secondly, it urges the High Judicial Council to take a clearer position in defense of the judiciary as a whole and certain judges in particular.
Third, it calls on all our international partners to unreservedly support the reformed justice system, which is primarily a product of their unstinting assistance, and to make their voices in this regard heard by those who have lost this sense in relation to domestic actors.
Fourthly, it reminds the highest representative of the executive branch that any derogatory statement directed at judges constitutes interference in their activity and that, pursuant to Article 145, point 3, of the Constitution of the Republic of Albania, such an action entails liability under the law.
The Association guarantees to all judges of the Republic of Albania that it will not tolerate any offensive or humiliating action, performance or comment committed by high-ranking state officials, of whatever power they may belong to. This Association will not stop only at making statements condemning such behavior or expressing solidarity with the judges but, as the case may be, will exercise any other legal means. Posts and comments such as the one made against Judge Marko Boshku are on the verge of a criminal offense and, as such, will be monitored by this Association, deciding the steps to be taken in each case. The attack on individual judges constitutes an attack on the entire judicial power and this, without a doubt, is not only an attempt to usurp this power but may have consequences in the process of integration into the European Union. The principle of separation of powers is one of the features that distinguishes a state of law from a dictatorial state, and this separation of powers begins with the culture of accepting the existence of spheres of competence that do not belong to one. Attacking another power not only undermines this cornerstone principle of our Constitution but is an expression of a mentality that belongs to another regime."/ CNA
