The Authority for Information on the Documents of the former State Security has reviewed the archived documentation of the "Mezini" and "Bezhani" commissions.

The purpose of reviewing the files is to identify the officials and persons who cooperated with the State Security.

The Files Authority reflects the work of the two commissions, while confirming that during the years 2017-2022, it has verified 77 officials who have data on their behalf, in documents of the former State Security.

According to the data, 55 of these officials were previously verified by the Mezini-Bezhani commissions and were given a certificate of purity.

"From the total number of officials verified by the Authority, 55 of them were previously verified by the Mezini - Bezhani commissions, so for them, the Authority could not carry out verification when the certificate of purity was given. But among them, in 9 cases ascertained through parallel processes, or 16.3% of them, data were accidentally found that connected the figure of the official with the structures of the former State Security.

Now with the fall of the legal shield, the Authority exercises its competence even for those cases where the certificate of purity of the image was given by the previous commissions", the statement says.

At the end, the group drafted a summary report, which was approved by Decision. Because of the information it contains it is classified. Some of the findings of this report are briefly summarized as follows: The archival fund examined during the period 1996-2001 consists of 274 files and 24,034 sheets.

The Mezini Commission started its work with the first requests on March 27, 1996, on the occasion of the parliamentary elections. Throughout the time of its operation, the focus has been on the verification of the figures of the legislative body, the Assembly.

In total, 71 political entities participated in the two parliamentary and one local elections of 1996 and 1997. Meanwhile, this commission made decisions for 4,964 candidates, confirming 4,563 candidates and excluding 399 candidates from running, or 7% of the total number resulted in cleanliness problems.

Of the 399 candidates excluded from running, 45 filed an appeal with the Court of Cassation, of which in 37 cases the Court of Cassation upheld the commission's decision.

In the Mezini commission, the working group has identified at least 40 cases, with contradictory decisions that belong to different political subjects of the 1996 and 1997 elections. Of these 40 cases, 21 candidates were banned from running, while 19 of them were allowed to run, even though they seem to have the same image purity problems.

The Bezhani Commission carried out its activity from 1998 to the end of 2001, examining the integrity of the image of 3,759 high-ranking officials. This commission, unlike the previous one, had as its focus the control of the figure of state administration officials.

For 278 officials or 7% of the total number, for which it turned out that there is information about them in the documents of the former Security, for at least 104 of them, i.e. for 3% less of the number, the Bezhani commission has decided to give the certificate of the purity of the image, considering the candidates as persons who are not under the conditions of legal obstacle to continue with the appointment to the office.

From the analysis, it is noted that throughout the period of operation of the two commissions, the law of control and verification of figures has undergone changes, easing the barriers for the prohibition of running for the Assembly or local government, as well as the appointment to high state positions and independent institutions of officials found with data.

Kështu si rezultat i ndryshimeve ligjore, në maj të vitit 1997, të cilat ngushtonin rrethin e pozicioneve dhe cilësive që konsideroheshin kusht pengues, Komisioni Mezini ka marrë disa vendime të kundërta me ato të një viti më parë, duke i lejuar kandidatët të vijojnë me kandidimin, ndërkohë që një vit më parë të njëjtët kandidatë ishin në kushtet e pengesës ligjore sipas nenit 2 të ligjit. Ndryshime ligjore vijuan edhe në janarin e vitit 1998, kohë kur Komisioni Bezhani kishte vetëm 4 muaj që funksiononte dhe vepruan deri në dhjetor të vitit 2001 kur ligji me vendim të Kuvendit u abrogua.

Të dy komisionet kanë raportuar në mënyrë periodike për gjetjet e tyre, si edhe kanë informuar institucionet kërkuese për rezultatet e verifikimit dhe gjetjet.

Ndërkaq, Autoriteti, përgjatë viteve 2017-2022, ka verifikuar 2.399 zyrtarë lidhur me pastërtinë e figurës së tyre përpara emërimit/ngritjes në detyrë. Nga verifikimet, 77 zyrtarë, ose 3.2 % e numrit total kanë rezultuar me të dhëna në emër të tyre, në dokumente të ish-Sigurimit të Shtetit.

Nga numri i përgjithshëm i zyrtarëve të verifikuar nga Autoriteti, 55 prej tyre ishin verifikuar më parë nga komisionet Mezini - Bezhani, kështu që për ta, Autoriteti nuk mund të kryente verifikim kur ishte dhënë çertifikata e pastërtisë. Por ndër to, në 9 raste të konstatuara përmes proceseve paralele, ose 16.3% e tyre, u gjetën rastësisht të dhëna që e lidhnin figurën e zyrtarit me strukturat e ish-Sigurimit të Shtetit.

Tashmë me rënien e mburojës ligjore, Autoriteti ushtron kompetencën e tij edhe për ato raste kur është dhënë çertifikata e pastërtisë së figurës nga komisionet e mëparshme.
