"House arrest"/ GJKKO's decision on Sali Berisha is clarified

The decision of GJKKO against the former Prime Minister Sali Berisha for the accusations of the privatization of the former Partizani complex is clarified.

Decision:

1. Accepting the request of the Special Prosecution against Corruption and Organized Crime.

2. The replacement of coercive personal security measures "obligation to appear before the judicial police" provided by Article 234 of the Criminal Code and "Prohibition of leaving the country" provided for by Article 233 of the Criminal Code , determined by decision No. 112, dated 20.10.2023, verified by decision no. 117 dated 26.10.2023, of the Special Court of First Instance for Corruption and Organized Crime, left in force by decision no. 56 dated 21.11.2023, of the Special Court of Appeal for Corruption and Organized Crime, with the measure of coercive personal security "house arrest", provided by article 237 of the Penal Code, against the citizen under investigation Sali Berisha, of son of Ram and Shiqere, born on 15.10.1944, born in Tropoja, with no. personal E40701031R, suspected of committing the criminal offense "Passive corruption of high state officials or local elected officials", carried out in cooperation, provided by article 260 and 25 of the Criminal Code.

2.1. The citizen under investigation, Sali Berisha, is ordered not to leave his apartment located at the address: "Mustafa Matohiti" Street, Building 36, Entrance 1, Nd. 036, Administrative Unit no. 2, Tirana and not to communicate with other people except those who live in the same apartment with him.

3- The Special Prosecutor's Office against Corruption and Organized Crime, represented by prosecutors Arben Kraja and Enkeleda Millonai, is charged with the execution of this decision.

4- The supervision of the implementation of the security measure "house arrest", provided by article 237 of the Penal Code, as well as the orders defined in this decision, shall be controlled by the Special Prosecutor's Office against Corruption and Organized Crime and the police services judicial, near the General Directorate of the State Police.

5-Against this, an appeal can be made by the parties, within five days, to the Special Court of Appeal for Corruption and Organized Crime.
