The international human rights organization Amnesty International states that: "Individuals rescued by Italian authorities at sea, including those seeking safety in Europe, are under Italian jurisdiction and cannot be sent to another country before their claims are examined for asylum and individual circumstances".

In a reaction to the announcement that the leaders of Italy and Albania had reached an agreement on the construction in Albania of two centers for sheltering migrants rescued at sea by Italian ships, Mrs. Elisa De Pieri, with the organization Amnesty International, said that the persons rescued in det by Italian authorities are under Italian jurisdiction. She said the law is very simple to understand and that migrants cannot be sent to another country before their asylum claims are examined.

This agreement deals with refoulement, a practice which is prohibited under international and European law and for which Italy has already been condemned by the European Court of Human Rights. The agreement is illegal, inappropriate and should be cancelled, said Ms Elisa De Pieri, with Amnesty International.

"Italy claims that the detained persons will remain under Italian jurisdiction, but the reality is that the agreement will be used to circumvent Italian, EU and international law. This can have devastating consequences for asylum seekers, who may be subjected to lengthy detentions and other violations beyond the control of Italian justice authorities."

The European Commission has already made it clear that the EU law on asylum cannot be applied outside the borders of the bloc./ VOA
