5 thousand euros in the Korça Appeal for the prisoner/ GJKKO leaves the 3

GJKKO has left 3 people in prison, so another one has been assigned the measure of 'house arrest', while another has an obligation to appear after they are accused of influencing the easing of the sentence of a convict in Korça.

Concretely, the 'prison arrest' measure has been set for the person under NH investigation; BK and NJ

The personal security measure "House arrest" was set for the citizen DK (N.) and the person under investigation DK (N) was ordered not to leave her apartment.

These persons are accused of intervening with the Court of Appeal of Korça in exchange for a sum of 5,000 euros to ease the security measure of a citizen.

Court Notice:

1. The Special Prosecutor's Office against Corruption and Organized Crime, on 18.12.2023, addressed the Court with the request with the object: Assigning to persons under investigation NH, NJ, DK, DT and BK the measure of personal security "Prison arrest" provided for by Article 238 of the Criminal Code, as well as the assignment to the person under CA investigation of the personal security measure "Compulsion to appear before the judicial police" provided for by Article 234 of the Criminal Code, as a suspect for the commission of the criminal offense of "Exercising illegal influence on persons exercising public functions", carried out in cooperation, provided by article 245/1/2-25 of the Criminal Code.
2. Regarding the examination of this request, the Court decided to examine it in the consultation room without the presence of the parties and the court secretary. The Special Court of First Instance for Corruption and Organized Crime with a panel composed of judge Elsa Ulliri, based on Article 244 of the Penal Code, with decision No. 137 Act, dated 25.12.2023, decided, among other things:
1. Partial acceptance of the request.
2. The appointment of the measure of personal security "Prison", provided for by Article 238 of the Criminal Code, to the person under NH investigation, suspected of committing the criminal offense "Exercising illegal influence on persons exercising public functions ", carried out in cooperation, provided by article 245/1/2-25 of the Criminal Code.
3. The appointment of the measure of personal security "Prison", provided for by Article 238 of the Criminal Code, to the person under investigation by the Criminal Code, suspected of committing the criminal offense "Exercising illegal influence on persons exercising public functions ", carried out in cooperation, provided by article 245/1/2-25 of the Criminal Code.
4. The appointment of the measure of personal security "Prison", provided for by article 238 of the Criminal Code, to the person under NJ investigation, suspected of committing the criminal offense "Exercising illegal influence on persons exercising public functions ", carried out in cooperation, provided by article 245/1/2-25 of the Criminal Code.
5. The assignment of the measure of personal security "House arrest", provided by article 237 of the Criminal Code, to the person under investigation DK (N.) suspected of committing the criminal offense "Exercising illegal influence on persons who exercise public functions", provided by article 245/1/4 of the Criminal Code.
6. The person under investigation DK (N) is ordered not to leave her apartment, located in the neighborhood in Korça, at the address: Rr. "******", Nd. ***, **.*.
7. The assignment of the measure of personal security "Compulsion to appear before the judicial police", provided for by article 234 of the Criminal Code, to the person under investigation by the DT, suspected of committing the criminal offense "Disobedience of the crime". provided by article 300 of the Penal Code.
8. The person under DT investigation is ordered to appear at the judicial police at the prosecutor's office, on the last Thursday of every month, at 2:00 p.m.
9. The appointment of the measure of personal security "Compulsion to appear before the judicial police", provided by article 234 of the Penal Code, to the person under investigation CA, suspected of committing the criminal offense "Exercise of illegal influence against persons exercising public functions", carried out in cooperation, provided by article 245/1/2-25 of the Penal Code.
10. The person under CA investigation is ordered to appear at the judicial police at the prosecutor's office, on the last Tuesday of every month, at 1:00 p.m.

11. Prokuroria e Posaçme kundër Korrupsionit dhe Krimit të Organizuar dhe policia gjyqësore urdhërohen të kontrollojnë respektimin, ndjekjen dhe zbatimin e këtij vendimi.
12. Kundër këtij vendimi lejohet ankim në Gjykatën e Posaçme të Apelit për Korrupsionin dhe Krimin e Organizuar brenda 5 ditëve, duke filluar ky afat nga e nesërmja e marrjes dijeni.
3. Pasi është bërë ekzekutimit i masës së sigurimit Prokuroria e Posaçme kundër Korrupsionit dhe Krimit të Organizuar bazuar në nenin 248 të K.Pr.Penale më datë 26.12.2023 paraqiti në Gjykatë kërkesën me objekt: Marrjen në pyetje të personave nën hetim. Gjykata e Posaçme e Shkallës së Parë për Korrupsionin dhe Krimin e Organizuar me trup gjykues të përbërë nga gjyqtarja Elsa Ulliri, me vendimin Nr. 140 Akti, datë 27.12.2023, vendosi:
1. Pranimin e kërkesës.
2. Verifikimin e kushteve të zbatimit të masës së sigurimit personal me karakter shtrëngues “Arresti në burg” të dhënë ndaj personit nën hetim N.H me vendimin Nr.137, datë 25.12.2023 të Gjykatës së Posaçme të Shkallës së Parë për Korrupsionin dhe Krimin e Organizuar dhe vazhdimin e zbatimit të kësaj mase.
3. Verifikimin e kushteve të zbatimit të masës së sigurimit personal me karakter shtrëngues “Arresti në burg” të dhënë ndaj personit nën hetim B.K me vendimin Nr.137, datë 25.12.2023 të Gjykatës së Posaçme të Shkallës së Parë për Korrupsionin dhe Krimin e Organizuar dhe vazhdimin e zbatimit të kësaj mase.
4. Verifikimin e kushteve të zbatimit të masës së sigurimit personal me karakter shtrëngues “Arresti në burg” të dhënë ndaj personit nën hetim N.J me vendimin Nr. 137, datë 25.12.2023 të Gjykatës së Posaçme të Shkallës së Parë për Korrupsionin dhe Krimin e Organizuar dhe vazhdimin e zbatimit të kësaj mase.
5. Verifikimin e kushteve të zbatimit të masës së sigurimit personal me karakter shtrëngues “Arresti në shtëpi” të dhënë ndaj personit nën hetim D.K (N) me vendimin Nr. 137, datë 25.12.2023 të Gjykatës së Posaçme të Shkallës së Parë për Korrupsionin dhe Krimin e Organizuar dhe vazhdimin e zbatimit të kësaj mase.
6. Urdhërohet personi nën hetim D.K (N) të mos largohet nga banesa e saj, e ndodhur në Korçë, në adresën: Rr. “*****”, Nd. **, h.*.
7. Verifikimin e kushteve të zbatimit të masës së sigurimit personal me karakter shtrëngues “Detyrimi për t’u paraqitur në policinë gjyqësore” të dhënë ndaj personit nën hetim D.T me vendimin Nr.137, datë 25.12.2023 të Gjykatës së Posaçme të Shkallës së Parë për Korrupsionin dhe Krimin e Organizuar dhe vazhdimin e zbatimit të kësaj mase.
8. Urdhërohet personi nën hetim D.T të paraqitet në policinë gjyqësore pranë prokurorisë, të enjten e fundit të çdo muaji, ora 14.00.
9. Verification of the conditions of implementation of the coercive personal security measure "Compulsion to appear before the judicial police" given to the person under investigation by the CA with decision No. 137, dated 25.12.2023 of the Special Court of First Instance First on Corruption and Organized Crime and the continuation of the implementation of this measure.
10. The person under CA investigation is ordered to appear at the judicial police at the prosecutor's office, on the last Thursday of every month, at 2:00 p.m.
11. The Special Prosecutor's Office against Corruption and Organized Crime and the Judicial Police are ordered to follow up and implement this decision.
12. An appeal against this decision is allowed in the Special Court of Appeal for Corruption and Organized Crime within 5 days, starting from the day after the communication of the decision./ CNA
