VKM-New payment scheme and financial treatment for military personnel serving

The Council of Ministers has approved a new decision on the financial treatment of Armed Forces servicemen who are appointed or commanded to serve away from their families and places of residence.

The new decision, which repeals the old 2004 regulation, specifies the amount of compensation for transportation, dividing it into bands according to kilometers.

ON DETERMINING THE CRITERIA AND THE AMOUNT OF COMPENSATION FOR THE SOLDIERS OF THE ARMED FORCES OF THE REPUBLIC OF ALBANIA, WHEN APPOINTED OR COMMANDED TO DUTY OUTSIDE HIS PLACE OF RESIDENCE

In accordance with Article 100 of the Constitution and point 3, Article 25, of Law No. 9210, dated 23.3.2004, “On the status of the military personnel of the Armed Forces of the Republic of Albania”, as amended, upon the proposal of the Minister of Defense, the Council of Ministers

DECIDED:

1. The purpose of this decision is to determine the criteria and the amount of compensation for the military personnel of the Armed Forces of the Republic of Albania, when appointed or commanded to duty outside their place of residence.

2. An active military member of the Armed Forces, when appointed or commanded outside his place of residence, if he is not provided with transportation, housing or is not treated with housing rental compensation by the Ministry of Defense, shall benefit from transportation compensation, as follows:

a) From 5 km to 25 km, at the rate of 4,400 (four thousand four hundred) lek per month;
b) From 26 km to 50 km, at the rate of 8,800 (eight thousand eight hundred) lek per month;
c) From 51 km to 100 km, at the rate of 13,200 (thirteen thousand two hundred) lek per month;
d) Over 101 km, at the rate of 20,000 (twenty thousand) lek per month.

3. The benefit of the payment, according to point 2 of this decision, is terminated when:

a) the military member is appointed to his place of residence;
b) the period of command outside his place of residence ends;
c) he is settled in a residence in the municipality/administrative unit where the place of service is located.

4. To receive the payment, according to point 2 of this decision, the active military member of the Armed Forces presents, to the military structure where he is appointed or commanded, the documentation as follows:

a) Written request to the spending unit where the military member is financially treated;
b) Photocopy of the identity card;
c) Certification from the responsible public body, if he/she has a residence in ownership or in the process of legalization in the municipality/administrative unit where he/she is appointed or commanded.

5. Military structure, where the active military person is appointed or commanded:

a) evaluates the submitted documentation within 5 (five) working days;
b) notifies the serviceman about the correction of inaccuracies or lack of documentation and requests their correction/supplementation;
c) at the end of the documentation review, forwards the documentation to the spending unit for compensation.

6. In order to benefit from transportation compensation according to this decision, the active military member shall submit, every year, the documentation specified in point 4 of this decision, to the military structure where he is appointed or commanded.

7. A soldier of the Armed Forces, who is assigned to a duty outside his place of residence and at the same time transfers his family, benefits from free transportation for his family and household materials with the means of the Ministry of Defense.

8. Decision no. 435, dated 25.6.2004, of the Council of Ministers, “On the criteria and amount of compensation for the military personnel of the Armed Forces of the Republic of Albania, when appointed or commanded to duty outside his place of residence”, is repealed.

9. The financial effects resulting from the implementation of this decision shall be borne by the budget of the Ministry of Defense.

10. The Ministry of Defense and the General Staff of the Armed Forces are charged with the implementation of this decision.
