The vice-chairman of the Investigative Committee for the TIMS System, Toni Gogu, reacted strongly to Ervin Salianji, the "Babale" deputy who heads the committee.

While explaining the reasons why the SP left yesterday's meeting, Gogu says that MP "Babale" is following in the footsteps of Enkelejd Alibeaj in the Investigative Commission and is failing the investigation into the TIMS system.

The deputy states that Salianji systematically violated the law with ignorance as a worthless thing, while he emphasizes that he is either incompetent, or he is malicious for doing this.

In the statement, he underlines that the socialists left the commission to stop this violation of the law.

Yesterday we left with pain from the Commission of Inquiry into the treatment of TIMS data.

In yesterday's meeting, we were forced, as members of an Investigative Commission, to witness how the law was systematically violated with ignorance as a worthless thing.

The law that we had to respect for the Organization and Functioning of Investigative Commissions charges us, the legislators, to: (cit.) "investigate through procedural actions to clarify a particular issue (in our case, the activity of the institutions charged with protecting the system TIMS), but without taking defendants and without filing criminal charges."

The law does not authorize us to accuse, so every time we accuse instead of investigating, the law is broken.

The law does not authorize us to declare guilty, so every time we do so without asking any questions, the law is violated.

We, the legislators who are members of the Investigative Commission, in implementation of the law on investigative commissions, are assisted by legal experts. From those legal experts of the Commission, who were approved by qualified majority. The law charges legal experts with gathering information and drafting the Investigation Plan. We VOTE on the Voting Plan, and then implement it meticulously in calling and questioning witnesses and heads of institutions.

How incompetent or in bad faith do you have to be not to understand this?!

We, the legislators who are members of the Investigative Committee VOTE!

WE VOTE EVERY REQUEST FOR INFORMATION! WE VOTE FOR THE INVESTIGATION PLAN!

WE VOTE ANY CHANGES OR ADDITIONS TO THIS PLAN!

VOTING is the basic rule in the decision-making of a Commission (and not only).

There is no other way to make a decision!

Therefore, when colleagues of the Commission are deprived of the right to VOTE, because they pretend not to hear them, or pretend not to see them, not only violates the law, but also deprives the Commission of the opportunity to make Decisions.

How incompetent or malicious do you have to be not to understand this?!

Të shohësh Kryetarin e një Komisioni Hetimor, që injoron hapur jo vetëm ligjin e Komisioneve Hetimore, por edhe ligjet e logjikës së thjeshtë njerëzore, duke mos ja nënshtruar vendimmarrjen VOTIMIT, e tejkalon dhimbjen për Ligjin e shkelur.

Të shohësh dikë që nga karrikja e ligjvënësit REFUZON t'i nënshtrojë VENDIMMARRJEN VOTIMIT dhe beson se demagogjia mund të zëvendësojë procedurën më elementare nga e cila buron çdo vendimmarrje, të bën të ndjehesh i keqardhur edhe për demagogjinë e konsumuar më kot.

Komisioni është i detyruar nga Ligji që të votojë dhe miratojë me votë SECILËN KËRKESË PROCEDURIALE, të përgatitur nga ekspertët që i ka propozuar vetë.

Në një situatë si ajo e drejtimit të çartur të Komisionit Hetimor për TIMS-in, jo vetëm që bëhesh dëshmitar i një shkeljeje ligjore, por edhe i një sjelljeje në keqbesim dhe keqdashëse.

Më duhet të shpjegoj se kërkesat proceduriale për informacion që i dërgohen krerëve të institucioneve të rendit dhe sigurisë në republikën tonë, kanë nevojë të mbështeten me vendimmarrjen e deputetëve anëtarë te Komisionit. Për vendimmarrjen nevojitet Votim sipas Ligjit, sepse vendimet e Komisioneve Parlamentare, nuk janë si votimet e 5 mijë delegatëve, që votonin të ulur në 3 mijë karrige, e nga të cilat votime "merreshim vendime" të njoftuara e të zbardhura muaj të tërë përpara votimit.

Secila Kërkesë Proceduriale për informacion meriton vëmendjen dhe VOTËN E KOLEGËVE DEPUTETË. Dhe kur ia mohon këtë të drejtë të gjithë kolegëve, majtas e djathtas, jo vetëm që shkelet ligji, por nëpërkëmbet edhe inteligjenca e votuesve që presin të shohin rezultatet e hetimit parlamentar.

Për pak shoë politiko-mediatik, mund t’i qepesh edhe një batute të mjerë, thjesht sepse të ngjason me një shkop bejzbolli me të cilën mund t’u hakërrehesh kundërshtarëve politikë. Me batutë në gojë mund të shkelësh edhe Kodin e Eikës së Deputetit, por nuk zhbën dot procedurën parlamentare. Nuk zëvendëson dot VOTIMIN.

Nuk ka batutë që të shpëton nga procedura ligjore.

Komisioni hetimor, është i vetmi instrument që mund të na udheheqë drejt së të vërtetës objektive. Të paralizosh Komisionin Hetimor do të thotë minimumi të shkelmosh me arrogancë pritshmëritë e atyre që beson se të votojnë.

Shkelja haptazi e ligjit, Rregullores së Kuvendit dhe Kodit të Etikës, për më tepër me një arrogancë, që sa kohë nuk buron dot nga vota, me sa duket merr frymëzim nga padija, na e bënte të pamundur vijimin e mbledhjes.

Ndaj dhe u larguam, nga ajo skenë e shëmtuar, ku ligji shkelet dhe komisioni hetimor paralizohet me vetdije. Shpresojmë që Kryetari dhe kolegët opozitarë që kanë kërkuar të hetojnë, t’u kthehen pyetjeve dhe të lënë mënjanë deklaratat.

Të paktën deri në ditën që Komisioni mund të vendosë t’i thërrasë si dëshmitarë për aq shumë gjëra sa kanë deklaruar dhe pretendojnë se dinë. Atë ditë mund të DEKLAROJNË gjerë e gjatë!

Deri atë ditë është mirë të pyesin dhe të dëgjojnë, pra të hetojnë.
