Prime Minister Rama announced yesterday the great "victory" of Thoma Gëllçi in Strasbourg. We wrote "victory" in quotation marks not without purpose, because there is no such thing.

In fact, if you carefully read the Strasbourg decision that you have below and we have taken it from "shqiptarja.com", the decision itself, but also the opinion of professional lawyers, is that Thoma Gëllçi, first of all, has not been found innocent.

Secondly, there are some details within that decision: 

A-The participation of an Albanian official when an issue for Albania is being considered. What is his business? Is someone else invested in this individual?

B-The other is the fact whether the State Attorney's Office has been active in protecting Albania, in protecting prosecutors, in protecting actions, legal decisions taken by Albanian institutions.

So, beyond these doubts that there may be interference all the way to Strasbourg or that Thoma Gëllçi's decision was rushed with a specific purpose to be used as a weapon in defense of Mayor Erion Veliaj, if you read the decision in detail, it simply "kills" the reason for which the prime minister is using it.

Edi Rama requested that there be no prison sentences, but the Strasbourg decision for Thoma Gëllçi legitimizes the security measure of prison sentences for criminal offenses such as abuse of office, which so far in the decisions given by the Court has been one or up to 2 years of imprisonment.

So it is legitimized. What Strasbourg said is to give Thoma Gëllç a small amount of money, another part to pay expenses, and if you read the decision again clearly, it legitimizes Thoma's arrest.

Moreover, in the case of Thoma Gëllçi, which is being used as propaganda to give him a kind of cover and to create propaganda against SPAK and against the Court after the arrest of the mayor of Tirana.

Erion Veliaj is not actually charged with "abuse of office" which Strasbourg legitimized in the case of Thoma Gëllçi, but Erion Veliaj has two other offenses, corruption and laundering of the proceeds of a criminal offense.

So, the criminal offense for which the mayor of Tirana risks up to 15 years in prison. Here we are clear in the face of the fact that someone may have stimulated and intervened all the way to Strasbourg to issue a decision for Thoma Gëllçi and to use it as propaganda against the justice institutions in Albania.

In fact, the Strasbourg decision, although it may have been slightly biased by official Tirana, in the end it "shot" the propaganda, it "shot" the position that Prime Minister Edi Rama himself held because that Strasbourg decision legitimizes prison arrest in the case of "abuse of office" and no longer for the more serious criminal offenses that are foreseen for Erion Veliaj, therefore the arrest of both Erion Veliaj and Thoma Gëllçi is legal.

But the Strasbourg decision has hit, we are saying, "the Albanian state only for extending the detention period."

So, during the extension of the pre-trial detention period, the prosecutors should have found other evidence, they should have filled this extension of the pre-trial detention with actions, when in fact this did not happen for this reason, namely for the extension of the pre-trial detention period by one month, not for the arrest.

The arrest has been called legal by Strasbourg for Thoma Gëllçi as well. The arrest of Thoma Gëllçi and the Strasbourg decision are being used as propaganda for Erion Veliaj when in fact it is completely the opposite, the Strasbourg decision "legitimizes" the arrest of the mayor of Tirana just as it "legitimizes" the arrest of Thoma Gëllçi. / CNA
