The DP deputy, Oerd Bylykbashi, has reacted to the accusations that have been leveled against the mayor of Durrës, Emiriana Sako, who has forced teachers and high school students to participate in electoral meetings.
Bylykbashi has mentioned to the mayor the Criminal Code and what it proposes regarding this situation.
Among others, he stated that it is the duty of SPAK and the Prosecutor's Office to react to this event.
"Fear makes them break the law with both feet!
Ms. Emirjana Sako (Mayor of Durrës and SP candidate - clarification for the majority of Durrës citizens who do not know her and do not know what she does) has organized electoral meetings with students of pre-university education.
He declared it himself publicly. Citizens' and students' denunciations show us that they took them out of class earlier.
The Criminal Code says:
"Article 328/a
Obligation to participate in political activity
[…]
Forcing or organizing to participate in the electoral activity of an electoral subject of students of pre-university education by employees who perform a state duty in public education, or a duty or function in non-public education, constitutes a criminal offense and is punishable by imprisonment from three months to a year." So only the organization is enough, not only the forcing of the students by the candidate and the responsible persons to participate in political activity to consume the criminal offense. It does not even matter if the electoral activity with students was carried out during the school hours, the misuse of the students is enough to constitute the violation.
And the prosecution, will it continue to de facto "abolish" the Criminal Code with its chronic inaction in the face of electoral crimes?
With the supposed independence given to them by the reform of "deception", a fair and a little courageous prosecutor would be enough to bring these power offenders to justice. But it didn't matter to the prosecution that in 2020 the law emphasized the responsibility of the ordinary prosecution and SPAK for election crimes! This is called "independence" from the law. The end to this day vetting is proving itself what political capture of justice it has produced. The only thing left for the prosecution is to go to SP electoral meetings with students and administration, to "share" and "like" the posts of the power candidates and on the day of voting go and vote with conviction. Thus they contribute to the perception of the impunity of the socialist rulers. On May 14, the citizens of Durrës and Albania will punish this immoral, rotten and degraded government by voting themselves," he said.
