The government approves the decision on expropriations for public interest in

The Albanian government has today approved the decision on expropriations in the public interest, of owners of real estate affected by the implementation of projects of public importance.

The two decisions concern expropriations in two areas of the country, in Rinas and Vlora.

DECISION ON SOME AMENDMENTS AND ADDITIONS TO DECISION NO. 20, DATED 17.1.2024, OF THE COUNCIL OF MINISTERS, “ON THE EXpropriation, FOR PUBLIC INTEREST, OF THE OWNERS OF REAL ESTATE, PRIVATE PROPERTY, AFFECTED BY THE IMPLEMENTATION OF THE PROJECT “CONNECTION OF THE TRANS-BALCAN ROAD WITH THE SEAPORT”, VLORA”

In accordance with Article 100 of the Constitution and Articles 5, 20 and 21 of Law No. 8561, dated 22.12.1999, “On the expropriation and temporary use of private property for public interest”, as amended, upon the proposal of the Deputy Prime Minister and Minister of Infrastructure and Energy, the Council of Ministers

DECIDED:

1. In decision no. 20, dated 17.1.2024, of the Council of Ministers, “On the expropriation, in the public interest, of the owners of real estate, private property, affected by the implementation of the project “Connection of the Trans-Balkan Road with the Sea Port”, Vlora”, the following changes and additions are made:

a) In points 3 and 4, the value “… 182 020 370.86 (one hundred and eighty-two million twenty thousand three hundred and seventy point eighty-six) lekë …” is replaced with “… 200 831 026.08 (two hundred million eight hundred and thirty-one thousand twenty-six point zero eight) lekë …”;

b) In the table attached to decision no. 20, dated 17.1.2024, of the Council of Ministers, the following changes and additions are made:

i. The data on expropriation, which belong to ordinal numbers 17 and 18, are replaced with the data reflected in ordinal number 17 of the table, which is attached to this decision;

ii. The data on expropriation of ordinal numbers 28, 29 and 43 of the table, attached to decision no. 20, dated 17.1.2024, of the Council of Ministers, are replaced with the data with the same ordinal number of the table, attached to this decision;

iii. To the table attached to decision no. 20, dated 17.1.2024, of the Council of Ministers, the assets with serial numbers 51-55 of the table attached to this decision are added.

2. The owners of properties with numbers 32/589 and 32/134+1-10, which were liquidated according to the value determined before the entry into force of this decision, are compensated, for the purpose of expropriation, only for the difference in the added value of the compensation, according to the table attached to this decision.

3. Procedural expenses, in the amount of 50,000 (fifty thousand) lek, are borne by the Municipality of Vlora.

4. Ngarkohen Ministria e Financave, Ministria e Infrastrukturës dhe Energjisë, Bashkia Vlorë, Agjencia Shtetërore e Kadastrës, Drejtoria Vendore Vlorë dhe Agjencia Shtetërore për Shpronësimin për zbatimin e këtij vendimi.

V E N D I M PËR DISA NDRYSHIME DHE SHTESA NË VENDIMIN NR.384, DATË 29.6.2023, TË KËSHILLIT TË MINISTRAVE, “PËR SHPRONËSIMIN, PËR INTERES PUBLIK, TË PRONARËVE TË PASURIVE TË PALUAJTSHME, PRONË PRIVATE, QË PREKEN NGA REALIZIMI I PROJEKTIT “REHABILITIMI I RRUGËS  SË ISH-REPARTIT USHTARAK PËR NË AEROPORTIN E RINASIT”

Në mbështetje të nenit 100 të Kushtetutës dhe të neneve 5, 20 e 21, të  ligjit nr.8561, datë 22.12.1999, “Për shpronësimet dhe marrjen në përdorim të përkohshëm të pasurisë pronë private për interes publik”, të ndryshuar, me propozimin e Zëvendëskryeministrit dhe ministër i Infrastrukturës dhe Energjisë, Këshilli i Ministrave

V E N D O S I:

1. Në vendimin nr.384 datë 29.6.2023, të Këshillit të Ministrave, bëhen këto ndryshime dhe shtesa:

a) Në pikën 3, fjalët “… vlera e përgjithshme prej 477 120 (katërqind e shtatëdhjetë e shtatë mijë e njëqind e njëzet) lekësh.” zëvendësohen me                  “… vlera e përgjithshme prej 1 482 432 (një milion e katërqind e tetëdhjetë e dy mijë e katërqind e tridhjetë e dy) lekësh.”;

b) Pika 4, ndryshohet, si më poshtë vijon:

“4. Vlera e përgjithshme e shpronësimit prej 1 482 432 (një milion e katërqind e tetëdhjetë e dy e mijë e katërqind e tridhjetë e dy) lekësh përballohet, si më poshtë vijon:

a) Vlera e përgjithshme e shpronësimit prej 477 120 (katërqind e shtatëdhjetë e shtatë mijë e njëqind e njëzet) lekësh përballohet nga Autoriteti Rrugor Shqiptar;

b) Vlera shtesë prej 1 005 312 (një milion e pesë mijë e treqind e dymbëdhjetë) lekësh përballohet nga buxheti i shtetit, llogaria “Fondi i shpronësimeve”, në Bankën e Shqipërisë.”.

c) Kudo në përmbajtje të vendimit, fjalët “pronarit të pasurisë së paluajtshme”, “pronari i pasurisë së paluajtshme” dhe “pronarit të shpronësuar” zëvendësohen përkatësisht me “pronarëve të pasurisë së paluajtshme”, “pronarët e pasurive të paluajtshme”, “pronarëve të shpronësuar”.

ç) Tabelës bashkëlidhur vendimit nr.384, datë 29.6.2023, të Këshillit të Ministrave, i shtohet tabela, që i bashkëlidhet këtij vendimi.

2. Bashkëpronarët e pasurisë së paluajtshme, pronë private, të pasqyruar në tabelën shtesë që i bashkëlidhet këtij vendimi, kompensohen, për efekt shpronësimi, pasi të kenë paraqitur dokumentacionin justifikues për likuidim pranë Agjencisë Shtetërore për Shpronësimin.

3. Agjencia Shtetërore për Shpronësimin kryen procedurat për likuidimin e bashkëpronarëve të shpronësuar, sipas përcaktimeve të bëra në këtë vendim.

4. Shpenzimet procedurale shtesë, në vlerën 50 000 (pesëdhjetë mijë) lekë, përballohen nga Autoriteti Rrugor Shqiptar.

5. The Ministry of Infrastructure and Energy, the Albanian Road Authority, the State Cadastre Agency, the Kamzë - Vorë Local Directorate, the Directorate of Land Administration and Protection at the Tirana District Council and the State Agency for Expropriation are charged with the implementation of this decision.

This decision enters into force immediately and is published in the "Official Gazette". /CNA
