Democratic Party MP Oerd Bylykbashi has criticized in the Assembly the proposals for changes to the institution's regulations, describing them as an attempt to limit the opposition's space and to unilaterally change parliamentary functioning.
He raised concerns that the proposed interventions could reduce MPs' speaking time and limit parliamentary debate, affecting the oversight role of the Assembly.
Bylykbashi also opposed the possibility of accelerated review of legal initiatives, including those related to the European Union integration process, warning that this approach could harm transparency and create space for various interests.
He stressed that any change to the Assembly's rules of procedure should be made only after a reasoned decision by the Constitutional Court of Albania, adding that its decisions must be fully respected to guarantee democratic standards.
The opposition MP requested that the process not continue without first clarifying the position of the Constitutional Court, emphasizing the need for political consensus in amending the Assembly's rules of procedure.
"Mr. Speaker, in fact, I was talking precisely about the issue of changes in the rules of procedure of the Assembly. You, we yesterday in, in, in the Council for the rules of procedure and mandates, mandates and immunity discussed a set of proposals that or we started the discussion for a set of proposals in the rules of procedure of the Assembly. Even what just happened here is an, it is an indicator of how we approach the rules of procedure.
So, we talk and make the proposal right there. We bring proposals for changes to the rules of the Assembly because someone thinks that we should do this, and even do it by tightening and narrowing the opposition's space in the Parliament. I believe you know that you are the leader of that, not only the speaker of the Assembly but also the leader of that council, but also the members who are present there, but now the public also knows that the reduction of the speaking time of the deputies is required. So the deputies who have all these problems that they have to bring here to the Assembly, their speech should be reduced to five minutes. They need to make a 180-degree turn with the laws on the European Union.
So today the regulation states that they cannot be examined with an accelerated procedure, now they must be examined with an accelerated procedure. And this, even though the European Union does not support this kind of idea. Not only because there is a need to discuss many more issues, but also because of the fact that under that guise of approximation with the European Union, clientelist interests are hidden. Articles are introduced that regulate other interests.
Now, what I do not want to discuss here is the substance, what we insisted on is, it cannot be discussed in the committee, in the Council of Regulations and Mandates without the reasoned decision of the Constitutional Court being issued first. Mr. President, yesterday we agreed, so this is also for those who follow us, to continue only after the written decision of the Constitutional Court is issued and has entered into force. Not for nothing, that decision says it enters into force 30 days after the publication of the Official Gazette.
Because it should give the Assembly time to study what, why? Because it is precisely about the procedure by which the previous changes were made. It is, that decision of the Constitutional Court that will determine the rules on how the regulation should be changed. Let it not happen like the previous one, where the Constitution was violated to the extent that the Constitutional Court had to intervene.
So, this parliament must definitely start following a completely different rule in the way the regulations are changed. On May 30, we changed it by consensus, on May 30, 2013, we did it by consensus, we stopped the election campaign. After that time, there have only been unilateral changes.
Here, in this parliament, this parliament functions in a minimally democratic way, if the rules of procedure are shared. Not with proposals that come suddenly, we don't know where they come from, or let's do it here in the session because that's how we find it interesting to say it. So let's change the approach, Speaker. I appreciate that the Council of Rules of Procedure and Mandates yesterday decided not to go further until the decision of the Constitutional Court is issued.
