Jamarbër Malltezi, the head of the Department of Environment in the Democratic Party, asked 23 questions about the affair in the incinerators.

By means of a written statement for the media issued by the PD, Malltezi recalls the criminal report to the SPAK for a structured criminal group for the people of the incinerators.

He mentions the fact that this charge has not been filed, while he accuses SPAK of allowing money to be stolen from the Albanians' taxes for 3 years.

Malltezi wants to know who made the incinerators, who requested the signing of concession contracts and who received the money.

Malltez's statement:

It's been over 3 years since the PD filed a criminal complaint in SPAK for a structured criminal group with the aim of stealing 430 million euros with the incinerator scheme. All Albanians knew that they were the same thieves led by Edi Rama, but SPAK did not know. SPAK has wasted 3 years, allowed 130 million euros to be stolen while we have no incinerator! This would not have been possible without Edi Rama.

We only have a few simple questions for SPAK to answer:

1. Who had the authority to issue the Waste Strategy & Action Plan that was drafted with 4 million euros of European Union funding through the INPAEL and SELEA projects?

2. Who had the authority to ignore the Public Procurement Agency that declared the procedure to be illegal?

3. Who could pretend to go through 9 procedures and 17 signatures within the day of December 16, 2014, when each of them required evaluations from many institutions?

4. Who decided that we need not 1 but 3 incinerators less than 50 km apart?

5. How could the Minister of Environment sign for hundreds of millions of euros, when there was 0 lek in the ministry's budget for waste treatment? Who gave him the guarantee to sign?

6. Who forced Mr. Koka to sign the contracts? The central government has no legal standing, as the law assigns waste management to local governments. Why didn't the legal department in the Prime Minister catch the legal violation?

7. Who inserted the point in the contract "The impossibility of terminating the contract"? Can't terminate the contract even if its clauses are not implemented?!

8. Why was the method of selecting the Supervisor contrary to the Public Procurement law? Why were the monthly payments made without selecting the Supervisor and without the supervisor submitting the work progress documentation at the end of each month?

9. Who added the point that even if the concessionaire cheated, the state would not order the cessation of payments? "In case of violations of the Contract, ascertained during monitoring and general supervision, the Contracting Authority will not order the cessation of payments to the Concessionaire"

10. Who is giving hundreds of millions of euros without any explanation of the technical characteristics of the incinerators? There is nothing in the contracts, neither what capacity it has, nor how many dangerous gases it emits.

11. Where did 130 million euros go? The people close to Edi Rama, Engjëll Agaci and Erion Veliaj without investing a single shovel, receive hundreds of millions of euros from taxpayers and disappear?

12. Regarding the Tirana incinerator, it was sent to 5 ministers for their opinion: Ylli Manjani, Arben Ahmetaj and Felaj left in writing that they are against it. Although 3 of the 5 ministers were against it and the company did not exist, Rama-Agaçi issued the VKM approving the bonus!!!

13. Why was the notice given only 5 weeks notice in only one international media while it should have been announced at least 3 months in advance and detailed documentation in English was required? For 128 million euros, there would have to be an international announcement in several international media with 2 steps, first for expressions of interest and then there would be a competition with those who want to be short-listed from the expressions of interest.

14. Who gave the power to the Ministry of Environment to announce the competition when there were neither funds in the budget nor legal authority for any form of waste management. Can a contract signed by a minister who was not concerned with waste management be binding on all the municipalities of Tirana district?

15. Is the procedure that gave Zoto MONOPOLY legal for:

A. Sawmill Landfill

B. Recycling

C. Inert waste

D. Soils that are not waste at all but valuable materials?

16. Why did Veliaj sign illegally, either by first taking (i) the Tirana District tax and then (ii) the Tirana City Council tax?

17. Why does Veliaj pay 29 euros/ton for depositing waste and covering it with soil, when this process was carried out for only 12 euros until 6 years ago? According to the contract in force, (i) the incinerator, (ii) the recycling plant, (iii) the wastewater treatment plant, etc. had to be functional. so that we had the payment of 29 euros/ton. There is neither an incinerator nor a wastewater treatment plant. Then who guarantees Veliaj to break the contract and cause damage to the state?

18. How and for what reason did Erion Veliaj transfer the management contracts from the public enterprise of Sharra to (i) the 3R company that Veliaj himself invited young people to come and work and where Ardit Gjoklaj died uninsured, then to ( ii) The company from Verona where Migliorazi was a member, then to (iii) the company Kilcyre above the post office (Vladimir Fezga) and finally to (iv) Klodian Zoto and Mirel Mërtiri?

19. Who gave the companies associated with Ramë-Bašë-Zoto another 15 million euros for the removal of waste from Porto Romano without a tender at all? A competition had been announced and several companies had applied, but the competition was interrupted and then they were connected with an illegal procedure "Negotiation without prior announcement".

20. Where are the river carriers in Shkumbin and Ishem for which Zoto was paid more than 2 million euros? Ministers Koka and Klosi appeared on television praising the carriers. Today, none of them exist, nor have they been taken over by the ministry, although the money was paid. Is there responsibility or what did you want?

21. Is there theft when Mirel Mertiri, Eva Blushi and Klodian Zoto created a shell company in Bulgaria and received millions of euros through fictitious invoices for incinerators? Are the media paid by our taxes included to steal money together with the incinerators and with the understanding of Edi Rama?

22. Did the ministers of Edi Rames appear in the wiretapping of the Elbasan Prosecutor's Office in 2017, and were the wiretapping administered, or were they destroyed when the deputies appeared?

23. Are Artur Metani (former Legal Director of Edi Rama and today Chief Inspector of Justice) and Engjëll Agaçi – General Secretary of the Prime Minister, criminally responsible for:

1. ignoring APP's letter that announced that the procedure was illegal;

2. 9 procedures and allegedly 17 signatures within a day on December 16, 2014;

3. Giving 8 bonus points to a company that did not exist and for which they had a notice from former minister Felaj; AND

4. Article "The impossibility of terminating the contract"

These are 23 questions that need answers from SPAK. The affair of the incinerators is not an affair of a few plane tickets, hotels or the cadastral voice of the land. NO! This is the case of a Structured Criminal Group to steal 430 million euros, and so far they have stolen 130 million euros from SPAK's inaction to hold the main thieves Rama-Agaçi-Veliaj accountable. SPAK can choose to be the cloth where Edi Rama wipes his feet, but DP and Albanians are waiting for answers to these 23 questions!/ CNA
