Theft scheme with "5D"/ From the quarrels to the millions extorted by the directors of Veliaj

The "5D Kontruskion" file put the important directors of Erion Veliajt, Mariglen Qaton and Redi Molla, Taulant Tushen behind bars, while six other officials were left under house arrest.

Another scandal has been revealed from the investigative file provided by CNA.  The request for security measures was submitted by the prosecutor of the case, Klodian Braho, on March 18 at the Posçame Court.  Meanwhile, judge Rudina Palloj gave an order to implement the request 10 days later, on March 28.

So according to the request of the prosecutor, Klodian Braho, the directors of Veliaj should have been arrested 10 days ago, but the judge gave the decision after 10 days.

The reason for the judge's move is not known, why she did not act immediately, but delayed the arrests for a full 10 days.

We remind you that on Thursday the three directors of Veliaj were arrested, Mariglen Qato, Redi Molla and Taulant Tushe, who is behind bars for the incinerator affair.

In the file that CNA was able to provide regarding the investigations against the company "5D Konstruksion", there are also communications between officials.

Jona Bejko, one of the company's employees, in a conversation with her colleague, says that some tax inspectors have seen some documents at the Finance office that they should not have seen.

Likewise, during another conversation that the employee had with citizen Algert Cifligu, she tells him about the clashes between the company's financier and the administrator, Nestor Muhametllari.

To quell these conflicts, the two directors of Veliaj, Redi Molla and Mariglen Qato, had intervened. From the unearthed conversations, it is said that Molla, Qato and Muhametllari had gone to meet at a facility in Durrës.

The object is suspected to be the hotel, but from the disclosed conversations it appears that the mayor Veliaj is also a shareholder, in addition to the directors. There, Molla asked not to dismiss the financier without closing the annual balance sheet.

CNA has disclosed the investigation file of the directors of Erion Veliaj, already arrested, Mariglen Qaton, Redi Molla and Taulant Tushe.

Other details have emerged from the theft scheme of the owners of "5D", the directors of Veliaj, disclosed by SPAK.

During the controls, Nestor Muhametllari's notebook was seized, which contains various payments for 5D works, public contracts obtained through procurement procedures and company expenses.

"During the search in the residence of citizen Nestor Muhametllari, a black notepad with the inscription "Notes" was found and seized, which contains a series of notes made by citizen Nestor Muhametllari. In this block, notes were kept by the citizen Nestor Muhametllari, which refers to various payments for the company's work, for public contracts obtained through procurement procedures, as well as for the company's expenses. In the notes kept, it is about monetary amounts that have been paid or received, that have been returned, referring to the persons written with the name (R) and the name (M)", the file states.

So, these notes reflect the fact that the person named (R) received the amount of 11,000,000 ALL from the realized profit in 2018, while the person named (M) received the amount of 4,000,000 ALL from the realized profit in 2018.

"From the content of these notes, it is established that the amount of 32,500,000 ALL was returned to (R), an amount which was deducted from the total amount of 134,810,000 ALL. The amount described as having been returned, of 32,500,000 ALL, is approximately the amount of ALL 31,505,177 which is the net amount of the dividend distributed by the company "51) Konstruksion" sh.pk by the decision of the assembly of the company dated 30.06.2020 at the time when the sole partner of the company was the citizen Muhamet Petriti.

From the notes it is understood, from the deduction of the total amount from the account, it is understood that this amount has been returned to the person marked with the name (R).

From the content of the notes above, it is established that the amount of 7,782,027 ALL with the description "returned dividend" is the same as the amount of dividend distributed by the company in 2019. at the time when the sole partner of the company was the citizen Muhamet Petriti. According to the notes, this amount was deducted from the total amount of ALL 102,310,000 and the account for (R) was deducted to the final amount of ALL 94,527,973. So, from the notes it is understood that the amount of the dividend was returned to the person marked with the name (R)", it is said in the file provided by CNA.

CNA has secured the investigative file for the directors arrested in the Municipality of Tirana, Mariglen Qaton, Redi Molla, Taulant Tushen, as well as the other officials who are in the mass of mandatory appearance.

The facts of the case are documented in the file, where the benefit scheme of Veliaj's directors through the company "5D Kontruskion" is shown step by step. 

In the office of the company "5D Konstruskion" a block with the inscription "Yuku" was found, which belonged to the citizen Mariglen Lika, an employee of the company.

In this block, notes were found for a meeting held on February 23, 2022, where staff organization and division of duties are discussed. In addition to the staff, Redi Molla, the director of Veliaj, also participated in this meeting.

The company's administrator, Nestor Muhametllari, Redi Strunga, Musai and director Red Molla participated in this meeting. SPAK clarified the conversations between the director of the Tirana Sports Club, Deborah Keçi, and Nestor Muhametllari, regarding the procurement procedure of the "Tirana Sports Club", an institution under the Tirana Municipality, with the object of "Reconstruction of the Gym".

From the conversations held between the director Deborah Keçi and Nestor Muhametllari, there are data that support the fact that the economic operator "VAS Konstruksion" sh.pk has been unfairly favored in this procurement procedure.

A worried, scared Deborah Keci tells Nestor Muhametllari to be careful with the procedure, as they may end up behind bars.

At the end of the conversation, after closing the procedure and achieving the goal of announcing 5D as the winner, the director tells them "Get out for God's sake now".

The Special Prosecutor's Office has revealed that the directors of the Municipality of Tirana are behind the company "5D Construction", even during the time that the latter held managerial positions in the institutions near the Municipality.

Thus, the body of the accusation revealed that in just 5 years this company was able to win dozens of procurement procedures from the Municipality of Tirana and its subordinate institutions, often in non-fulfillment of the conditions and unfairly.

From the evidence obtained during the preliminary investigation, up to this stage of the proceedings, it appears that the company has participated and was declared the winner in several procurement procedures for the period 2016-2022 by public institutions.

Among them, "5D Konstruksion" was announced as the winner in 13 procurement procedures announced by the contracting authority, the Municipality of Tirana, or affiliated institutions, as well as 10 procurement procedures announced by the contracting authority, the company "Ujësjellës Kanalizimi Tirana" sh.a." it is said, among other things, in the file provided by CNA.
