A lawsuit in SPAK could send the former Minister of Economy and Finance, Anila Denaj, who already holds the position of Minister of Agriculture, to prison.

It is about the lawsuit related to the benefit of the state property 4021.5 m² in the former Department of Clocks, in Tirana, by the publisher of Rilindah Carlo Bollino.

In the lawsuit of the Democratic Party, submitted yesterday to SPAK, 10 criminal charges are listed and one of the persons charged is the former minister.

According to the lawsuit uncovered by CNA, the Ministry of Finance, which was headed by Anila Denaj, announced the winner of the lease for state property Carlo Bollino in July 2019.

Afterwards, Denaj proposed to the Council of Ministers that Rama's servant publisher should not pay 6,300 euros in rent, but benefit from it with only 1 euro, and in October her proposal was accepted.

The government, with several VKM one after the other, gave Bollino the right to lease the 2nd floor of the building, then decided that the building would be demolished and finally changed the object of the lease contract, while no building of the state landlord already existed.

In order to cover the misuse of public property, according to the report of the DP, the Council of Ministers invested again to complete the regulatory acts, in the conditions when the leasing facility no longer existed.

"Specifically, with the proposal of Mrs. Anila Denaj, the Council of Ministers approves VKM no. 589 dated 22.07.2020, through which Article 2 of the lease contract is amended.

So Article 2 "Purpose of Use" and point 5.7 of Article 5 "Rights and obligations of the lessee", the words "total reconstruction" are replaced with "minimum reconstruction of the total", says page 10 of the lawsuit.

The next procedure is the handover of the property from the Industrial Enterprise on 06.05.2019, but the decision on leasing had not yet been issued by the Ministry of Finance.

In the lawsuit, it is emphasized that "at the request of Minister Denaj, the Industrial Enterprise was forced to change the dates and protocol of the decision of the Governing Council".

According to the report, during the period March-May 2020, Industrial Enterprise No. 1 and the Ministry of Finance and Economy have undertaken several actions to put out of use the buildings rented by the company "MTSC", owned by Bollino.

On June 10, 2020, Denaj asks the Territorial Development Agency to grant a building permit to Bollino, in order to build the television building on the acquired property.

In the lawsuit it is emphasized that: "The Ministry of Finance and Economy, AZHT and the entity "MTSC" have collaborated BETWEEN THEM, to advertise untrue facts and circumstances, with the aim of falsifying documentation, to justify not only completing the file to be equipped with construction permit, but to achieve the criminal and main purpose, the benefit from Carlo Bollinos, of state land property."

Based on the facts mentioned above, the Democrats sued the former Minister of Finance, putting her at risk of prison.

If SPAK's investigations prove the accusations of the Democratic Party, then Denaj will most likely not be able to escape the handcuffs.

This is because the former Minister of Finance can be accused of "abuse of duty", "falsification of documents", violation of the basic rights of participants in tenders and public auctions", and many others.

This lawsuit is now in the hands of SPAK and it remains for this institution if it will bring Denaj and other officials and former officials of Rilindja to justice for Rama's media servant, Carlo Bollino./ CNA

PD kërkon që pas depozimit të padisë, Prokuroria e Posaçme të nisë menjëherë me hetimet për personat e përfshirë në këtë aferë dhe kërkon që pezullohen nga detyrat që mbajnë deri më tani.

"Në këto kushte, do kërkoja, që pas kryerjes së disa veprimeve hetimore paraprake, të kërkohej nga organi akuzës dhe të vendosej nga Gjykata, masa ndaluese e sigurimit personal “Pezullimi i ushtrimit të detyrës publike” që ata mbajnë dhe çdo funksioni tjetër të dhënë deri në përfundimin e hetimeve të kësaj çështje, parashikuar nga neni 240 i Kodit të Procedurës Penale", thuhet në padi. 

Ndër të tjera PD kërkon që gjatë periudhës së hetimit të sekuestrohen telefonat e Carlo Bollinos, dhe të përsonave të përmendur në këtë kallëzim, për të evidentuar lidhjet dhe komunikimet që kanë patur ndërmjet tyre, apo përmes tyre. 

Po kështu kërkohet edhe marrja e të dhënave dhe komunikimeve prej adresave elektronike të shoqërisë ”MTSC” (në pronësi të Bollinos), Edi Rama, Anila Denaj, Ledia Tota dhe më pas të çdo adrese elektronike të re në lidhje me të kallëzuarit apo personave të tjerë të përfshirë.

According to the report, Bollino was initially declared the winner of the lease of the 4021.5 m² property by the Ministry of Finance.

Then, Minister Anila Denaj proposed to the Council of Ministers that Rama's servant publisher should not pay 6,300 euros in rent, but benefit from it with only 1 euro, and so it happened.

By means of a VKM, Carlo Bollino was granted the tenancy right for the 2nd floor of the building.

With another VKM, it was decided that the building will not exist, that is, it will be demolished.

All this was done for the sole interest of a media owner who was brushing the government day and night.

The last move of the government was to change the object of the lease contract, while no building of the state landlord already existed.

For the violations one after the other, Bollino, together with officials and former officials have been sent to SPAK.

In the lawsuit, 10 criminal charges are listed, from "abuse of duty" to "fraud", "false statements", "forgery", "illegal benefit of interests" or even "cleaning of the proceeds of a criminal offense".

Specifically, the 10 criminal charges are:

- "Abuse of duty", provided by article 248 of the Criminal Code;

- "Frauds", provided by article 143 of the Criminal Code;

- "Compilation of false statements", provided for by Article 163 of the Criminal Code;

- "Providing false information", provided by Article 168 of the Criminal Code;

- "Forgery of documents", provided by Article 186 of the Criminal Code;

- "Illegal benefit of interests", provided by article 257 of the Criminal Code;

- "Violation of the equality of participants in public tenders or auctions", provided by Article 258 of the Criminal Code;

- "Cleaning of the proceeds of the criminal offense", provided for by Article 287 of the Criminal Code;

- "Appropriation of money or goods derived from a criminal offense or criminal activity", provided by article 287/bi of the Criminal Code;

- "Decriminalization of crime", provided by article 300 of the Criminal Code./ CNA

A day ago, the member of the Presidency of the Democratic Party Belind Kelliçi and the General Secretary of the Democratic Party, Flamur Noka, filed a lawsuit in SPAK for the land at the "former Department of Watches", on which today Carlo Bollino has built the building for the television he owns. 

The lawsuit in SPAK was not only filed against Bollino, but also against Prime Minister Edi Rama, former Minister of Finance and Economy, Anila Denaj, Secretary General of the Council of Ministers, Úngjëll Agaçi, former Secretary General of the Ministry of Finance and Economy , Arian Kraja, Ledia Totas, former Director of the Territory Development Agency.

According to the PD, Bollino, Rama and the above officials are accused of 10 criminal offenses   "Abuse of duty", "Fraud", "Compilation of false statements", "Providing false information", "Forgery of documents", " Illegal profiting of interests", "Violation of the equality of participants in public tenders or auctions", "Cleaning of the proceeds of a criminal offence", "Empropriation of money or goods derived from a criminal offense or criminal activity", "Non-criminalization of crime" . 

Violations according to the PD: 

According to the PD, the procedure starts with the bulletin No. 29 dated 22.07.2019 of the Public Procurement Agency, where the Ministry of Finance and Economy announced the announcement for "Rental of property 7/649 with a total area of ​​4021.5 m²".

Noka and Kelliçi denounce that Anila Denaj, as Minister of Finance and Economy, declared Carlo Bollino the winner, proposing to the Council of Ministers that he not pay 6,300 euros in rent per month, but benefit him with only 1 euro. 

But what happened to the approval of the building permit? 

According to the DP, the illegality begins on January 13, 2020, when the National Council of the Territory, with Chairman Edi Rama, approves a construction permit for a single building. The lease contract clearly determined that Carlo Bollino would have to reconstruct 3 buildings, and then return them to the Albanian state. But in fact, with the next VKM, it was decided to demolish this building and build a new one. 

4 VKMs

In the lawsuit, it is underlined that the Council of Ministers with VKM No. 157, dated 19.02.2020 , gave Mr. Carlo Bollino the right to lease the second floor of the building, with another decision, the Council of Ministers decided that this building should no longer exist, but be demolished.

By decision of the Council of Ministers no. 368, dated 6.5.2020, "For the demolition of three rented buildings, it has been decided : Demolition of 3 buildings with the names "Building no. 1" 2nd floor, "Building no. 2" 1 floor, "Object no. 3" 1st floor, with a total construction area of ​​2497.06 m2, leased with the lease contract no. 2604 rep, no. 727 col, date 14.10.2019, with the contract fee of 1 euro, amended with the annex contract no. 479 rep, no. 189 col, dated 28.02.2020, concluded between the Ministry of Finance and Economy, as lessor, and the company "MTSC", sh.pk, as lessee.

Then, specifically, in July 2020, the decision of the Council of Ministers was approved, VKM 589 dated 22.07.2020. Through this VKM, the object of the lease contract changes, while no building of the lessor, the state, already existed, because the lessor himself, with the VKM, had established their total image.

Specifically, with the proposal of Mrs. Anila Denaj, the Council of Ministers approves VKM no. 589 dated 22.07.2020, through which Article 2 of the lease contract is amended. So Article 2 "Purpose of Use" and point 5.7 of Article 5 "Rights and obligations of the lessee", the words "total reconstruction" are replaced with "minimum total reconstruction". On August 4, 2020, a new Contract Annex is signed, where the legal basis is the same VKM of July 2020./ CNA

Carlo Bollino was criminally charged to SPAK yesterday.

The lawsuit is about the benefit of the land at the "former Department of Watches", where today Bollino has built the television building.

The acquired property was state property with an area of ??4894.10 m2 and the former owners claim that they had donated it to build a gymnasium.

Kelliçi listed all the criminal charges and violations with the 4 government decisions.

First of all, I want to start by clarifying for which criminal offenses Carlo Bollino and Edi Rama and their friends have been charged:

- "Abuse of duty", provided by article 248 of the Criminal Code;

- "Fraud", provided for by Article 143 of the Criminal Code;

- "Compilation of false statements", provided for by Article 163 of the Criminal Code;

- "Providing false information", provided by Article 168 of the Criminal Code;

- "Forgery of documents", provided by Article 186 of the Criminal Code;

- "Illegal benefit of interests", provided by article 257 of the Criminal Code;

- "Violation of the equality of participants in public tenders or auctions", provided by Article 258 of the Criminal Code;

But let's go into a little more detail:

So, as it turns out, the company MTSC sh.pk, at the time of receiving the construction permit on 13.1.2020, this permit was given for the construction of a unique building, and not the reconstruction of three different existing state buildings, as foreseen in lease contract, the company did not have ownership or tenancy rights over the second floor of the main building, which was given to this company only with VKM No. 157, dated 19.02.2020, while the construction permit was granted 30 days ago, on 13.1.2020.

Then the question arises:

- How did KKT know that Anila Denaj, Minister of Finance and Economy, would very soon propose a decision, and this would be approved by the Council of Ministers, to give Mr. Bollino an additional area in the state buildings?

- How did KKT know that the state buildings that were leased by the Ministry of Finance and Economy would be demolished, at the proposal of the latter, while KKT gave the construction permit on 13.1.2020, while the demolition of the building it would happen 4 months later?!!!

- If the construction permit is granted by the KKT, on January 13, 2020, is this the act that dictated the lease relationship or the very existence of state buildings and at the same time the fate of the land, and this act with the chairman of the body, Mr. Edi Rama, the one who ordered Mrs. Anila Denaj to change the terms of the contract and then the very existence of the buildings in violation of the law?!

By decision of the Council of Ministers no. 368, dated 6.5.2020, "For the demolition of three rented buildings, it has been decided:

1. Pra, vetëm dy muaj, pasi Këshilli i Ministrave me VKM Nr. 157, datë 19.02.2020, ia dha zotit Carlo Bollino të drejtën e qiramarrjes për katin e dytë të godinës, me një tjetër vendim, po Këshilli Ministrave vendosi që kjo godinë të mos ekzistojë më, por të prishet.

Kjo tregon, se veprimtaria publike, që po realizohej sipas këtyre akteve, ishte dhënia e gjithë pasurisë publike, me qira përpara prishjes së tyre, me qëllim që zoti Bollino të përftonte maksimalisht gjithë sipërfaqen e truallit funksional dhe nën objekt të tyre.
Me pas, konkretisht, në korrik të vitit 2020 miratohet vendimi i Këshillit të Ministrave, VKM 589 datë 22.07.2020.

Përmes kësaj VKM-je, ndryshon objekti i kontratës së qirasë, ndërkohë që asnjë godinë e qiradhënësit shtet, tashmë nuk ekzistonte, sepse vetë qiradhënësi, me VKM kishte vendosur shembjen totale të tyre.

Atëherë lind pyetja: Cila është ajo pasuri publike, që zoti Bollino kishte të drejta qiraje dhe do të rikonstruktonte për ndërtimin e një televizioni me kushte bashkëkohore?!

Për të mbuluar sado pak këtë injorancë/makutëri në shpërdorimin e pasurisë publike, rezulton se Këshilli i Ministrave është investuar sërish për të plotësuar, aktet rregullatore, në kushtet kur objekti i qiradhënies nuk ekzistonte më.

Konkretisht me propozim të zonjës Anila Denaj, Këshilli i Ministrave, miraton VKM nr. 589 datë 22.07.2020, përmes të cilës ndryshon Nenin 2 të kontratës së qirasë.
Pra Neni 2 ?Qëllimi i Përdorimit? dhe pika 5.7 e nenit 5 ?Të drejtat dhe detyrimet e qiramarrësit?, fjalët ?rikonstruksion total? zëvendësohen me ?rikonstruksionin minimalisht të totalit?.

Pra lind pyetja: Në kushtet kur objekti u shemb, cili nga objektet do të rikonstruktohej, dhe sipas Këshillit të Ministrave, në mënyrë ?minimalisht të totalit??!
Kjo lloj zgjidhje tregon se Këshilli i Ministrave dhe Ministria e Financave, përpiqen të mbulojnë paligjshmërinë flagrante të veprimeve të tyre, në shërbim të zotit Bollino dhe televizionit të rij, ?të pavarur?!

Në këtë moment ndodh dhe paligjshmëria me flagrante. Në datën 24 korrik të vitit 2020, pas miratimit të VKM, firmoset Aneks Kontrata mes Ministrisë së Financave dhe subjektit MTSC. Por kjo kontratë nuk shërbente për zbardhjen e lejes, pasi gjithmonë flitej për rikonstruksion të godinave që tashmë ishin prishur, po me vendim të firmosur nga Edi Rama.

Prandaj me datë 4 gusht 2020, firmoset një Aneks Kontratë e re ku si bazë ligjore është po e njëjta VKM e muajit korrik 2020, por tashmë fjala rikonstruksion total, zëvendësohet me ?rindërtim jo më pak se sipërfaqja e godinës ekzistuese?. Kjo fjalë nuk përmendet në asnjë moment të VKM. Pas këtij falsifikimi firmoset dhe zbardhja e lejes së ndërtimit, bazuar në po këtë Aneks Kontratë.
