The latter have benefited thanks to falsified tax invoices worth about 4 million euros, presenting and declaring invoices for works performed as subcontractors of the company "Integrated Energy BV SVP" with fictitious entities, which according to SPAK are registered as economic operators , but who have never exercised real activity.

In the present case, SPAK points out, Klodian Zoto has declared works performed on behalf of the concessionaire company, based on a forged subcontracting contract, presenting it only as a contractual relationship between his ITS and the concessionaire company "Integrated Energy BV SVP", but it actually turns out that Zoto and Mirel Mërtiri won the contract and then set up a complete forgery scheme to get the money.

So, SPAK declares that Klodian Zoto's ITS company has made fictitious invoices for the company in the Tirana incinerator, where again the "de facto" owners are Klodian Zoto and Mirel Mërtiri, who have not been satisfied with just that, but have made fake invoices.

In the content of these invoices, the citizen Klodian Zoto presented as the performance of works and the purchase of goods for the entities "Lumi-06" sh.pk, "AA-117" sh.pk, "AL-BerCo&Co" sh.pk and "EZ & LA" sh.pk, but which actually, says SPAK, contain false circumstances.

Specifically, these are explained below. Regarding the subject "Lumi-06" is spoken on page 18 to page 19, then it continues with the company "AA-117".

On page 20, the company "AL-BerCo&Co" is mentioned, while the Special Prosecutor's Office also mentions concrete names, means, invoices of the citizens involved. Page 21 starts with "AL-BerCo&Co" and ends with "EZ & LA".

SPAK emphasizes that the employees of these entities are simultaneously employed in different functions in several companies with employees and many of them have never worked for the 4 above-mentioned companies.

In the above circumstances, according to the prosecution, it turns out that Zoto, in cooperation with Mërtir, benefited with forged tax invoices, as we mentioned, about 400 million new ALL, but also the previous values ??that were mentioned in another act.

Further, SPAK declares that in the above circumstances, Zoto and Mërtiri, the "de facto" shareholders of "Integrated Energy BV SPV", in cooperation with each other, are suspected of having committed the criminal offenses of "Fraud with serious consequences", in cooperation, "Cleaning of the products of a criminal offense or criminal activity", carried out in cooperation and under qualifying circumstances, according to article 287, paragraph 2 of the Criminal Code. Also published is the fact of the benefit that Alqi Blako had, a machine worth about 120 thousand euros, which was bought for the account of his father's factory, but was paid for by Klodian Zoto's wife a few weeks before the concession contract was signed for the incinerator of Tirana.

According to the official document that SPAK has sent to the Special Court of First Instance, it turns out that persons who were administrators and shareholders of the company were interrogated.

CNA is bringing the testimony of Giuseppe Ciaffaglione, who was questioned by the Italian judicial authorities on June 22 of last year by letter, this one executed directly.

SPAK, after having seized a quantity of documents of the company "Integrated Energy BV SVP" in Tirana, has asked the citizen Giuseppe Ciaffaglione about the signing of the contract between "Integrated Energy BV SVP" and the company "Integrated Technology Services" of Klodian Zoto in December of of 2017, but Ciaffaglione states that he did not sign this contract and that he was looking at this contract for the first time.

From the analysis of the sales books, according to page 17 of SPAK, it is emphasized that the Municipality of Kavaja also paid a figure of about 1.3 million dollars. The Municipality of Vora also turns out to have paid an amount of about 180 thousand dollars.

Giuseppe Ciaffaglione ka qenë administrator i inceneratorit të Tiranës, është edhe aksioner i saj me vlerën 20%, por ai ka deklaruar se këto aksione nuk i ka blerë dhe nuk ika si vlerë monetare, por i janë dhënë për shkak të kapaciteteve teknike që ai zotëronte, duke njohur mirë fushën në të cilën po operohej.

CNA published yesterday the first 11 pages of the accusation that SPAK has brought against the Tirana incinerator company. Days ago it was announced that the real shareholders, hidden in the company, not revealing their names, are Klodian Zoto and Mirel Mërtiri, this has already been confirmed by SPAK.

On pages 12 and 13, the conditions of the contract, the transfer to the contracting authority of the conclusion of the concession contract, the way it would be signed, the exchange document between APP and the Ministry of Environment, while it was concluded to proceed with the concession and the signing of of the contract from the Ministry of Environment, after the rules have been defined through a concession contract working group, which passed into the hands of Klodian Zoto and Mërtir before.

However, SPAK, on ??page 14 of the request that it brought to the Court of First Instance, states that several criminal offenses have been identified until the investigation stage. So, the investigative phase for the incinerator in Tirana's landfill continues, documents, facts and evidence are collected.

According to the document, it is said that Alqi Blako, in the capacity of the Secretary General of the Ministry of Environment, has irregularly requested and benefited from the citizens Klodian Zoto and Mirel Mërtiri the value of about 119,755 euros, in order to favor the granting of the concession to the concessionaire company "Integrated Energy BV", and this had shareholder Klodian Zoton, who was the sole shareholder of the company "ITS".

According to SPAK, the citizen Alqi Blako secured this irregular benefit indirectly through Klodian Zoto, by making payments for machinery for filling, sealing, sealing and certification of bottles, machinery for gasification of drinks worth 119,755 euros.

The payments for this equipment were made by the company of Zoto's wife, SPAK points out, which bought the equipment from an Italian company with payments made in two installments, which started before the award of the concession contract, that is, on November 22, 2016. after that, there is another contract on July 11, 2017, that is, a few weeks before the Tirana concession contract was signed.

We recall that some time ago Alqi Blako had signed the documents for Fier and Elbasan and was involved in the whole affair of the incinerators in his position as Secretary General of the Ministry of Environment.

From the data of SPAK, which were recorded as evidence, on Klodian Zoto's computer by the expert witness, it results that in 2016 Alqi Blako made communications through his electronic address with the representative of the company "IC Filling Systems", at an address and then Alqi has delivered a document, which is the agreement for a technological line for filling beer bottles.

This line was paid for by the wife of Klodian Zoto, on account of Alqi Bllakos. SPAK points out that during the investigations it was found that Alqi Blako, in the capacity of Secretary General of the Ministry of Environment, benefited from the monetary amount of 120 thousand euros, in order to favor the procedure of granting the concession of the concession company "Integrated Energy BV" composed of in which Klodian Zoto's company "Integrated Technology Services" was also a shareholder.

Alqi Blako, with his illegal actions, is suspected of having committed the criminal offense of "passive corruption of persons exercising state functions, or of local elected officials", provided for in Article 260 of the Criminal Code.

This is the part that is spoken about Alqi Bllako, that is, beyond the fact that previously the citizen Giuseppe Ciaffaglione, the former administrator of the company, has been declared internationally wanted, after having employed the father of Alqi Bllako, Mr. Edmond Bllako with a salary of 10 thousand euros per month and SPAK at that time connected it to the Fier incinerator, as a benefit that the former secretary received for its construction.

Now a new fact emerges. The purchase of a production machine worth 120,000 euros, which was completely discovered by SPAK, where it was bought by a company of Klodian Zoto's wife and then passed on to Alqi Bllakos.

SPAK has seized all the materials, evidence, documents, invoices, payments, a fact that shows that the scheme of Alqi Bllakos to benefit from the construction of the Tirana landfill is already clear. One of the proofs is the machinery.

We emphasize that in these documents SPAK clearly shows that Klodian Zoto is the person engaged, together with the citizen Mirel Mërtiri and the citizen Denisa Tollkuçi all the time with emails and communications to prepare everything the state needs until the signing of the concession contract.

There are e-mails with senior officials of the ministry, advisors of the Minister of Environment, there are various communications of the Ministry of Environment with other ministries, which would be included in this concession to grant the relevant permits, including the Municipality of Tirana.

Everything was followed by Klodian Zoto and Mirel Mërtiri as two responsible persons.

Further, CNA will bring facts and evidence, which show how the company's shareholders admit to SPAK that the people of the incinerators are called Mirel Mërtiri and Klodian Zoto and they are simple and only "sleeping" shareholders because they are set with a percentage of shares for secure financing.

Since the financing was not provided until the moment when the persons were interrogated, they declare that they have no responsibility, they have not appointed anyone, they have not signed any order, they have not given any payment, they do not even know who is the administrator, who appointed him.

They always talk about two citizens, Klodian Zoto and Mirel Mërtir, as the two individuals who raised the pyramid of fraud, scandal and corruption with the affair of the incinerators from Elbasan, in Fier and already proven in Tirana with the depositions of several foreign citizens, who in the official documents at KKB and in those published by CNA, they appear as the sole shareholders of the company "Integrated Energy BV", which has changed its name to "Geogenix".

On September 28, 2016, the Ministry of Environment sent the Ministry of Finance the request for the preliminary approval of the feasibility study for the Tirana incinerator concession.

Three weeks later, the Ministry of Finance replies that it cannot comment on this concessionary project as long as the conditions, criteria and documentation defined by the laws in force have not been met. Also, the Ministry of Finance brings to the attention of the Ministry of Environment that the costs of the project are planned to be covered within the annual budget approved by the Assembly.

During this time, the Concession Commission, set up by the Ministry of the Environment with members from this ministry, the Municipality of Tirana and the Concessions Agency, held its fourth and fifth meeting, where it decided to propose to the government that Integrated Energy BV The SPV was given a bonus of 8 percent of the points for the unsolicited proposal.

After the first rejection, on November 27, the Ministry of Environment again sends the request for approval to the Ministry of Finance together with the feasibility study and the draft concession contract.

Three days later, on November 30, the Ministry of Finance again rejects the approval. In the reply, the Ministry of Finance says that the Ministry of Environment has not clearly stated whether the municipalities of the Tirana district have foreseen the coverage of the fee in their mid-term budget. According to Finance, in relation to the bonus draft decision, on the one hand, it is determined that the Tirana incinerator concession will not have additional effects on the state budget because it is a private investment, while on the other hand, it is stated that the district municipalities will pay the deposit fee waste.

Enter the government

A week later, on December 7, the Council of Ministers approves the decision that gives the 8 percent bonus to the company Integrated Energy even though the Ministry of Finance did not approve the financing for this project.

After the approval of the bonus in the government, the Ministry of Finance is asked again to approve the financing of the project, but this time not from the Ministry of Environment, but from the Concession Commission. On December 27, 2016, the Commission held the minutes of the 7th meeting, where it decided to send the request for approval to the Ministry of Finance again, accompanied by the feasibility study and the draft concession contract.

Almost a month later, on January 23, 2017, the Ministry of Finance responded to the Ministry of Environment, requesting additional clarifications regarding the additional effects that this project would have on the state budget, the comparative analysis of why it was necessary with a concession and not to be built by the state, how the costs of expropriation would be covered, as well as clarifications on the investment return rate.

On February 1, 2017, the Ministry of Environment re-sent the request for approval to the Ministry of Finance for the fourth time.

Two weeks later, the Ministry of Finance responded to the Ministry of the Environment informing them that before announcing the concession awarding procedure, it should reflect the recommendations of the Ministry of Finance in the letter of January 23, 2017, regarding the effects on the budget. comparative analysis, etc.

On February 21, the Ministry of Environment re-sent the request for approval to the Ministry of Finance, reflecting in it additional materials according to the recommendations of Finance.

On March 2, the Ministry of Finance refuses approval for the fifth time, asking the Ministry of Environment to obtain approval from the Tirana region, as the project would financially affect all municipalities in the region.

Meanwhile, Alqi Blako had already sent the letter for approval to the municipality of Tirana on February 28. A month later, on March 27, the Mayor of Tirana responded to Alqi Bllakos' letter for approval, expressing his agreement in principle with the feasibility study.

A day later, on March 28, the Ministry of Environment sends for the sixth time the request to the Ministry of Finance for the final approval of the concession procedure.

On the 6th shot the dam broke. On April 6, the Ministry of Finance gave approval without comment, reminding the Ministry of Environment that the financier and main beneficiary of this project would be the Municipality of Tirana. Also, in the same letter, Arben Ahmetaj asks the Ministry of Environment to get approval from other local government units involved in this project regarding their bearing the financial risk of not fulfilling the amount of waste.

The above materials are taken from the first 11 pages of the file that SPAK took to the court for the sequestration of the Tirana incinerator. These 11 pages published a day ago by the  CNA portal  also show us the reason why SPAK has probably not been able to bring charges of abuse of office against the former Minister of Finance. Because according to SPAK itself, the Ministry of Finance blocked the Tirana incinerator concession for 6 months in a row, refusing to approve this project five times, even though the government had meanwhile approved the 8 percent points bonus.

Dokumenti i SPAK tregon se si janë çuar dokumentet dhe kërkesat përkatëse nga Ministria e Mjedisit, te Ministria e Energjisë dhe Infrastrukturës, te Ministria e Drejtësisë, te ministria e Mjedisit dhe te Bashkia e Tiranës.

Gjithmonë del emri i Klodian Zotos dhe në një moment edhe i kryetares së komisionit të koncesionit, që është zonja Valbona Ballgjini. Në vitin 2016 rezulton që kanë filluar mbajtjet e procesverbaleve dhe diskutimet në bashkinë e Tiranës.

Përfaqësuesit e bashkisë theksohet se kanë deklaruar që përballimi i kostove ishte i pamundur dhe do të duheshe mbështetja e Qeverisë për të paktën 4 vitet e para, dokumentet e ndryshme që kalojnë nga një e-mail në tjetrin, protokolle që i dërgohen ministrive, ka raste që disa ministri kundërshtojnë.

Kundërshtitë nga disa ministri

Një i tillë është në momentin kur fillohet t?i kërkohet dhënia e bonuesit prej 8 pikësh për kompaninë ?Integrated Energy?. Fryrja e kostove për venddepozitimin e mbetjeve

Në dokumentin numër 9 që shihni më poshtë, rishfaqen në e-maile Mirel Mërtiri dhe Klodian Zoto, ku ata komunikojnë me shtetasin Ilirjan Priftanji, ndërkohë që bëhet një preventiv i ri, sipas sugjerimeve të Mirel Mërtirit për venddepozitimin ekzistues dhe mbylljen e tij, ku në fillim vlera firmoset rreth 12.1 milionë euro dhe më pas fryhet me një shumë më të madhe dhe këtë SPAK e ka konstatuar.

Vlera rritet me rreth 100 mijë euro, por nga ana tjetër në faqen 9 flitet se Mirel Mërtiri i është përgjigjur e-maileve të Klodian Zotos dhe personave të tjerë të përfshirë, duke dhënë dakordësinë e tij për të proceduar pas ndryshimit të këtij preventive.

Në faqen 10 gjithashtu flitet se kostot e ndërtimit sipas rezultateve që duken nga studimi i fizibilitetit, janë fryrë me të paktën 26 milionë euro nga krahasimi i të dhënave me koston e ndërtimit të landfillit dhe inceneratorit të Tiranës. Kjo është përllogaritur nga SPAK, duke nxjerrë diferencën në faqen 10 të publikuar më poshtë nga CNA.

Sipas të dhënave të administruara nga kompjuteri i Klodian Zotos dhe ekspertizës së bërë, rezulton se shtetasi Elton Kalleshi jep të dhëna të plota për vlerat e kostos se sa kushton incenerimi, pra kostoja e landfillimit, shitjet, të ardhurat e tjera që krijohen dhe sa është fitimi i kompanisë dhe më pas ka komunikime të tij që shkojnë deri tek finalja.

Komunikimi i Ministrisë së Mjedisit me Klodian Zoton

Pas dhënies së ?OK? nga ministri, ka rifilluar dhënia e shkresave për të kthyer përgjigje institucioneve të ndryshme, komisionet e dhënies-mbajtjes koncesion, është proceduar që të përfundohet vlerësimi i ofertës së paraqitur nga shoqëria koncesionare, ministria e Mjedisit gjithashtu ka kërkuar sqarime nga kompania në lidhje me dokumentacionin që kjo ka çuar në ministri sipas të dhënave të publikuara më lart. Në datën 16 korrik 2017, shoqëria ?Integrated Energy B.V.?, i përgjigjet Ministrisë së Mjedisit, duke sqaruar se për çdo pyetje në lidhje me dokumentacionin e dorëzuar prej tyre, ata ishin të gatshëm të vinin në dispozicion ekspertët e tyre. Kjo shkresë, është nënshkruar, siç thuhet edhe nga shtetasi Klodian Zoto.

Pra, gjithçka ka theksuar CNA, që inceneratori i Tiranës, landfilli dhe gjithçka tjetër kanë filluar nga Klodian Zoto dhe Mirel Mërtiri, ashtu siç është rasti i Elbasanit, ku Mërtiri fshihet pas bashkëjetueses së tij, Stela Gugallja, apo në Fier, ku Zoto del direkt me kompaninë e tij ?ITS? dhe themelon një kompani tjetër për të marrë koncesionin e landfillit të Tiranës.

Alberto Presezzi has stated that together with the Swiss company "Icare" they own the majority of the shares of "Geogenix BV", but he has emphasized that their shares are dormant, without legal force , since they could not find the financing of 100 million euros for the incinerator. Tirana.

In response to SPAK, the four shareholders have emphasized that they know Mirel Mërtir and Klodian Zoto through the Italian Giusepe Ciaffaglione.
