2 lawsuits and 15 charges in SPAK for Carlo Bollino

The Democratic Party announced today that it has submitted to SPAK a second lawsuit against Carlo Bollino, this time for "BUNK'ART".

The General Secretary of the DP, Flamur Noka, told reporters that the contracts for the benefits of funds from "Bunkart 1" and "Bunkart 2" were made in violation of the law and that since the beneficiary entity, in this case Bollino was not selected by the commission established for the assessment of artistic and economic quality and collegium.

The first concerns a contract worth ALL 11,985,000. 

"By order no. 309, dated 30.10.2014 of the Minister of Culture, the financing of the project "BUNKERI" to be realized by QSSL in the amount of ALL 11,985,000 ALL is ordered, Ms. Elira Kokona is authorized to sign the contract with Mr. Ergys Gezka , Executive Director of QSSL, with whom the service contract no. 5208 dated 11.11.2014 was concluded".
This contract was concluded in violation of law no. 10352, as the beneficiary entity was not selected by the commission established for the assessment of artistic quality of economy and collegium. The Minister of Culture at that time was Mirela Kumbaro", said Noka. 

PD further denounced that after the first funds were received, it is seen that the payments for BUNK'ART go to another NGO, "CENDRA URA", and this one is headed by Ergys Gezka. The latter has received 320,000 euros in payments from the State Budget, in addition to the income from the tickets sold.

A very important moment that connects Karlo Bolino with these funds is the company Spazio Eventi Albania.

"The company founded by the 'presta-nome' of Karlos, Lindita Doda (this founded the MTSC company that acquired the property for REPORT TV) and several other citizens. In 2018, Alba Malltezi buys 59% of the shares of this company.  From the analysis of the balance sheets of 'Spazio Eventi Albania' it is established that it is the final beneficiary of the amount of ALL 11,985,000 given by the Ministry of Culture", said Noka. 

According to the PD, a very important part of the report is the name Ergys Gezka and his family members who have set up a scheme with several NGOs, which benefit from funds from the Budget. Ergys Gezka is an associate of Bollino. 

"Karlo Bolino's employee for BUNK'ART, Ergys Gezka, has held several public functions during the period 2015-2021 in the Municipality of Tirana, the Ministry of Health and the Ministry of Finance. SPAK must follow the money and will clearly understand that Karlo Bolino has set up a sophisticated scheme of fictitious organizations to benefit public money.  Another point of the criminal complaint is the financing of Karlo Bolino's company, C-7 Communication Systems by the company owned by Igli Gjelishti, Image&Communications Development. Igli's company "Gjelishti has benefited from 12 million dollars of tenders in the period 2019-2023, with which they fictitiously financed Karlo Bolino to build Report TV and not only", he said

The accused persons in the second lawsuit are: 

-Elira KOKONA, Albanian citizen, former General Secretary of the Ministry of Culture at the time of the events. Currently, she is the director of the Investment Corporation directly subordinate to the Prime Minister.
- Carlo Bollino , Italian citizen, naturalized Albanian, born in Lecce (Italy), resident in Tirana, owner of "Report TV" and "Shqiptarja.com".
- Alba Ridvan Malltezi, partner in the company "FFM Group" sh.pk and in the company "4B Communications" with address for notification: "Shqiptarja.com", "Ndre Mjeda" Street, "Former Enterprise Metalike Tirana", ( Department of Watches) - Tirana, Albania.

- Igli Ilir Gjelishti, Albanian citizen, owner of the company "Image & Communications Development".

-Ergys Arben Gezka , former director at the Ministry of Finance and currently human resources expert at the NGO - "LiburnEtik" Association. 

- Arben Myftar Gezka , head of the "Hand of Reconciliation" Association (DEP)./ CNA

The Democratic Party has signed another report to SPAK for the publisher Carlo Bollino, this "BUNK'ART", where it is accused that the contract is in violation of the law. 

After the first lawsuit where he is accused of 10 criminal offenses, 5 more charges were filed against him in the second lawsuit. (read here)

This is the second lawsuit in SPAK of the DP against Carlo Bollino. Sources for CNA indicate that a third lawsuit is being prepared against Bollino in SPAK. 

The accused persons are: 

-Elira KOKONA , Albanian citizen, former General Secretary of the Ministry of Culture at the time of the events. Currently on duty as Director of the Investment Corporation under the direct authority of the Prime Minister.
- Carlo Bollino , Italian naturalized Albanian citizen, born in Lecce (Italy), resident in Tirana, owner of "Report TV" and "Shqiptarja.com".
- Alba Ridvan Malltezi , partner in the company "FFM Group" Sh.pk and in the company "4B Communications" with address for notification effect: Shqiptarja.com, Rruga "Ndre Mjeda", "Former Enterprise Metalike Tirana", (Department of Hours) - Tirana, Albania.

- Igli Ilir Gjelishti , Albanian citizen, owner of the company "Image & Communications Development".

-Ergys Arben Gezka,  former Director at the Ministry of Finance and currently human resources expert at the NGO - "LiburnEtik" Association. 

- Arben Myftar Gezka,  head of the "Hand of Reconciliation" Association (DEP).

Opposition experts have submitted another report to SPAK for the publisher Carlo Bollino.

After the first lawsuit where he is accused of 10 criminal offenses, 5 more charges were filed against him in the second lawsuit.

In the report made, Bollino is accused of the following criminal offences:

1) "Concealment of income", provided by Article 180 of the Criminal Code.

2) "Exercising illegal influence on persons exercising public functions", provided by Article 245/1 of the Criminal Code.

3) "Active corruption of persons exercising public functions", provided for by Article 244 of the Criminal Code.

4) "Active corruption of high state officials or local elected officials", provided by Article 245 of the Criminal Code

5) "Cleaning of the proceeds of the criminal offense", provided for by Article 287 of the Criminal Code,

Criminal offenses committed in collaboration (Article 25 of the Criminal Code).

Sources told CNA that there will be a third lawsuit against publisher Carlo Bollino.

As we mentioned above in SPAK, another lawsuit was filed against Bollino by opposition experts where he was accused of 10 criminal offenses such as  "Abuse of duty", "fraud", "compilation of false statements", "providing false information ", "forgery of documents", "illegal benefit of interests", "violation of the equality of participants in public tenders or auctions", "cleaning of the proceeds of a criminal offence", "embezzlement of money or goods derived from a criminal offense or criminal activity" and "non-reporting of crime".

The first lawsuit was about the benefit of the land at the "former Department of Watches", where today Bollino has built the television building.

The acquired property was state property with an area of ​​4894.10 m2 and the former owners claim that they had donated it to build a gymnasium.

While the second lawsuit concerns the facilities "Bunkart 1" and "Bunkart 2", which he uses for the purposes of economic gain./ CNA
