The Central Election Commission has responded to the postal company DHL regarding the delay in payment for the provision of voting services for the May 11 elections by Albanians in the diaspora.

Through a letter from the State Election Commissioner Ilirjan Celibashi, he emphasizes that the obligation to pay arises only after the performance of the service according to the object of the contract is verified and that the mere submission of invoices to the system does not automatically oblige the institution to make the payment or pay interest on late payments.

Dear Mr. Koçollari,

In response to your letter forwarded on 01.09.2025, recorded with our no. 5950 Prot., dated 01.09.2025 with the subject "Repeated request for payment of contractual obligations", please note the following:

Contract no. 1358/20 prot., dated 04.04.2025 “Postal service for voters from abroad” concluded between the Central Election Commission (CEC) and “DHL International Albania” sh.pk (DHL), has as its object the provision by the latter of the service of sending ballots to voters residing outside the territory of the Republic of Albania for the elections for the Assembly of Albania on 11 May 2025. The CEC will pay DHL for the provision of this service.

In accordance with the object of this contract, the parties to it, CEC and DHL, have mutual rights and obligations which are reflected in this document.

As part of these rights and obligations, allow me to bring to your attention, in particular, some contractual provisions:

Article 1.11 “Inspections and Audit by the Buyer”

Supplier shall respond to questions and provide Buyer with any information or documents necessary for (i) investigation of allegations of Prohibited Practices, or (ii) Buyer's monitoring and evaluation of the Contract and to enable Buyer to review and address any issues relating to the Contract.

The Supplier maintains all documentation related to the implementation of the Contract in accordance with applicable legislation.

Article 4 “Supply Object”

4.1 “The services to be supplied must be in accordance with the terms of reference and conditions set out in the Tender Documents.

4.2 The terms of the contract do not differ from those described in the tender documents and in the winning bid, except in cases where the Supplier, for objective reasons independent of it at the time of bidding, offers, at the same price, better terms than those tendered.

Article 5 “Delivery”

5.1 The delivery of the Services shall be in accordance with the requirements specified in the Tender Documents.

Article 6 “Supplier’s Responsibilities”

6.1 The Supplier shall be responsible for performing all Services in accordance with the requirements set out in the Tender Documents.

Neni 8 “Detyrimet e Veçanta të Furnizuesit” 

Furnizuesi duhet të kryejë të gjitha Shërbimet siç specifikohet tek Termat e Referencës.

Furnizuesi duhet t’i paraqesë Blerësit të gjitha shërbimet, në sasitë e përcaktuara, siç kërkohen nga kontrata duke përfshirë, por jo të kufizuara nga, të gjitha raportet, dokumentat, studimet, skicimet dhe planimetritë.

Furnizuesi duhet të sigurojë raportet e lidhura me zbatimin e Shërbimeve siç kërkohet në kontratë.

Neni 10 “Kushtet e pagesës”

10.2 Pagesat do të kryhen menjëherë nga Blerësi, jo më vonë se periudha kohore e specifikuar në KVK pas dorëzimit të një fature ose kërkese për pagesë nga Furnizuesi, dhe pasi Blerësi ta ketë pranuar atë.

Neni 15 “Dispozita të Fundit”

Për sa nuk parashikohet shprehimisht në këtë kontratë, do të zbatohen dispozitat e parashikuara në Kushtet e Përgjithshme të Kontratës, të publikuara si pjesë e Dokumenteve Standarde të Tenderit të procedurës së prokurimit me objekt këtë kontratë”.

Sjellim gjithashtu në vëmendjen tuaj se pjesë tërësore e kësaj kontrate janë edhe anekset:

“Aneksi 1” – Oferta ekonomike;

“Aneksi 2” – Termat e referencës;

“Aneksi 3” – Propozimi teknik;

“Aneksi 4” – Vendimi nr. 13 datë 12.01.2024 “Për miratimin e rregullave për procedurën e votimit nga jashtë vendit”, i ndryshuar

Në vlerësim të dispozitave të sipërcituara, por edhe në tërësi nga përmbajtja e gjithë kontrata, është qartësisht e kuptueshme se detyrimi i KQZ për t’ju paguar vjen vetëm pasi të verifikohet kryerja, ose jo e shërbimit nga ana juaj sipas objektit të kontratës. 

Vetëm fakti se DHL i ka përcjellë këto fatura në KQZ dhe se ato janë tashmë në sistem (por as janë pranuar dhe as nuk janë refuzuar) nuk e detyron automatikisht KQZ që të bëjë pagesën e tyre, e më shumë akoma të paguajë për kamatvonesa.

Sikurse edhe në çdo kontratë tjetër të ngjashme, bazuar në përmbajtjen e vetë asaj, si dhe në legjislacionin përkatës, shërbimi i marrë përsipër për t’u kryer nga njëra palë (DHL me këtë rast) do të duhet të provohet se është kryer në sasi, në cilësi dhe në kohë. Ky është një parashikim kontraktual i qartë edhe në kontratën objekt trajtimi në këtë komunikim. 

Pranimi i kryerjes së shërbimit nga pala tjetër (KQZ), e detyron këtë të fundit që të paguajë për shërbimin e marrë.

Sikurse ju shumë mirë e dini, midis KQZ dhe DHL, nuk ka akoma një dokument, i cili sipas kontratës, si dhe dispozitave përkatëse të Kodit Civil, ligjit nr.162/2020 “Për Prokurimin Publik” i ndryshuar, të tregoj/të provojë se (nga KQZ) është pranuar  pjesërisht, apo tërësisht kryerja e shërbimit nga ana juaj sipas parashikimeve kontraktuale. 

Thënë sa më sipër faturat e dërguara nga ana juaj në KQZ në bazë të cilave ju kërkoni të paguheni për shërbim e kryer sipas objektit të kontratës, nuk kanë respektuar procedurën kontraktuale dhe atë ligjore të rastit dhe rrjedhimisht nuk përbëjnë deri më tani detyrim për t’u paguar nga ana e KQZ.

The CEC has subsequently requested that you make available to it all the documentation proving your performance of the contractual service (see for this purpose the documents no. prot 3592, dated 30.04.2025; no. prot 3683, dated 03.05.2025; no. prot 4009, dated 08.05.2025; no. prot 4444, dated 13.05.2025; no. prot 4444/2, dated 22.05.2025, (together with the proof of signature and the delivery route with timestamp).; no. prot 4444/4, dated 28.05.2025; no. prot 4444/6, dated 4.06.2025 and that with no. Prot 5318/1, dated 10.07.2025)

A large part of this documentation has already been sent by you. However, due to the large volume of data contained in this documentation, it has been impossible for the CEC to complete its review and evaluation by the time this response is being sent to you. It is a universally recognized fact that during this period the CEC has continued to be engaged in fulfilling its constitutional and legal obligation to administer the electoral process of May 11, 2025. As you may be aware, the completion of this process is dated September 4, 2025!

Apart from the fundamental reason explained above, the non-payment of the invoices sent by you is also related to the content of the invoices themselves. Their content does not indicate anything about how much, how and when your service was performed according to the object of the contract. The lack of this clarity in the content of the invoices constitutes a legitimate reason for the CEC to not pay them.

The above also supports the CEC's claim that your request for payment of late payment interest is without contractual or legal grounds.

Dear Mr. Koçollari,

The CEC recognizes all obligations towards DHL arising from the Contract with no. 1358/20 prot., dated 04.04.2025 “Postal service for voters from abroad” concluded between these two legal entities and is committed to fulfilling these obligations. Therefore, to continue with this fulfillment, you are requested to:

1. revoke your request for late payment interest;

2. authorize a DHL representative to coordinate with the CEC to draft the document (minutes) regarding the performance of the contractual service by DHL and the acceptance of this service by the CEC;

3. resend invoices for services rendered by state;

Fulfilling these requirements as soon as possible paves the way for the immediate payment by the CEC of financial obligations towards DHL.

The CEC reconfirms once again that the first-time voting of voters from abroad, in the elections for the Albanian Parliament on May 11, was a process that was successfully carried out even though it was challenged by the time factor and other objective and subjective factors. On this occasion, the CEC appreciates the commitment of DHL as a contractual partner of this institution to contribute to the realization of this process./CNA 

Ragip Gila, the perpetrator of today's attack in Shkodra, turns out to be a person with a criminal past. In 2023, Gila was arrested as a suspect in supplying criminal groups with weapons and various materials.

Ragip Gila has been found guilty by the Shkodra Court for the criminal offense of "Production and sale of narcotics." An offense for which he was sentenced to 5 years in prison, a sentence which was reduced to 3.4 years in prison due to the summary trial.

CNA has secured the court's decision, which decided to suspend Gila's prison sentence, assigning him a "probationary service" measure for 5 years, on condition that he does not commit another criminal offense during this period.

The State Police has published the plan of measures taken for tomorrow's match between Albania and Latvia on "Air Albania".

In a statement, the police announced that several road axes near the "Air Albania" stadium will be blocked.

It is also said that all fans entering the stadium will be thoroughly checked.

Plan of measures by the State Police

State Police, a special plan of measures to guarantee order and security before, during and after the football match "Albania - Latvia" that will take place on September 9, 2025, at 8:45 PM, at the "Arena Kombëtare" stadium, Tirana.  

Based on the positive experience in planning, organizing and managing the public order and security situation during international events, the State Police has drafted a special measures plan with concrete tasks for all Police structures involved. Specifically, the measures plan foresees:   

-Escorting and securing the Latvian team's footballers from Rinas airport, to the hotel, to the stadium and back to Rinas; 

-Escorting and securing the Albanian team's football players at the stadium; 

-Conducting detailed checks on the stadium premises and inside the stadium, for unauthorized citizens, items and pyrotechnics, before fans enter;

-Organization of services to guarantee public order before, during and after the football match, not only near the stadium, but also control of the territory throughout the city of Tirana;

-Ensuring emergency service routes;

-Road traffic management in the city of Tirana, before, during and after the football match.

To guarantee security before, during and after this international match, cooperation has been established with all institutions that have a role in the smooth running of this activity, specifically with the Albanian Football Federation, UEFA, the Republic Guard, the Municipal Police, the Fire Service, private security companies (stewards and security personnel), hospitals, health centers and first aid centers.

Also, contacts have been established and cooperation is being carried out with the security service personnel of the Latvian football team, in order to increase security standards before, during and after the development of this international match.

For the smooth running of this activity, on September 9, 2025, from 5:00 PM until the end of the match, the State Police, in cooperation with the Tirana Municipal Police, will apply vehicle traffic restrictions on several road axes near the stadium, specifically:  

Bulevardi “Dëshmorët e Kombit”, nga kryqëzimi pranë Presidencës drejt sheshit “Nënë Tereza”, rruga “Papa Gjon Pali i II”, rruga “Dervish Hima”, pranë Ambasadës së SHBA-së, rruga “Asim Zeneli”, pranë Ambasadës së SHBA-së, rruga “Themistokli Gërmenji”, rruga “Gjergj Filipi”, rruga “Lekë Dukagjini”, pranë ish-Gardës së Republikës deri tek stadiumi, rruga “Faik Konica” dhe rruga “Skerdilajd Llagami”.

Parkimi i autobusëve me tifozë vendas që vijnë nga Korça dhe Elbasani, do të bëhet në parkingun e lokal “Kalvin”, ndërsa autoveturat te terminali pranë qytetit “Studenti”.

Parkimi i autobusëve që vijnë nga veriu dhe jugu, do të bëhet në parkimin “Terminali i përpunimit të automjeteve” pranë mbikalimit të Kamzës, ndërsa autoveturat tek parkingu pranë pallatit të sportit “Asllan Rusi”, në parkingun nëntokësor në sheshin “Skënderbej”, si dhe në parkingun nëntokësor në “Bulevardin e Ri”, te ish stacioni i trenit.

Në zbatim të planit të masave, punonjësit e Policisë së Shtetit do të ushtrojnë kontroll të imtësishëm ndaj tifozëve, para futjes në stadium, me qëllim parandalimin e futjes në stadium, të banderolave me përmbajtje raciste, të fishekzjarrëve, flakadanëve, lëndëve piroteknike, monedhave metalike, çadrave, çakmakëve, karikuesve të celularëve, mjeteve/produkteve për përdorim kozmetik dhe sendeve të tjera të forta. 

Gjithashtu, apelojmë për qytetarët që të mos ngrenë dronë në perimetrin e sigurisë (përreth stadiumit “Arena Kombëtare”), sepse do të rrëzohen, pasi Policia e Shtetit do të përdorë pajisje anti-dronë.

Me këtë rast, informojmë shtetasit shqiptarë dhe të huaj, se në bazë të Kodit Penal të Republikës së Shqipërisë, veprimet e dhunshme në aktivitetet sportive, si hyrja në fushën e lojës gjatë kohës së zhvillimit të aktivitetit sportiv nga persona të paautorizuar, përbën kundërvajtje penale dhe dënohet me gjobë nga 50 000 deri në 100 000 lekë. Kur nga kjo vepër, ka ardhur pengimi i zhvillimit normal të aktivitetit sportiv, dënohet me gjobë ose me burgim deri në tre muaj.

Hedhja e sendeve të forta në fushën e lojës ose mbi njerëzit, mbajtja apo përdorimi i lëndëve piroteknike, fishekzjarrëve, flakadanëve, gjatë zhvillimit të një aktiviteti sportiv, dënohen me burgim nga gjashtë muaj deri në tre vjet.

Legjislacioni penal shqiptar e konsideron vepër penale, goditjen apo çdo vepër tjetër dhune, ndaj sportistit, trajnerit, arbitrit, ndërmjetësit sportiv, për shkak të veprimtarisë sportive, dhe i dënon me burgim nga një deri në tre vjet. Kjo vepër, kur kryhet në ambiente sportive, më shumë se një herë, apo nga drejtues apo anëtarë të klubeve sportive, dënohet me burgim nga një deri në pesë vjet.

Each ticket is equipped with a barcode, is personal and must be kept only by the citizen who possesses it, who, in turn, will pass alone, to have their barcode checked by the device that automatically records any attempt to enter with a counterfeit or duplicate ticket.

 

We inform you that duplicating/multiplying a ticket is considered forgery and fraud, offenses that are punishable by the Criminal Code of the Republic of Albania.
