The Special Prosecutor's Office against Corruption and Organized Crime has revealed details about the latest action, against arms trafficking from Albania to the United Kingdom.

SPAK announces that it has started investigations for the citizen with the initials JK, under the charges of "Trafficking of weapons and ammunition", remaining in the attempt committed in the special form of cooperation, that of the structured criminal group, as well as "Structured criminal group".

From the acts administered for the interests of this criminal proceeding, it has been found that, on 10.04.2023, during the scanning process of the fugon type vehicle with English plates KS 15 MZN (which was driven by the citizen JK), anomalies were found, so it was concluded with the control his body near the checkpoint in the presence of the driver. From the physical control of the van, it was found that 8 pistol-type firearms, 4 pistol combs and 201 pieces of 9 mm cartridges were found hidden inside a woodworking table and were seized as material evidence.

Based on the significant amount of seized firearms and combat ammunition, with final destination the United Kingdom, referring to how the organizers of this trafficking acted to secure them and delete the serial numbers on 6 (six) of the weapons fire in order not to identify them, it has been estimated that these firearms would not be used for self-defense. The execution by the organizers of this traffic of the actions of hiding the seized items inside the woodworking facilities, in order not to be caught by a possible control of the police and customs structures, the use of false generalities, such as those who deliver orders to the transport company, as well as their UK hosts, and taking action to ensure safe delivery at destination, created reasonable suspicion that we were present before the commission of the criminal offense in the special form of cooperation, that of a structured criminal group .

Pas regjistrimit të procedimit penal janë kryer një sërë veprimesh hetimore, me qëllim mbledhjen e provave dhe identifikimin e autorëve të tjerë që kanë marrë pjesë në këtë aktivitet të paligjshëm kriminal. Më datë 15.06.2023 është bërë e mundur që të ndalohej shtetasi F.Gj, i cili ka patur rolin e ndihmësit në këtë aktivitet të paligjshëm kriminal, pra atë të transportuesit, i cili është marrë në cilësinë e të pandehurit F.Gj, për veprat penale “Trafikimi i armëve dhe i municionit”, mbetur në tentativë dhe kryer në formën e veçantë të bashkëpunimit, atë të grupit të strukturuar kriminal, të parashikuar nga nenet 278/a/1-22 dhe 28/4 të Kodit Penal, në lidhje me nenin 334/1 të Kodit Penal “Kryerja e veprave penale nga organizata kriminale ose grupi i strukturuar kriminal”, dhe “Grup i strukturuar kriminal”, të parashikuar nga neni 333/a/2 i Kodit Penal. Më datë 26.07.2024, janë përfunduar hetimet për procedimin penal me Nr. 60/2023, ndaj të pandehurit F. Gj., për akuzat e mësipërme dhe dosja (me përfundimin e afatit 10 ditor) do i dërgohet për shqyrtim gjyqtarit të seancës paraprake me kërkesën për gjykim ndaj tij.

Sa i përket drejtuesit të mjetit tip fugon me targa angleze KS 15 MZN, të hetuarit J. K., nuk është bërë e mundur që të mblidhen prova me anën e të cilave të vërtetohet fakti se ishte i implikuar që të kishte marrë pjesë, apo të kishte dijeni për episodin e datës 10.04.2023 e për rrjedhojë u vlerësua se ndodhemi përpara dispozitave të parashikuara në nenet 329/a, dhe 328/1 gërma “dh” të Kodit të Procedurës Penale, sipas së cilave për këto fakte penale, paralelisht me kërkesën për gjykim do i drejtohemi gjyqtarit të seancës paraprake me kërkesën për pushimin e hetimeve ndaj tij.

Gjithashtu, më datë 25.07.2024, është proceduar me ndarjen e akteve të procedimit penal Nr. 60 të vitit 2023, me qëllim identifikimin e bashkëpunëtorëve të të pandehurit F. Gj., numërtimin e tyre si procedimi penal me Nr. 60/1 i vitit 2024, dhe vijimin e hetimeve.

Nga tërësia e veprimeve hetimore të kryera për interesa të procedimit penal me Nr. 60/1 të vitit 2024, është bërë e mundur të identifikohen personat e tjerë të përfshirë në këtë aktivitet të paligjshëm kriminal, që janë marrë me organizimin, drejtimin dhe financimin e këtij grupi të strukturuar kriminal, i cili merrej me sigurimin e armëve të zjarrit dhe municionit luftarak, me qëllim trafikimin e tyre për në Mbretërinë e Bashkuar tek porositësit e këtyre armëve.

The role of the organizers of this traffic consisted in providing firearms (some of which with deleted identification numbers), finding a suitable environment and specialists in the field of carpentry in the outskirts of Tirana who would enable them to be hidden in interior of wood products (mainly tables), securing the persons who would move the "orders" to the transport company Albania-United Kingdom-Albania which was located in the city of Tirana, making available the means of transport and means of communication, as well as the respective rewards for each transport I carry out. The people involved in this illegal activity have provided false details of the deliverers of the products, and their host in the United Kingdom.

For the interests of this criminal proceeding, the Special Prosecutor's Office has requested the Special Court of First Instance for Corruption and Organized Crime, the determination of the measure of personal insurance, and the Court with its decision No. 91 The Act, dated 30.07.2024, decided to accept the request, assigning the coercive measure of personal security "arrest in prison" provided by Article 238 of the Code of Criminal Procedure for 6 (six) persons as suspects for committing the elements of the criminal offenses "Trafficking of weapons and ammunition", remaining in the attempt and committed in the special form of cooperation, that of the structured criminal group, provided by articles 278/a/1-22 and 28/4 of the Criminal Code, in relation to article 334/1 of the Criminal Code "Commitment of criminal offenses by a criminal organization or structured criminal group", and "Structured criminal group", provided for by article 333/ai of the Criminal Code.

On the part of the structures of the General Directorate of the State Police and the National Bureau of Investigation, on 01.08.2024, it became possible to execute the measure of personal insurance for the 3 (three) persons under investigation who lived and resided in Albania, more specifically for the citizens: AH, RA, and BT, as well as cooperating with foreign authorities for the execution of personal security measures for the other 3 (three) persons under investigation who have been declared wanted, as they live and reside outside Albania.

Thanks to the intensive and comprehensive investigations of this criminal proceeding, it has become possible for this structured criminal group to seize weapons and other material evidence as follows:

- As a result of the checks carried out in Albania, on 10.04.2023 in PKK Port Durrës, and 16.06.2023 in Tirana, the following items were seized:

- 6 (six) pistol-type firearms, "GLOCK" brand, with deleted numbers and inscription "Glock Austria 9 x 19".

- 1 (one) pistol-type firearm, "HERSTAL" brand, with number 1534 P.

- 1 (one) pistol-type firearm, "BROËNING" brand, with number 2205.

– 4 (four) black pistol combs

– 201 (two hundred and one) pieces of 9 mm caliber cartridges.

– 1,650 (one thousand six hundred and fifty) euros

– 31,700 (thirty one thousand seven hundred) ALL

– 8 (eight) mobile phones

– 1 (one) DVR camera, brand "HILOOCK",

– various documents

– 1 (one) Mercedes Benz Sprinter brand vehicle

Also, in accordance with the decisions of the Court, on 01.08.2024, control was exercised in some apartments, businesses, vehicles or personal control of persons where the following items were found and seized:

– 24 pistol firearms

– 1 Kalashnikov assault rifle

- different parts of firearms (needle, spring, bolt, barrel, etc.)

– 49 combs (chargers) of different types,

– 2 knives

– 409 cartridges of different calibers,

– 1 pair of handcuffs

– 10 special optical and laser devices

– 4 vehicles

– 1 engine

– 1 pair of military clothing

– 1 special forces helmet

– 4 mobile devices

– 2 laptops

– 1 central unit

- 290 euros

- 13,000 ALL

– Sim Vala card (Kosovar)

Investigations continue with the administration of evidence regarding the implication of other persons suspected of being involved in this illegal criminal activity.

These investigations were carried out in close cooperation with the British authorities of justice, the investigation structures of the Criminal Police Department of the State Police, as well as the investigators of the National Bureau of Investigation.
