The Special Prosecutor's Office against Corruption and Organized Crime has revealed the criminal activity of a criminal organization, which was based in the city of Elbasan and which was led by the brothers Franc Gergely (otherwise Franc Çopja) and Hajdar Bako (otherwise Hajdar Çopja).

In the framework of this criminal proceeding, the Special Prosecutor's Office against Corruption and Organized Crime, in intensive cooperation with Eurojust, Europol and the Dutch, Belgian and French law enforcement agencies, has conducted investigations regarding several Albanian citizens involved in criminal activities in Albania, such as and in several other countries in Europe. It has also been investigated in connection with some previous criminal events that occurred in Albania.

Investigations have proven that this criminal organization stands out for its particular degree of structuring, stability, duration, intent to commit certain criminal offenses and its financial strength.

It is suspected that the criminal activity of the two brothers dates back to the years 2006-2007, where they initially carried out the criminal activity in Italy by distributing small quantities of cocaine-type narcotics. Over the years, they became very empowered by the sale and trafficking of drugs, where from Italy they extended/expanded their criminal activity to other countries in Europe and beyond.

Also, over the years their economic potential increased and consequently their position in relation to other groups changed as they established contacts which then gave them the opportunity to establish direct links with important exponents of narcotics trafficking. .

In order to dominate the market and establish their hegemony over other groups, this criminal organization in 2018 began to eliminate opponents (through paid murders), who had an important role in drug trafficking in Europe and beyond.

The triple murder, where the citizen Endrit Alibej was killed on 29.12.2018, in the place called Bradashesh roundabout in Elbasan, is proven beyond reasonable doubt that it was committed by this criminal organization and that the purpose of this murder is related to the competition for possession of the cocaine market. The murder of the citizen Endrit Alibej (known exponent in cocaine trafficking) was followed by the ordering of the murders of several relatives of the citizen Endrit Alibej.

In relation to money laundering, from the data provided by the prosecution, it appears that this criminal organization has invested in Albania a part of the income derived from the criminal activity of international drug trafficking, mainly in the real estate market. (through the purchase of various properties such as apartments, villas, bars and restaurants and land), in the cities of Tirana, Elbasan and Durrës.

By conducting intensive investigations, interesting information was obtained regarding the assets, investments and assets of the two brothers in Albania, the forms used by them as well as the persons involved in the process of cleaning the proceeds of the criminal offense or criminal activity.

The use of the construction sector by criminal organizations is evidenced, where, through third parties, it has injected and invested significant amounts of cash for the realization of works on residential buildings in the construction process, as well as in the construction of residential buildings/complexes from the beginning.

It turns out that the criminal organization has invested in the hatching of economic operators as well as the use of existing economic operators active in Albania, which "de jure" were registered in the name of their social, friendly and cooperative ties, not exposing the "de facto" owners ” and their use as a camouflage/concealment of the true nature of the source and activity, in order to launder money derived from criminal activity.

Also, it is evident that the citizen FG (otherwise known as F. Ç.), on repeated occasions, has carried out the transfer of significant monetary values ??in cash through the use of foreign exchange offices (Exchange) inside and outside the country, sending them to his trusted persons with the purpose, among others, of paying for contract killings as well as making investments on their behalf in Albania and abroad.

During the intensive investigations carried out by BKH investigators, under the guidance of special prosecutors, it became possible to document the criminal activity of suspected persons, as well as to identify some of the perpetrators of criminal events and the commission of criminal offences, which were carried out in cooperation, in the form of a criminal organization, as follows:

The criminal fact "Murder in qualifying circumstances" to the detriment of the victims Endrit Alibej, Arben Dylgjeri and the Turkish citizen Erdal Duranay, event that happened on 29.12.2018, at 21:00, in the place called Bradashesh, Tirana - Elbasan road axis, near Dervishaj restaurant;

The criminal fact "The murder in qualifying circumstances of the citizen Klevin Baho and the wounding of his brother, the citizen Aldo (Aleksandër) Baho", event that happened on 07.2019, at 00:30, in the village of Broshke, Elbasan;

The criminal fact "Murder in qualifying circumstances to the detriment of the victims Andi Zylyfi and the wounding of the citizen Ardit Uruçi", event that occurred on 13.12.2019, in the village of Përparim, Peqin;

The criminal fact "murder of the citizen Klevis Kapllani", event that happened on 15.09.2020, in the village of Sinaballaj, Rrogozhinë;

The criminal case "Murder with premeditated intent remaining in the attempt", to the detriment of the citizen Kei Piku, event that happened on 16.01.2020, in the neighborhood "Kongresi i Elbasan", in Elbasan;

The criminal fact "Premeditated murder remaining in the attempt", to the detriment of the citizen Irfan Azizi, event that happened on 11.2020, in the place called Poshnje roundabout in Uran Vajgurore, Berat.

Criminal Fact "Theft with a weapon remaining in the attempt, to the detriment of the citizen Minella Muçi and the Murder of the Employee of the State Police, remaining in the attempt, an event that occurred on 23.03.2018, in the 28 November district, in Fier;

Criminal Fact "Theft at gunpoint of monetary values" that were to be transported on the Tirana-Vienna flight, event that occurred on 04/09/2019, on the runway of the "Mother Teresa" airport, Rinas, Tirana.

Also, this criminal organization has also carried out active actions by providing the conditions and material means in order to commit the murder of several citizens, specifically:

10. Criminal Fact "Providing the conditions and material means to commit murder", to the detriment of the citizen Erion Alibej, an event planned to be carried out after the quarantine period in 2020;

11. Criminal Fact "Providing the conditions and material means to commit murder", to the detriment of the citizen Erion Alibej, event planned to be carried out in September 2020;

12. Criminal Fact "Providing the conditions and material means to commit murder", to the detriment of the citizen Erion Alibej, an event planned to be carried out in the period July - November 2020;

13. Criminal fact "Providing the conditions and material means to commit murder, to the detriment of the citizen Nuredin Dumani, an event planned to be carried out in the period July - October 2020;

14. Criminal Fact "Providing the conditions and material means to commit murder, to the detriment of the citizen Nuredin Dumani, an event planned to be carried out in the time period October - November 2020;

15. Criminal Fact "Providing the conditions and material means to commit murder, to the detriment of citizen A., an event planned to be carried out in September 2020;

16. Criminal Fact "Providing the conditions and material means to commit murder, to the detriment of citizen S., an event planned to be carried out in the period December 2019 - January 2020;

17. Criminal Fact "Providing the conditions and material means to commit murder, to the detriment of citizen S., an event planned to be carried out in the time period November 2020 - January 2021;

18. Criminal Fact "Providing the conditions and material means to commit murder, to the detriment of citizen S., an event planned to be carried out in the time period January 2020 - January 2021;

19. Criminal Fact "Providing the conditions and material means to commit murder, to the detriment of citizen C., an event planned to be carried out in the time period January 2020 - November 2020;

20. Criminal Fact "Providing the conditions and material means to commit murder, to the detriment of citizen Ç., an event planned to be carried out in the months of July - November of 2020;

21. Criminal fact "Providing the conditions and material means to commit murder, to the detriment of the citizen Aldo Baho, an event planned to be carried out in the months of May - August 2020;

22. Criminal fact "Providing the conditions and material means to commit murder, to the detriment of citizen B., an event planned to be carried out in the months of July - August 2020.

23. There have been evidenced and documented cases of supporting the perpetrator of the crime, actions that prevent the discovery of the truth and not reporting the crime.

24. In addition, the recruitment of two state police officers to carry out actions contrary to duty on behalf of the criminal organization has been documented.

25. The criminal fact of "Passive corruption of judges, prosecutors and other functionaries of the justice bodies, event that happened during 2020 in Elbasan and "Active corruption of judges, prosecutors and other functionaries of the justice bodies" was also recorded.

26. The investigations have also revealed the criminal fact of "Disclosure of secret acts or data", by an employee of the judicial administration of the Court of First Instance of the General Jurisdiction Elbasan, committed during the time period September - October 2020, in Elbasan.

Based on the request of the Special Prosecution against Corruption and Organized Crime, the Special Court of First Instance for Corruption and Organized Crime with decision no. 86, dated 29.07.2024, has decided to assign personal security measures to 33 citizens. The General Directorate of the State Police executed on 31.07.2024 the security measures assigned to 13 citizens, while 2 other citizens are arrested outside Albania.

Pursuant to the Court's decision, control was exercised in 8 different premises, at the end of which it was possible to seize a large amount of cash, in various currencies and Lek in a total amount of over 1,000,000 (one million). Euros as well as other material evidence of interest for further investigation.

Also, pursuant to court decision no. 467, dated 29.07.2024, with the object "Imposition of preventive sequestration", 42 (forty-two) properties were seized, among which 38 immovable properties, such as apartments, villas, arable land, buildings under construction of 4 (four) floors and four bank accounts.
