Election of the Deputy Speaker of the Assembly / Srpska Lista files an appeal

On October 16, the Serb List again filed a complaint with the Constitutional Court of Kosovo regarding the election of the Deputy Speaker of the Assembly from among the Serb community, claiming that the Constitution, the Rules of Procedure of the Assembly, as well as a previous judgment of the Constitutional Court, were violated.

"We have also requested the imposition of a temporary measure to stop unconstitutional actions that could cause irreversible damage ," said the announcement of the Serbian List, the main party of Kosovo Serbs that enjoys the support of Belgrade.

The new Kosovo Assembly was constituted on October 10, with the election of Nenad Rashic as deputy speaker from the Serbian community. His election came after the nine deputies of the Serbian List, despite being voted on three times, failed to receive the necessary votes.

The Constitutional Court had addressed the complaint previously submitted by the Serbian List regarding the issue of deputy speakers, after the Speaker of the Assembly, Dimal Basha, had declared the Assembly constituted without the election of a fifth deputy speaker from the ranks of the Serb community.

The Court then found that the Assembly was not constituted, requiring the deputies to elect the deputy speaker from among the Serb community, in order to pave the way for the formation of the government.

The Constitutional Court's decision stated that the proposal for the vice-president from among the non-majority communities, in this case the Serbian minority, must be made by the majority or the largest number of deputies from among the deputies of the Serbian community.

After the Serb List MPs did not receive the required number of votes, the Speaker of the Assembly, Dimal Basha, requested that the election of the Serbian deputy speaker proceed through a draw, allowing the other Serb MP, Nenad Rashic from the For Freedom, Justice and Survival party, to be elected as the deputy speaker. Rashic had been a minister in Albin Kurti's government, leading the Department for Communities and Returns.

The Serbian List says that Rasic's election is "illegitimate" and warns that the elections will lose their meaning if the majority of Albanian MPs impose representatives on Serbs, thus legalizing "the violence of the majority against the minority."

A day after Rashic's election, Kosovo President Vjosa Osmani mandated the leader of the Vetëvendosje Movement, Albin Kurti, to form a new government. According to the Constitution, Kurti has 15 days to present the composition and program of the new government to the Assembly.

The election of the Government requires 61 votes of MPs and Kurti has said that in the coming days he will hold discussions with the parties about a governing coalition. LVV won 48 seats in the 120-MP Parliament in the February 9 elections.

If Kurti fails to secure the necessary 61 votes by October 26, then Osmani, according to the laws, is obliged to invite the political parties to a consultation once again within 10 days, and to decide, at her discretion, on the new candidate, if she proves to her that she has the numbers to form the Government.

The next prime minister must also have 15 days to present the composition of the government cabinet to the Assembly. If the government is not formed even after 40 days, President Osmani must announce new elections. /REL
