Proposal to ban social media in Germany faces legal hurdles

A proposed ban on social media for children in Germany is facing major legal hurdles, according to a Bundestag research report.

The scientific service of the German lower house of parliament found obstacles, mainly in EU law, and warned that the constitutional right of parents to raise their children could also present "a further obstacle".

According to DW, the report noted that the debates in Germany mirror discussions in other countries about restricting young people's access to social platforms.

States, including Lower Saxony and Thuringia, have proposed banning use for those under 14 and restricting access to "age-appropriate versions" for those under 16.

However, the report noted existing EU rules under the Digital Services Act, which take precedence over national law. The report also mentions the country of origin principle, which means restrictions by individual states would have little effect as major platforms such as Meta, Google, X and TikTok are based in Ireland.

The Left Party said the findings supported its skepticism, arguing that the bans would not solve fundamental problems, would restrict the rights of young people and are difficult to enforce both technically and legally.

Instead, she called for stronger enforcement of existing rules and greater investment in media education. /CNA
