Constitutional Court: The Assembly must elect the new leader through open voting

The Constitutional Court of Kosovo said that the deputies of the Assembly of Kosovo must elect the new head of the legislative body through open voting. The constitution of the Assembly must be concluded within 30 days.

In the judgment announced on August 8, the Constitutional Court said that the presiding judge of the session, Avni Dehari, did not act on the basis of this court's previous judgment of June 26, adding that all sessions held from June 27 to July 26 "are declared invalid."

The Constitutional Court of Kosovo has ordered the chair of the constitutive session of the Assembly of the Republic of Kosovo to proceed with item 3 of the agenda of the constitutive session, approved on 8 April 2025, and to "invite the representative of the largest parliamentary group to propose the candidate for President of the Assembly of the Republic of Kosovo, who is elected through open voting, the voting of which can only be carried out up to three times for the same candidate".

It has also ordered that during the procedure for electing the President and Vice-Presidents of the Assembly of the Republic of Kosovo, all elected deputies must be present and vote.

The deputies who emerged from the February 9 elections had ignored a decision of the Constitutional Court, which gave them until June 26 to constitute the legislative body. After that, the Court imposed a temporary measure, pending the review of the cases sent by the Democratic Party of Kosovo and the Democratic League of Kosovo, cases for which it announced the ruling on Friday, August 8./ REL
