Court of the EU: Victims of domestic violence qualify for refugee status

Women victims of domestic violence, in their countries of origin, are qualified for refugee status, or for similar protection, the European Court of Justice confirmed on Tuesday.

The decision guarantees international protection to women who are subject to "physical or mental violence" in their homeland, as well as to those who face a "real risk of murder".

The court's decision has been made public, following questions from a Bulgarian court about the case of a Turkish woman of Kurdish origin.

The Muslim woman, who has applied for international protection in Bulgaria, has said that she is afraid for her life if she returns to Turkey.

She said that she was forced to marry by her family and was beaten and threatened by her husband, from whom she later divorced.

Women qualify for refugee status when in their homeland, due to their gender, "they are exposed to physical or mental violence, including sexual violence and domestic violence", the court decision said.

If they do not qualify for refugee status, women can benefit from another type of protection, which allows asylum seekers to remain in the country where they applied, but cannot travel to any other country in the European Union./ REL
