Denunciation-Arben The opponent of the Magistrate is caught in violation, the
Arben Rakipi

Arben Rakipi runs the Magistrate's school in violation of the law, in open conflict of interest and even in terms of abuse of office, taking into account his private activity or that of his family members.

The School of Magistrates operates according to Law No. 115 of 2016, which in Article 250 point 3 provides that the head of the School cannot hold any other public function, political engagement or have a profitable activity, with the exception of teaching.

While in office, the Director of the School of Magistrates enjoys the salary and benefits of a judge of the Supreme Court. The function of the Director of the School of Magistracy is incompatible with any other public function, membership in political parties or participation in their activities, or performing any other profitable activity, with the exception of teaching and activities of a scientific nature.

According to this article, Arben Rakipi is categorically forbidden to own a private company, or to have benefits from any company. This is even reinforced by the "Regulation for the prevention of conflict of interests, as well as the declaration of assets in the exercise of public functions in the School of Magistrates", a document which is published by the official website of the School of Magistrates and ironically bears the signature of Arben Rakipit.

In Article 21, especially for "Restriction of private interests for the prevention of conflict of interest on a case-by-case basis for special issues", point a, provides:

The director of the School of Magistracy cannot carry out any profitable activity, with the exception of teaching and activities of a scientific nature.

In the Plug in Syri TV show, it has been revealed that Arben Rakipi has committed an offense where, in conflict of interest, he exercises his profession contrary to the law in his private entity.

From the data collected at the National Business Center, it appears that Arben Rakipi was registered as a Natural Person with NIPT K71813004C, from 2006 until September 2020 when he was deregistered.

On June 25, 2020, Arben Rakipi, Jon Rakipi, Ermir Beta and Romina Zano (Lleshi) founded the company Zyra Ligjore Rakipi & Partners. Jon Rakipi (son of Arben Rakipi) is represented by proxy by his mother Vilma Rakipi as he is a Dutch citizen, resident in the Netherlands and works there full time.

From the establishment Arben Rakipi will own 55% of the shares, Jon Rakipi will own 10% of the Shares, Ermir Beta will own 20% of the shares and Romina Zano 15% of the shares.

The Rakipi & Partners Law Office is registered with the CKB in July 2020, when it officially starts

So, as it results from these documents, Arben Rakipi, even though he was in command in the function of the Director of the School of Magistrates, continued to exercise the private activity of the Lawyer and 3 days before the competition for this position was opened, he founded another company, which was registered at the KKB in July 2020, this period when Arben Rakipi would apply to be elected as Head of the School of Magistracy. So according to the law on the School of Magistrates and its regulation, open violation and placement in the conditions of conflict of interest. It is now up to the law enforcement bodies to perform a complete verification of the application file, and whether this activity was declared in it.

The fact remains that Arben Rakipi, during the exercise of his duties as the director of the School of Magistracy, knew very well that the law prohibited him from owning shares in commercial companies, and with full awareness he not only practiced the profession of lawyer privately but also founded a new commercial company .

It doesn't end here! Only 20 days after the establishment of the company, on July 28, 2020, Arben Rakipi was elected Director of the School of Magistracy for a 4-year term with the right to reappointment. As we explained above, the law and regulations clearly define that the Director of the School of Magistracy and their family members cannot exercise private activity./ CNA
