Buys a car, gets a fine in Maliq without ever being there

Fejzi Shkemza, who lives in Shkodër, says that he bought a vehicle in Korçë, but they are not letting him enjoy it. He bought the car in October with a contract and changed ownership in November 2023. Fejziu says that in January 2024 he will receive a fine, which he received in Maliq, but he has never been in Maliq.

Fejzi Shkemza, the whistleblower: I first contacted the person of the car that I saw on the Internet, I went directly to Korça. I negotiated with the person for the price and everything and I bought the car. I paid the money and went to DPSHTRR Korçë, there I did all the documentation and everything was in order. I bought the car on October 20 in Korça.

The fine charged in January 2024 has the value of 300 thousand old lek and was accompanied by the removal of 3 points on the license. It bears the date July 10, 2023, the date when Fejzi Shkemza did not have that car and was in Shkodër. Fejziu addressed the Korça Police, where they confirmed that the fine was received in July 2023, but without giving him a solution to remove the punishment from his name.

Complainant: The fine that appeared on the computer was received in Maliq of Korça on July 10, 2023 at 4:50 p.m. I was at home, in Shkodër, the car was not mine. The car came into my possession on November 2nd. They told me that you should contact the Regional Directorate of Korça to make a written request. I made the request in writing, waited a month and received an answer. It said that the fine was received on July 10, 2023. I agree that a fine may have been received, it's not that a fine was not received, but the car was not in my ownership. Then they returned the first answer, I waited a few days, they told me to make a second one. It may be two and a half months since the second request and I still haven't heard back. Then I was forced when there was no solution from the state, I came to Stop.

Stop secured the contract of sale and purchase of the car on October 18, 2023, after which the new traffic permit was produced in November 2023. Expert Artur Sulçe, analyzing the case, says that in addition to not respecting the Highway Code, the possibility of ½ of the amount was paid, it is not allowed, since the fine was thrown out of time. This fine, says Sulçe, should be paid in the name of the old owner of the car.

Artur Sulçe, expert: Late disposal also loses the right of the person who has been fined, the user of this vehicle, to apply the rules of the Highway Code, that if you pay within 15 days, you pay half of that penalty for the violation that you have done. There is no reason to give this kind of penalty to the other owner. It could be in the system all as it was being put in after 6 months and put to the old owner.
