On May 23, 2018, the Municipality of Kamëz signed the contract 'For the concession of the cleaning, collection, transportation and selection of urban waste service for the city of Kamëz', with the entity Alko Impex General Construction. The concession had a 12-year term with a value of 13.5 million euros without VAT.
According to this concession contract, this entity undertook the cleaning, collection, transportation of waste to the Sharra landfill, as well as the payment of 29 euros/ton after VAT. Alco Impex also undertook the construction of a transfer station and installation of the waste differentiation plant.
The service of cleaning, collection and selection of urban waste through the waste differentiation plant will be developed in the city of Kamza, with the following characteristics:
- Collection and transportation of urban waste and markets;
- Washing and disinfection of containers;
- Maintenance of waste collection sites during the day;
- Sweeping of streets and sidewalks with wings;
- Sweeping roads with machines;
- Washing the streets once a day;
- Construction of the transfer station and installation of the waste differentiation plant;
- Transportation and storage of waste in the respective places approved by the relevant authorities.
The station, together with the plant, should be completed within 6 months from the date of entry into force of the contract.
The concessionaire undertakes to implement the following work schedule:
The concessionaire undertakes to put the waste sorting transfer station into operation within 6 months from the date of entry into force of this contract.
The Concessionaire undertakes to start immediately from the next day at 00:01, the performance of the cleaning service, collection and deposit of waste according to the items defined in Annex 2 of this contract.
The deadline for performing the cleaning, collection, transportation and waste disposal service is 365 days a year times 12 years from the date of conclusion of the contract.
But did you implement this contract?
In 2019, in the local elections, Rakip Suli became the head of the Kamëz Municipality, after an unopposed race. Rakip Suli as the holder of the Contracting Authority had the task of monitoring the implementation of this concession contract.
On November 17, 2020, Top Channel, then under the direction of Ben Blush, and in coordination with the company Integrated Energy BV SPV published an investigation on the show INSIDE STORY.
Asked by journalists, Rakip Suli would say that:
So, Rakip Suli, in November 2020, declares that the Alko Impex company had not implemented the terms of the concession contract, as it had not built either the transfer point or the processing plant.
Asked by the I Top Channel journalist, Suli stated that the Kamëz Municipality produces about 80 tons of waste per day and that he did not know whether or not this company had paid the waste deposit fee of 29 euros at the Sharra landfill.
The Plug show addressed several requests for information to the Kamez Municipality.
The investigative show PLUG is analyzing data on waste and its cost for the budgets of Tirana District Municipalities.
According to the data collected until today, it appears that the Kamëz Municipality has concluded a concessionary contract for the cleaning, collection of waste, and then the transfer and deposit of waste in the Lanfill of Sharra.
The Concessionary Contract was concluded with the company Alko Impex shpk. The contract stipulates that the Alko Imex company should make the investment for a collection point within 6 months and should pay the GATE FEE for each ton of waste in the Sharra Landfill.
For the above, please provide us with the following information/documentation:
1- The documentation submitted by the company for the completion of the investment for the collection point;
2- The annual amount of waste deposited in Sawmill for the account of this concession contract;
3- Payments made by the Concessionaire on behalf of the company INTEGRATED ENERGY BV SPV;
4- Annual reconciliations of Kamez Municipality with the concessionaire for waste disposal and investment value;
5- JPZP relations for this concessionary contract;
6- Have there been established violations of the contract and imposed penalties;
7- The payments made to the concessionaire by the Municipality of Kamëz and have they been received in full by the day of sending this request;
After initially refusing to make the requested information available to us, Kamez Municipality informs us in an email dated April 15, 2020 that the concession contract was unexpectedly terminated at the request of the concessionaire himself.
We would like to inform you that Kamëz Municipality has concluded the Concession contract dated 23.05.2018 "For the concession/PPP of the service of cleaning, collection, transportation and selection of waste of Kamëz Municipality". The Concessionary Contract has been unilaterally terminated, by the Concessionaire and by the Kamëz Municipality, penalties have been applied according to the contract, keeping the value of the unrealized investment and the insurance of the contract.

On the 7th and 8th of May, the Municipality of Kamëz returns two responses one after the other to the Plug show, where it clarifies the situation. In the email dated May 7, the municipality of Kamëz says that the responsibility for the payment of the waste deposit in the Sharra landfill was the Concessionaire company.
In the Concession Contract dated 23.05.2018 "For the concession/PPP of the service of cleaning, collection, transportation and selection of waste of the Municipality of Kamez", the Concessionaire has also taken over the cost of disposal in a landfill licensed by the relevant authority. The municipality of Kamëz has not paid for the cost of landfilling as this cost has been taken over by the concessionaire.
A day later, on May 8, the Kamëz Municipality resends additional information, along with the contract, some invoices and the fines that, according to it, have been applied to the concessionaire company for non-fulfillment of the contract.
The Concession Contract was unilaterally terminated by the Concessionaire and the Kamez Municipality applied penalties, keeping the value of the unrealized investment 34,897,104 ALL and the insurance of the contract worth 135,000,000 ALL. So, in total, Kamëz Municipality has kept the following penalties:
1. Penalty for not building the station in the amount of ALL 12,791,417
2. Penalty for the implementation of the contract 5,409,988 ALL
3. The value of the unfinished investment is ALL 34,897,104
4. Contract insurance 135,000,000 ALL
In total, 188,098,509 ALL were kept
In this email, the Kamez municipality also admits that the construction of the urban waste station has not been built, calling this a breach of contractual obligations.
The company has not built the urban waste transfer station. According to Article 10 of the contract, the waste transfer station had to be built within 6 months from the signing of the Contract, that is, the contract was signed on 23.05.2018 and the waste transfer station had to be built by 01.12.2018. During that period, Kamëz municipality did not close the contract but continued its implementation, not applying any penalty or other measure. The matter has gone to court proceedings between the company and the Regional Environmental Agency for not having an Environmental Permit for the construction of the station. The date of the Decision of the Court of First Instance is 26.03.2019, and this case has passed to the Court of Appeal on 12.04.2019, before WE came to the Municipality of Kamëz. After August 2019, the company was penalized every month according to the provisions of the contract for not building the waste transfer and selection station, keeping the value even for the period before 2019, which was not kept, the penalties in the amount of ALL 12,791,417 were kept until the date of termination of the contract. Due to the fact that the contract was unilaterally closed by the Concessionaire, Kamez Municipality kept the value of the unrealized investment in the amount of ALL 34,897,104.
Although it was the concessionaire who had not fulfilled the main obligation for the establishment of the transfer station and the installation of the waste differentiation plant, the Kamëz Municipality had not taken any action, as stipulated in Article 12 of the concession contract.
Article 12
Termination of the Concession/PPP Contract
12.1. Unilateral termination of the contract by the Contracting Authority.
The Contracting Authority has the right to terminate the contract:
12.1.1. When the concessionaire does not put into operation the transfer station for the selection of waste according to point 10.1 of this contract. In this case, the Contracting Authority has the right to receive the value of the Contract Insurance provided for in Article 14.
On the contrary, it was the concessionaire himself who withdraws from the contract. The sole reason for this breach of contract action was for the subject to escape criminal investigation by simply paying the Contract Insurance.
But according to the concession contract, the Contracting Authority is obliged to monitor the concession through the Project Implementation Unit.
In its article 6.2, the contract stipulates that:
6.2. General supervision of the service
The Contracting Authority has the right to exercise continuous general supervision during the realization and commissioning [...]
In case of violations of the Contract, found during monitoring and general supervision, the Concessionaire will be notified in writing about the measures that will be taken and the tasks that will be left to him, as well as the manner and terms of their implementation. For the realization of the general supervision of the service (NJZP), the holder of the Contracting Authority will authorize a group [...]. NJZP maintains minutes and monthly situations [...].
The obligations for which the Mayor Rakip Suli would have to supervise the contract are defined in Article 8.
Article 8
Obligations of the Concessionaire
8.1. The Concessionaire is obliged to implement the Project and the object of the Contract in accordance with its terms and conditions.
8.4. To realize the anticipated investments according to the defined deadlines and with the quality required in the Contract;
8.10. To keep the Contracting Authority informed of any circumstances that may have an impact on the progress of the project;
8.15. The concessionaire is obliged to pay 10% of the local taxes related to the construction of the transfer station;
8.17. The concessionaire will assume the cost of the disposal of urban or inert waste;
So, contrary to what is stated in the interview given for the show INSIDE STORY, that he could not intervene in a relationship between Alko Impex and the Incinerator Company of Tirana, Rakip Suli would have to verify whether the concessionaire has fulfilled one of the main obligations , that of the waste deposit payment.
Although informed by journalists, Suli did not do any verification even though the Alko Impex company was also paid for waste disposal by the Kamëz Municipality.
The Mayor of Kamëz, in flagrant violation of the contract, has continued to pay the company Alko Impex about 1.2 million euros per year.
At the end of 2023, Rakip Suli, sued for a series of violations in the direction of the Kamez Municipality, would say to the journalists at the exit of SPAK that he willingly went to the prosecution body. Desire that he lacked when he had to fulfill his obligations to the citizens, first breaking the contract for flagrant violation. What prompted Rakip Suli to go with his own feet towards criminal prosecution instead of Alco Impex, this must be clarified by justice, but in the future PLUG sheds some more light.
It seems that Rakip Suli's desire to go to SPAK has a reason, since his colleague from the municipality of Tirana, Erion Veliaj, had taken it upon himself to do charity with the taxes and budget of the capital's municipality for the chamza garbage.
But the violations of the Kamez Municipality in this affair are only the tip of the iceberg.
You have often heard the Mayor of Tirana, Erion Veliaj, say in the television studio that he is simply one of the customers of the Incinerator of Tirana.
The facts that we will present today prove for the umpteenth time that these statements are a FRAUD.
The concession contract between the Kamez Municipality and the Alko Impex company entered into force in May 2018, from that date this company would have to deposit the waste and pay a fee of 29 euros per ton at the sawmill landfill.
The Plug show today will exclusively publish the electronic communications between the Municipality of Tirana, Klodian Zoto and the employees of the Incinerator.
On March 29, 2019, Namik Simixhiu sent an email to citizen Denisa Tollkuçi after the Alko Impex company vehicle was blocked at the entrance gate of the incinerator and was not allowed to unload the waste.
2 hours later, Tollkuçi wrote to Klodian Zoto about this issue:

The vehicle below belongs to Alko Impex and has been requested by the Municipality to be allowed to enter Sharre. This is the vehicle that was caught with Kamze's remains and it was decided that it would not be allowed to enter again. I am asking for an answer on how it will be done so that I can give you and the Municipality an answer.

About an hour later comes Klodian Zoto's answer:

The Municipality of Tirana was informed in March 2019 that the Alko Impex company deposited the waste of the Municipality of Kamëz as waste of the Municipality of Tirana and therefore that amount was billed and paid by the latter.
Erion Veliaj knew in 2019 that the citizens of Tirana also paid for Kamza's remains.
Although notified by the concessionaire, the Municipality does not take any measures. Alko Impex continues to have in force both the Kamza concession contract and the contract with the Tirana Municipality for its cleaning.

Under pressure, after the affair became public, Erion Veliaj forces Taulant Tusha to turn to the concessionaire as there could be criminal consequences.
On 25.11.2020, Taulant Tusha addressed an official letter to the company Integrated Energy BV SPV and for the information of the company Alko Impex.

The municipality of Tirana, in the context of fulfilling its obligations regarding the disposal of urban waste in the Sharra landfill, finds that the trend of deposits in this facility by the means of the Operator "Alko Impex General Construction" significantly exceeds the forecasts and expectations regarding the territory where this operator exercises its activity, referring to the Contract that the Municipality of Tirana has with this Operator.
This trend should not exceed the daily figures of deposits of 165 tons/day, calculated in function of the obligations that this operator has in relation to the Contract as well as the extension to the territory provided for in the contract.
As above, we inform you that any excess of the figures here above, from the tools working on behalf of the Alko Impex Operator, should not be billed to the Municipality of Tirana and will be covered directly by the operator or by you.

So the letter sent by the General Director of Public Works Taulant Tusha was not being implemented as Klodian Zoto would have to discuss the Alko Impex company's deposits with HIGHER LEVELS in the Municipality of Tirana.
Referring to the organizational chart of the Municipality of Tirana, the General Director of Public Works is directly subordinate to the Mayor Erion Veliaj, so according to Elton Bualli's email, the decision-making for the deposits of the Alko Impex company would come after the approval of Erion Veliaj.
So far, according to the documentation and emails that we made public, it is proven that Erion Veliaj was fully aware that the company Alko Impex did not pay for the waste disposal of the Kamez Municipality and provided false information on the deposit slips, invoicing all of them on account of Tirana Municipality.
Informed since March 2019, the actual owner of the incinerator did not take any action to stop this illegality, which continued for the years 2021, 2022, 2023.
According to Rakip Suli's public statements, the Kamëz Municipality generates about 80 tons per day.
This information is also confirmed by the GENERAL LOCAL PLAN OF THE MUNICIPALITY OF KAM?Z. On its page 115 it is stated that:
Kamez Municipality has determined a generation rate of 0.8 kg/inhabitants/day. Based on this indicator, the municipality has estimated that 80-108 tons/day or 39,438 tons/year of urban waste are generated on a daily basis.
Based on these data, the Alko Impex company has deposited 39,000 tons of waste per year or 195,000 tons for the period 2019-2023 in the sawmill landfill.
The financial invoice for this amount is 5,655,000 euros without VAT. And this staggering bill has been covered by Tirana Municipality funds.
The PLUG show addressed a request for information to the Alko Impex company, but to date has not received any response.
Even though Erion Veliaj seeks to justify himself by claiming that he is only one of the clients of the Tirana Incinerator, the many facts published by the Plug show prove the opposite.
As we stated earlier that it is Erion Veliaj who determines that each tower of Tirana must pay for the waste; is the one that blocks the malfunctioning of the JPZP in order for the state structures not to control the implementation of the concession contract; today we found out that it is Erion Veliaj who decided that over 6 million euros of Tirana's taxpayers will go in favor of Alko Impex, even though this company performed the works on behalf of the Kamëz Municipality.
SPAK will have to investigate the financial abuse of Erion Veliajt with the budget of the municipality of Tirana, show whose pockets the 6 million euros went to, and what is most important, explain why in every decision-making related to the payments to the incinerator of Tirana the name and direct involvement of Erion Veliaj comes out./ PLUG
