They extorted millions of euros with 5D/ How Qato and Molla hid their assets,

Other facts and details of the fraud of Mariglen Qatos and Redi Molla this time before the ILDKPI.

In the investigation file provided by CNA , it is emphasized that Redi Molla has hidden private interests and conflict of interests in relation to the company "5D Construction", hiding the wealth.

"Specifically, it turns out that the citizen Redi Molla for the period from 24.02.2016 to 16.10.2020 exercised the function of the General Director of the company "Ujësjellës Kanalizime Tirana" sh.a. and from 22.10.2020 to 06.09.2023 he exercised the function of the General Director of the company "Tirana DC" sh.a, a joint-stock company which, according to the extract from the commercial register, was established on 28.10.2020, registered in the CKB on 03.11.2020, with the object of the activity "Design, construction, reconstruction, implementation, approval of constructions of all types, including here, but not limited to residential constructions, reconstruction of social, cultural, industrial public buildings when the case is, as well as other commercial constructions.

Making investments by mobilizing state and/or private domestic or foreign capital, Realization of construction, maintenance, reconstruction, reconstruction and insurance of existing and new public buildings and facilities, when the case is...etc. with shareholder Tirana Municipality, which owns 100% of the shares of this entity.

Due to the above two functions, the citizen Redi Molla has been subject to a declaration and has made the declaration of wealth from 2016 to 2023. The citizen Redi Molla has submitted to II.DKPI the declarations of wealth as follows:

1. Declaration of private interests before starting the task, dated 29.03.2016: 2. Periodic/annual declaration of private interests 2016, dated 31.03.2017; 3. Periodic/annual declaration of private interests 2017, dated 31.03.2018: 4. Periodic/annual declaration of private interests 2018, dated 31.03.2019: 5. Periodic/annual declaration of private interests 2019, dated 31.05.2020; 6. 2020 periodical/annual statement of private interests, dated 31.03.2021; 7. Periodic/annual statement of private interests 2021, dated 31.03.2022; 8. Declaration of private interests periodical/annual 2022, dated 28.03.2023,

From the content of the asset declarations as above, it results that the citizen Redi Molla has concealed the fact that he indirectly owns the company "5D Konstruksion" sh.pk and has concealed his private interests and conflict of interests in connection with this commercial company, creating in this way reasonable suspicion, based on evidence, on the concealment of these declarable data, in each of the asset declarations as above", the file states.

Furthermore, SPAK has discovered that Mariglen Qato, the director of Veliaj in the Municipality of Tirana, has committed the same fraud.

"Citizen Mariglen Qato for the period from 16.03.2016 to 24.09.2018 exercised the function of the Director of the Support Department in the company "Tirana Water and Sewerage" sh.a. and from 25.09.2018 to 04.09.2023 he exercised the function of the Chief Inspector of the Territory Protection Inspectorate in Tirana Municipality. In the following, it results that from 06.09.2023 onwards citizen Mariglen Qato exercises the function of the administrator of the company "Tirana DC" sh.a, a joint stock company 100% owned by the Municipality of Tirana. Due to this function, the citizen Mariglen Qato is subject to the declaration of assets and has filed with the LLDKPI the declaration of private interests before starting the task, submitted on 05.10.2023.

In this declaration of assets, the citizen Mariglen Qato has hidden the fact that he indirectly owns the company "SD Konstruksion" sh.pk, he has hidden his private interests and the conflict of interests in relation to this commercial company, thereby creating reasonable suspicion based on these evidences administered, on his false declaration, through the concealment and non-declaration of declarable assets and property interests.

The circumstances described above result from the entirety of the acts and evidence received up to this stage of the investigation, together with their copies, of the request subject to review submitted by the Special Prosecutor's Office, administered in eighty-six volumes. Based on the above facts, the Special Prosecutor's Office against Corruption and Organized Crime has presented the criminal request subject to review, requesting the assignment of personal security measures to the persons under investigation, as reflected in the introductory part of this decision, it is further stated in the file .

In this investigative file, it is clearly stated that the two actual owners of the 5D construction company are Mariglen Qato and Redi Molla./ CNA
