Strasbourg condemns Albania/ The Constitutional Law violates human rights

The changes in the law on the functioning of the Constitutional Court within the framework of the judicial reform violate the principle of legal certainty and the right of citizens to turn to this court.

This is the decision given by the Human Rights Court in Strasbourg, to which an Albanian citizen appealed after in 2017, the Constitutional Court had rejected the appeal of a civil process that had started in 2014 on the grounds that they had past the deadlines, reports Euronews.

Strasbourg notes that the citizen's right of access to the Constitutional Court was violated and that the law did not clearly provide in any of its provisions how this term was calculated.

In the abbreviated decision, the Strasbourg Court says that the law adopted in 2016 created ambiguities in the calculation of deadlines and suggests a new interpretation by the Constitutional Court to clarify these ambiguities.

According to Strasbourg, with the decision to reject the appeal, the Constitutional Court has violated the first point of the sixth article of the Convention on Human Rights, which deals with the right of citizens to access to courts and to a fair judicial process. /CNA.al
