Alfred Balla, the shadow minister of Renaissance at the head of the High Council of Prosecution, managed to challenge even the observers of the International Monitoring Operation.

We are talking about the vetting process, which Balla achieved with a series of maneuvers so that he would not be subjected to it, using back-and-forth e-mails, failure to appear in sessions, lawsuits in the Administrative Court or even requests in the Supreme Council of The judiciary.

Exactly, this was done by the head of the High Council of Prosecution, who, although he leads one of the main institutions in terms of the field of investigation, avoided transparency and did not go through the sieve of declaring wealth, purity of image and professional skills.

Although he holds a key position in the field of justice, his wealth, how he secured it, and how professionally he performed his work are still unknown.

But some questions also arise: Why is Balla afraid to undergo this process? What is he afraid of? At the moment he may even feel "relaxed", as he is part of the Renaissance den, but if he continues to hold leadership positions, at some point he will have to declare his wealth. 

Let's go back to the Observers of the International Monitoring Operation.

The head of the High Prosecution Council was, according to the legislation in force, subject to vetting due to his work as a legal assistant in the High Court until July 31, 2017, and had to undergo the re-evaluation process. 

In this line, on June 6, 2022, the observers of the International Monitoring Operation expressed their determination that Balla should undergo the re-evaluation process.

"Regarding the concrete circumstances that support this opinion, the international monitor assesses that the analysis of the administered/available documents and the analysis of the applicable law support the conclusion that Mr.
Alfred Balla has continuously had the status of the subject of reassessment and therefore the Commission should to continue its reassessment process," observers said. 

Even after Balla's maneuvers with e-mails, the lawsuit in the Administrative Court and the request to the Supreme Court, for the recognition of the status of the Counselor/Assistant non-magistrate at the Supreme Court, thinking that in this way the law did not cover to subject you to Vetting- ut, ONM did not withdraw from the analysis and the conclusion that Balla should definitely submit to this process. 

"Alfred Balla ështësubjekt rivlerësimi dhe, si i tillë, duhet t’i nënshtrohet procesit të rivlerësimit. Për më tepër, statusi që z. Balla kishte në momentin e hyrjes në fuqi të ndryshimeve kushtetuese, nuk është hequr apo zhdukur gjatë kohës dhe nuk është ndikuar nga fakti që z. Balla nuk ushtronte më detyrën e Ndihmësit ligjor jomagjistrat dhe u bë anëtar i Këshillit të Lartë të Prokurorisë", u theksua nga ONM.

Këtu hyn në lojë Komisioni i Pavarur i Kualifikimit. 

Fillimisht ky komision, pas marrjes edhe të opinionit nga ONM-ja për Ballën, njoftoi këtë të fundit që nuk e pranon kërkesën e këtij dhe se do vazhdohet me procesin e rivlerësimit.

"Pas administrimit të këtij opinioni të vëzhguesit ndërkombëtar, trupi gjykues i Komisionit, me email-in e datës 9.11.2022, ka njoftuar subjektin e rivlerësimit, z. Balla, ndër të tjera, se [...] Trupa gjykuese... mori në shqyrtim kërkesën tuaj për përfundimin e procesit tuaj të rivlerësimit pa një vendim përfundimtar, dërguar me email e datës 10.1.2022. Kjo trupë gjykuese, pas shqyrtimit të kërkesës tuaj vendosi mospranimin e kërkesës tuaj dhe kryerjen e procesit të rivlerësimit për ju si një subjekt i ligjit nr. 84/2016", njoftoi KPK-ja. 

Manovra tjetër që bëri Balla

Pas marrjes së përgjigjes nga KPK-ja, ai kërkoi që procesi i vetting-ut ndaj të tij të pezullohej deri në përfundimin e procesit gjyqësor dhe daljen e gjykatës me një vendim të formës së prerë lidhur me çështjen e pasjes ose jo nga ana e tij të statusit të Këshilltarit të Gjykatës së Lartë.

Duke parë këtë situatë, nuk mungoi edhe një rekomandim nga ONM-ja. 

"Ankimi i bërë nga subjekti i rivlerësimit Alfred Balla nuk është nga ato që ligji në fuqi i parashikon shprehimisht si të pranueshme në këtë fazë të procedimit. Prandaj ankimi duhet të refuzohet nga Komisioni, e cila rekomandohet të mos dërgojë dosjen në Kolegj për të shmangur vonesat e panevojshme, dhe të vendosë sipas ligjit [...]", thuhej nga vëzhguesit. 

Më pas, në janar të 2023, ONM-ja i vendosi një ultimatum KPK-së që duhet të merrte hapa hetimorë konkretë në drejtim të vlerësimit të pasurive të subjektit të rivlerësimit, Alfred Ballës. 

Ndërkohë, kreu i KLP-së ndodhej nën procedurat e vetting-ut çështja ishte në Gjykatën Administrative të Apelit. Kjo e dyta vendosi në mars 2023 të prishë vendimin e Shkallës së Parë dhe të rrëzojë padinë. Në shkurt të vitit 2023, ai hoqi dorë nga padia dhe paraqiti në Këshillin e Lartë Gjyqësor edhe kërkesë për heqje dorë nga njohja/pasja e statusit të Këshilltarit/Ndihmësit ligjor pranë Gjykatës së Lartë.

Këtu gjeti edhe shteg KPK-ja që të merrte vendim që Balla të mos bëhej pjesë e Vettingut. Trupa gjykuese e KPK-së arsyetoi se Balla nuk kishte dhënë dorëheqjen dhe se statusin e kishte humbur për shkak se ishte shkarkuar nga kreu i Gjykatës së Lartë në korrik 2017.

"The Public Commissioner, supporting the assessment of the international observer, on the status of the subject and the progress of the reassessment process, finds that the reasoning of the Commission that: [...] the subject of the reassessment, Mr. Alfred Balla, has finally lost the status of the subject of re-evaluation related to his previous function, from which he was dismissed (even though he is still in the system, but due to a later legal event by the Assembly) [...], does not find support in the law, in the jurisprudence of the College , and not even in the factual circumstances of the concrete case" decision of the KPK. 

So, the KPK is the institution that ignores the opinions of internationals about Alfted Balla. On the procedural side, ONM insisted that Balla submit to the process, but the next "missionary" of the power against SPAK, found tricks to escape. 

In this whole process, not a single step was missing since the Public Commissioner asked the Special Appeal Board in June of last year to change two decisions of the KPK for Alfred Balla.

The first is not to interrupt the re-evaluation process for Balla. The Public Commissioner, Florian Ballhysa, asks the KPA to change the decision of the KPK on Alfred Balla and that the termination of the vetting process against him be accompanied by the sanction that prohibits his appointment in the justice system for 15 years./ CNA
