Violation of equality in public tenders and auctions/ GJKKO sentences Denis

The Special Court today found Denis Xholi guilty and sentenced him to 1 year and 6 months in prison, accused of violating equality in public tenders and auctions.

Xholi has also been banned from administration and public functions for the next 5 years.

The sentence will be served in a normal security prison.

The full decision of the GJKKO:

"The Special Prosecutor's Office against Corruption and Organized Crime has submitted to the Court the request with the object: Trial of the criminal case pertaining to criminal proceedings no. 9, of 2022, with defendant Denis Xholi, accused of committing the criminal offense "Violation of equality of participants in tenders or public auctions", committed in collaboration, provided for by articles 258 and 25 of the Criminal Code".

The trial of this case was conducted under the rules of ordinary trial. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime, with a panel composed of judges Etleva Deda, Elsa Ulliri and Bib Ndreca, with decision no. 61, dated 30.09.2025, decided:

"Violation of equality of participants in tenders or public auctions", (before the amendments to Law 43/2021), committed in collaboration, provided for by Articles 258 and 25 of the Criminal Code and its punishment of 1 (one) year and 6 (six) months of imprisonment.

-In application of Article 35 of the Criminal Code, the right to exercise public functions for the defendant Denis Xholi for 5 (five) years.

-Based on Article 33 of the Criminal Code and Article 15 of Law No. 81/2020 "On the rights and treatment of prisoners and detainees", the defendant Denis Xholi will serve his sentence in one of the institutions for adult prisoners and ordinary security. /CNA
