Fictitious procedure for the purchase of goods, 4 officials of Devoll

They carried out fictitious procedures for the purchase of construction goods for the Devoll Municipality and did not perform any work, 4 officials were suspended from their duties.

Officials with the initials GK, AC, KM, and EM are under investigation for 'Misuse of Duty' and Forgery of documents' provided by articles 248 and 186 of the Criminal Code.

Notice of the Prosecution:

The prosecution at the Court of First Instance of Korçë General Jurisdiction requested the suspension from duty of four officials of the Municipality of Devolli, citizens GK, AC, KM, and EM under investigation for the Criminal Offenses of 'Abuse of Duty' and Forgery of Documents' provided by articles 248 and 186 of the Criminal Code.

As part of the investigation of the criminal report no. 577 of 2023, it was found that the persons in question have carried out the procurement procedure with the object of purchasing construction material goods for the needs of the Municipality. But after the winner was declared, the defendants were accused of having fictitiously carried out both the procedure of receiving and storing the goods and equipment, as well as their removal from storage and use for various works by the municipality employees. The complainant claims that no goods were purchased.

During the investigations of the prosecution, from the administration of the film footage for the period of the investigation, no loads of construction materials are seen entering and leaving. Following the conclusions drawn by the experts, there are no new layers of gravel or any construction on the rural roads of the village.

From the conducted investigations, the Prosecutor's Office came to the conclusion that the employees of the municipality of Devolli, the citizens:

GK – Director of the Utility, Community and Administrative Services Agency;

AC – Responsible in the Public Services Sector;

KM – Responsible in the Transport Sector in the Public Services Agency; AND

EM – Storekeeper in the Financial Management Sector. have consumed the criminal offenses 'Abuse of duty' and Forgery of documents'.

The investigation proved that the act of receiving the materials on 21.09.2022 does not reflect the actual delivery of all materials. In this sense, according to the prosecution body, the persons must bear criminal responsibility for the above crimes. Based on the request of the Prosecutor's Office, the court decided to suspend the municipal employees from their duties./ CNA
