Criminal liability of institutions that should have investigated Irena Gjoka

The opposition publicly denounced that there was a criminal verdict against Irena Gjoka and that the latter, a judge at the GJKKO, had lied at the time of the vetting and for this reason should be removed from the justice system.

The opposition released the documents and facts. But at the moment it was published, no one started the investigation in the first place, neither the ILD (High Inspector of Justice), nor the General Prosecutor's Office, perhaps not even SPAK itself, when in fact everyone saw that the opposition was releasing documents.

Then it was Adriana Kalaja and Gazment Bardhi who took the official documents to the institutions, when many could have started the investigation, but someone prevented them.

The General Prosecutor's Office stated that it was verifying the case.

What did he do?

Instead of conducting a full administrative investigation, the Prosecutor General, after receiving the documents, did not send them to the ILD for disciplinary action. The Prosecutor General's Office did not forward to SPAK for criminal proceedings the finding of fact and evidence that Irena Gjoka was convicted in Greece and was aware of it, having also contacted a lawyer.

But the General Prosecutor's Office forwarded the file with the findings to the High Judicial Council.

Apparently, without results of the disciplinary investigation, because if there were results of the disciplinary investigation, they should have been forwarded to the ILD or SPAK.

The question arises: why did he take it to the Supreme Court and why without the results of the disciplinary investigation? Why didn't he take it to SPAK or ILD, when the fact was there?

On the other hand, the Supreme Court closed the case after "investigating" and said that it was not a case for it and did not even return it to the Prosecutor General to bring the results of the disciplinary investigation. The Supreme Court did not forward it to either SPAK or ILD, and neither did the Prosecutor General.

So who is protecting Irena Gjoka?

Let's go further. A member of the Supreme Court of Kosovo, with his own will and initiative, then forwarded Irena Gjoka's file to the ILD for its jurisdiction, and the latter announced that a disciplinary investigation had begun.

Now, what did the ILD do two years ago, since the denunciation of Irena Gjoka, to now tell us that verification for disciplinary violations has begun?

What did the ILD do during the two years, sit and read the newspapers? Couldn't it start the investigation itself? If the case was the ILD's and the ILD now started the disciplinary investigation, why didn't it get these documents for two years in a row? Berisha had published the documents, he could have verified them and could have started the disciplinary investigation, but he remembered now.

Who hindered the ILD for two years?

Who made the General Prosecutor's Office not send the letters to the ILD and SPAK, but to the Supreme Court? Who was the "mind" that intervened, that influenced the Supreme Court, so that the latter would not return them to the Prosecutor's Office for disciplinary investigation or send them to the ILD or SPAK?

Now the question arises as to why the Prosecutor General kept the file for two years and did not draw any conclusions? What is the reason? So, many questions remain unanswered, including: the Prosecutor General, the Supreme Court, the ILD and perhaps to some extent even the SPAK.

And if Irena Gjoka is innocent, they should all be dismissed in turn: the ILD, the members of the KLGJ (except for the one who forwarded the documents to the ILD), and the Prosecutor General because they did not act when they had all the facts and evidence, which showed that a judge of the GJKKO was convicted in Greece and she was aware of it, as we emphasized above, after she had also contacted her lawyer.

Then, either this woman is innocent and those documents are fake, or the ILD, the Attorney General, and the Supreme Court should all be dismissed.

And if they want a Justice Reform, this is the case when this reform "gets water".

Either Judge Irena Gjoka is innocent and if it turns out that way, they should all be dismissed again, because for two years in a row they did not solve this problem.

Even if she is guilty, they should all still be dismissed, as their delays and inactions have left a blackmailable judge in the system, caught and convicted, who cheated in the vetting./ CNA
