The prosecution at the Court of First Instance of Fier General Jurisdiction has completed the investigations and sent the company 'E...' to court. shpk and its administrator, citizen AK, for the criminal offense of 'Non-payment of taxes and duties', provided for by Article 181 of the Criminal Code.

From the investigations within the criminal proceedings no. 176 dated 14.02.2020, it was proven that the company "E..." Sh.pk, carries out its commercial activity with the object of activity, among others, "Design and implementation of the construction of multi-storey houses, road and infrastructure works, civil and industrial constructions, etc." During the exercise of the activity towards the company, tax liabilities have arisen which have not been paid with a total value of 8,884,799 ALL.

The investigations proved that although a tax liability was identified against this entity, administrative measures were taken in order to collect the liability, but it was not paid off by the administrator of the company. The prosecution documented the fact that the subject has been in the conditions of solvency since, in the subject's account, considerable sums of money have been transferred, poured, withdrawn in cash, during the time that the obligation existed. In the same way, the fact was documented that during this period, the administrator of the company, not only did not take the necessary measures to pay off the obligations, but that on his part active actions were taken by withdrawing cash from the bank account of the company monetary value , as soon as the amounts were transferred to the account.

At the end of the investigations based on the law no. 9754, dated 14.6.2007, "On the criminal responsibility of legal entities", as well as article 181 of the Criminal Code, the Prosecutor's Office at the Court of First Instance of the General Jurisdiction Fier, has sent for trial criminal proceeding no. 176 of 2020, in charge of the defendants the company "E..." Sh.pk, and its administrator, citizen AK with the accusation of committing the criminal offense "Non-payment of taxes and duties" provided by Article 181 of the Criminal Code.
