Illegal construction inside the hospital/ Fier Prosecution sends former director

Announcement: 

The Prosecutor's Office at the First Instance Court of General Jurisdiction in Fier has completed the investigations and is sending to trial citizen PV, accused of committing the criminal offense of 'Abuse of office' provided for by Article 248 of the Criminal Code, and citizens Xh.B., J.Sh., KL and A.Sh., accused of the criminal offense of 'Forgery of documents' provided for by Article 186/3 of the Criminal Code.

From the investigations conducted on criminal proceedings no. 831 of 2021, it was proven that:

- The defendant PV, in his capacity as director of the “Ihsan Çabej” Hospital in Lushnje, ordered the construction of the extension called the “connecting bridge between the pathology and infectious disease wards” without obtaining a construction permit from the competent authorities, changing the destination of the budget fund foreseen to cover the implementation of the maintenance contract no. 670/1, dated 05.06.2019, without following the relevant legal procedure and avoiding the public procurement procedure. Also, the situations of the works that according to this defendant were carried out on the “connecting bridge”, contain more works than those actually carried out, which has brought an unfair benefit to the company “D...” and economic damage to the state budget.

- Defendants Xh.B., J.Sh., KL in their capacity as members of the committee for monitoring the implementation of maintenance contract no. 670/1, dated 05.06.2019, have drawn up the minutes of 17.02.2021 on the works carried out in the oxygen warehouse as well as the minutes of 30.04.2021 on the works carried out in the infectious disease ward; none of which was actually carried out.

- Defendant A.Sh. in the capacity of the technical director of the company and the engineer implementing the maintenance contract no. 670/1, dated 05.06.2019, concluded by the company “D...” shpk, has drafted the final situation for the works carried out during the period 03.01.2021 to 25.05.2021, the situations of the works carried out in the oxygen warehouse and in the old infectious disease ward, and together with the commission established by the “Ihsan Çabej” Hospital in Lushnje, have drafted the minutes of 17.02.2021 on the works carried out in the oxygen warehouse as well as the minutes of 30.04.2021 for the works carried out in the infectious disease ward; which in fact were not carried out. Based on these situations and minutes, expenditure order no. 711, dated 29.12.2021, was issued for the payment of the company "D..." shpk.

In the following, the Prosecutor's Office at the First Instance Court of General Jurisdiction in Fier expresses its full commitment and the legal responsibility of all state employees or public servants who commit criminal offenses against state activity./CNA
