The draft law on confiscated buildings is approved/ Buildings will be sold at

The government has approved a draft law that defines the powers and duties of public authorities responsible for confiscated buildings.

According to the draft law, the right of ownership is recognized to the owners of the land on which the object was built in excess of the construction permit.

Land owners, the construction entity, as well as third parties who have a legal-civil agreement for the confiscated property have the right of pre-emption at the market value

If the parties mentioned above do not show interest in the objects, then the confiscated objects are put up for public auction. 

If the auction fails, its price in the second round does not decrease, but remains the same again. 

The program for the sale of confiscated objects is carried out by the ministry responsible for the administration of state property, through the structure responsible for the sale of public property.

Also, a structure called the Commission of Confiscated Objects is expected to be created, with 9 members, including 2 representatives from the Prime Minister. They will assess the condition of the confiscated objects on a case-by-case basis and propose how they will be used.  

We remind you that this draft law comes 9 months after the decision to confiscate constructions without a permit or those in excess of the construction permit./ CNA.al
