"Legislation on non-functional parties"/ ISP: Time for deep reform

The Institution of Political Studies, through a study, shows that Albania has an active register of political parties, most of which are not functional, do not participate in electoral processes and do not fulfill any of the functions of political parties nor the conditions of their existence.

ISP emphasizes that based on the monitoring and legal analysis of experts, it says that the legislation on parties is old, non-functional, based on a different political reality and hinders the transparency and accountability of political parties.

ISP beson se një sistem partiak me integritet bazohet në legjislacion me integritet, në transparencë dhe llogaridhënie, ndërsa nënvizon se është koha për reformë të thellë profesionale dhe afatgjatë në legjislacionin e partive politike.

“Partite politike jane elementi jetesor per ekzistencen e pluralizmit dhe nje demokracie konkurruese, por partite fiktive politike jane element thelbesor i deformimit te sistemit politik, te pluralizmit dhe te demokracise.

Shqiperia ka nje regjister aktiv te partive politike, shumica e te cilave nuk jane funksionale, nuk kane pjesemarrje ne proceset zgjedhore dhe nuk plotesojne pothuajse asnje prej funksioneve te partive politike dhe as kushteve te ekzistences se tyre.

Bazuar ne monitorimin dhe analizen juridike te eksperteve te ISP, legjislacioni mbi partite eshte i vjeter, jo funksional, i bazuar ne nje realitet tjeter politik dhe pengues per transparencen dhe llogaridhenien e partive politike. Shumica e vendeve europiane kane regjister publik te partive, i cili perditesohet cdo vit me depozitimin e dokumenteve baze dhe verifikimin e tyre nga nje institucion pergjegjes, tri standarde qe nuk aplikohen ne rastin shqiptar. Fiktiviteti i partive ka çuar ne fiktivitet te perfaqesimit ne parlament dhe ne fiktivitet te grupeve parlamentare, fiktivitet ne financimin elektoral dhe posedimin e selive shteterore dhuruar partive politike, si dhe ne trafikim te partive dhe logove te tyre ne prag te fushatave elektorale.

ISP believes that a party system with integrity is based on legislation with integrity, transparency and accountability. The Constitution of RSH, Article 9 emphasizes the principle of freedom, democratic functioning and transparency, principles that contradict the current reality of political parties.
