Constitutional Court: Vetting in SPAK is legal

The Constitutional Court has rejected the request of several people within the justice system who wanted to attack SPAK, making a request to remove vetting in SPAK, an extremely important filter.

In a decision dated 23.04.2025 , the Constitutional Court decided to leave the vetting in SPAK in force.

The Constitutional Court ruled today that this vetting is legal and every action taken is legal.

Constitutional Court: Vetting in SPAK is legal

Persons who will be appointed as judges in the GJKKO or prosecutors in the SPAK must pass a vetting procedure determined by law.

This second type of vetting, which goes much deeper and in more detail, has already been left in force by the Constitutional Court, which has rejected the request of the persons who filed the complaint.

The Constitutional Court has left in force the vetting and actions taken by SPAK for prosecutors and judges who have been excluded from going to the GJKKO or SPAK.

This type of filter is quite important and has shown that it can stop unsuitable people from taking office in the GJKKO and SPAK.

It is precisely this type of filter, this type of vetting that is worrying for people within the justice system, who requested that it not exist before taking office, and therefore sent a request to the Constitutional Court to review whether or not the filter that SPAK performs should exist.

Every filter, every scan, every vetting that takes place in such justice-level structures is necessary.
