Journalist Odeta Gjevori has brought back an article where the scandal of the judge in Fier, Miranda Nakaj, regarding the case of violence against the journalist and cameraman Igli Zeli is highlighted.

For this case, for which there is film footage and the violence is proven, as in no other country in the world, the judge in Fier has decided to ignore them and wants to hear 25 witnesses who have been called by the accusing party as violent.

This clearly shows that we have a trick on the part of the judge, who is trying to drag out the case endlessly.

In front of this judge stand a series of monitoring institutions, as responsible as she is for the mudslide they have brought the justice system to in this country.

A trial in the Court of Fier where the notary Anila Haxhiu and her ex-husband Ilir Haxhiu (only on paper as they live together at the same address), are accused of violence against the journalist Odeta Gjevori and the operator Igli Zela of the investigative show STOP on TV Klan can serve as a benchmark for the level at which the new justice has ended.

That justice for which millions of euros of European and American taxpayers have been invested, but from which there is little hope of getting justice, especially at an optimal time.

You can find an example of this in the court of Fier, with judge Miranda Nakaj, in a case that is as simple as it is proven.

But it takes a little will, good will, not to favor the parties, but to give a decision, based on evidence and facts, in real time, thus avoiding the game of introducing the case into a vicious circle in the hope that the abused they will get bored one day and retire.

One of the vetting criteria, which Judge Nakaj has passed in the first instance (KPK), is precisely the professional assessment, where one of the components is the quality of the decision and the time for its announcement.

At least this criterion must be respected by Nakaj, since he passed the vetting in the first instance, and he must protect the image of the KPK troop, who do not put it in vain when they evaluate judges and prosecutors.

To simplify the matter: Miranda Nakaj is judging the claims of a journalist and a cameraman who were raped by the notary Anila Haxhiu and her ex-husband Ilir Haxhiu (divorced only on paper as they live in a house which is a rare case in Albania when a couple divorces) , as they were investigating a case where the violent notary was part of the investigation.

The violence is proven, there is footage from the TV KLAN group, but also the security cameras in the area, even those that monitor Haxhiu's notary office.

But the judge has decided not to see these images, they do not seem like material evidence submitted by the Prosecutor's Office and may go down in the world history of people of justice who do not value film footage as evidence.

He chose to listen to 25 witnesses who were called by the accused party as violators, and this is the trick that Judge Miranda Nakaj has chosen to endlessly prolong a fair and correct trial.

She can hear not 25, but even 2500 people, as well as she can call all the residents of Fier as witnesses, even jump to Lushnje, but it does not help her to deliver justice.

On the contrary, it raises many questions about her professionalism, and may even make not only those in the KPK feel ashamed, but also her pedagogues from Jurisprudence to Magistrates.

Film footage is evidence, clear even for any event, so in an investigation, trial or any case where there is an event, the first thing that is done is the collection of film footage, then the testimonies, analyzing the evidence, facts and announcing the the decision.

Through those images, maybe Judge Nakaj can blame the journalists of TV KLAN, who can deceive when they accuse the notary, just as she can put her shoulders against the wall accused as a rapist Anila Haxhiu. If the judge feels under pressure, in a conflict of interest or if she feels unable to give a fair decision, it is understood that there is always a solution: to waive the judgement. This is not a shame. It's a shame when you try to hide, delay, maybe even favor one side, finding mechanisms to delay the process or inventions like "I don't have much time for 5 or 10 minutes of filming, but I have time to listen to 25 witnesses".

And this judge does this in the name of new justice. And in front of her are a series of monitoring institutions, just as responsible as this judge for the mess they have brought the justice system to in this country.

The notary, with or without another party, has been publicly identified as a violator of journalists, who were investigating a case of fraud involving the husband or ex-husband of the notary, who had undertaken to draw up the contracts.

So a public official, such as the NOTARY, who had to go through checks for the investigation of journalists, has the courage to rape, with the help of her husband or ex-husband, journalists and cameramen.

And here the question arises: who protects this notary so much? Politically, we know that she is a member of the former LSI, but we do not yet know if she joined the PL of Meta, or if she joined any of the other parties. We are bringing this detail to your attention to understand why the delegates of LSI/PL or PD in Fier do not react when journalists are violated. On the day of media freedom, only MP Ina Zhupa raised the case in the assembly, according to her, this case is also to discourage other journalists who will not find justice in the courts and will only drag on. As always, no one reacted from the majority who talk a lot about justice reform and free press. Journalist Odeta Gjevori and cameraman Igli Zela were on a public mission, they did not go there for their own reasons, and therefore protection and awareness should be a duty... And we are telling this detail so that at least these delegates do not feel "guilty" for not they are helping the violent notary to diminish her act as much as possible.

But the question is: what do the inspectors of Ulsi Manja, the Minister of Justice, do when a notary is proven that, in addition to being involved in an affair, she also abuses and threatens her?

Will Artur Metani's ILD find the time to follow the court proceedings in question and at least certify the skills of Judge Miranda Nakaj and let them enter the Guinness, maybe these partner countries can also be referred to as a practice, that the footage of do not consider evidence…/ CNA
