They caused 60 million ALL damage to the state/ The prosecution requests arrest

The Prosecutor's Office at the Court of First Instance of the General Jurisdiction in Tirana, referred by the Directorate of Tax Investigation in the framework of criminal proceedings no. 6684, year 2023, requested coercive security measures for seven people, including a former employee of the National Center of Business, for the Criminal Offense "Creation of fraudulent schemes in relation to value added tax", provided for by Article 144/ai of the Criminal Code.

From the analysis of the facts, it was proven that 17 commercial entities were created and registered fictitiously by means of forgeries, all with shareholders, administrators and members of the management board, foreign citizens, namely 15 citizens from countries such as Cuba, Spain, Germany , Croatia, Malta, Belgium, Italy, India, Bangladesh.

All 17 commercial entities made fictitious sales in the amount of 200,000,000 ALL, causing damage to the state in the amount of 60,000,000 ALL. From the verification carried out, these entities have never had employees, tools or secondary addresses to perform the works they invoiced. From the data of the TIMS system, it results that all 15 foreign citizens who have signed the registrations of subjects at the CKB, have not entered the territory of Albania at any time. The documents submitted by these entities to the KKB, second-level banks (mandate magesa kapitali), the appointment of accounting experts in their statutes, were proven to be forged.

In total, fictitious entities have made sales worth ALL 192,622,898 (data from the self-declaration). These values, which are suspected to be fictitious, have been billed only to the entity that operates in the chrome field.

The person under investigation, citizen AD, (former specialist at the Vlora CCA), was able to register four commercial entities, with the status of Sh.A. (joint stock company). While the other person under investigation, citizen A. Ç. (economist), created the conditions to supply third parties through fictitious entities for which he had access to their systems as well as tax documentation (VAT blocks).

As above, the prosecution suspects that the citizens A.Ç., AD, ML, AA, RR, AA, FD, should be investigated for committing the criminal offense "Creation of fraudulent schemes related to the value added tax", provided by the article 144/a, 180, 300 and 190 of the Criminal Code and requires:

1- The determination of the security measure "arrest in prison" for the person under investigation A.Ç. For the criminal offense provided for by Article 144/ai of the Criminal Code;

2- The determination of the insurance measure "Compulsion to appear before the judicial police" for the person under AA investigation for the criminal offense provided for by Article 300 of the Criminal Code;

3- The determination of the security measure "Compulsion to appear before the judicial police" for the person under ML investigation for the criminal offense provided for by Article 300 of the Criminal Code;

4- The determination of the security measure "Compulsion to appear before the judicial police" for the person under RR investigation, for the criminal offense provided for by Article 300 of the Criminal Code;

5- The determination of the security measure "Compulsion to appear before the judicial police" and "Prohibition of exiting the country" for the person under FD investigation for the criminal offense provided for by Article 300 of the Criminal Code.

6- The appointment of the security measure "Compulsion to appear before the judicial police" and "Prohibition of exiting the country" for the person under AA investigation for the criminal offense provided for by Article 300 of the Criminal Code; AND

7-Determining the security measure "House arrest" for the person under AD investigation for the criminal offense provided for by article 190 and 300 of the Criminal Code./ CNA
